On June 29, 2006, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development to install a nine-foot by nine-foot awning over an existing sidewalk cafe for the Outback Steakhouse restaurant at the Pelican Walk Shopping Center in the Tourist District, under the provisions of Section 2-802.0. The DRC recommended approval of the application under the following bases and condition: Bases for Approval: 1. The proposal complies with Flexibility criteria under the provisions of Section 2-802.0.; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area and with the existing shopping center. Condition of Approval: 1. That the color of the awning be white to match the trim and architectural features of the building. I concur with the findings of the Development Review Committee and, through this letter, APPROVE your application for Flexible Standard Development. The approval is based on and must adhere to the site plan and application dated received June 9, 2006. Pursuant to Section 4-303, an application for a building permit shall be made within one year of Flexible Development approval (June 30, 2007) (note: Building Permit #BCP2006-04845 has already been submitted). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Time frames do not change with successive owners.
