On December 7, 2006, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval to increase the permitted gross floor area of a two car detached garage with a second floor habitable area (accessory structure) from ten percent (267 square feet) to 24.72 percent (660 square feet) of the Detached Dwelling Use (principal use) and an increase in building height from 15 feet to 17.90 feet to midpoint of pitched roof under provisions of Section 3-201.B. The DRC recommended approval of the application with the following bases: Findings of Fact and Conclusions of Law: 1. The proposal complies with the Detached Dwellings criteria under provisions of Section 2- 203.B.; 2. The proposal complies with the Accessory Use/Structure standards under provisions of Section 3-201.B.; 3. The plan complies with the General Applicability Criteria under the provisions of Section 3- 913; 4. The accessory structure shall not be used as a dwelling unit; and 5. The proposed development is compatible with the surrounding area. Conditions of Approval: 1. That the habitable area in the accessory structure never be used as a dwelling unit; 2. That under no circumstance shall any structure(s), including building overhangs, be constructed within any easements; 3. That all existing and new mechanical equipment be screened from view of adjacent properties and street rights-of-way; and 4. That all Fire Department requirements are met. M w otr February 2, 2007 O'Connell - Page Two I concur with the findings of the DRC and, through this letter, approve your application for Flexible Standard Development. The approval is based on and must adhere to the site plan date stamp received January 30, 2007. Pursuant to Section 4-303, an application for a building permit shall be made within one year of Flexible Standard Development approval (February 1, 2008). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Time frames do not change with successive owners. The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. If you have any question, please do not hesitate to call Steven Everitt, Planner H, at 727-562- 4547. LINCOLN AVE (FLS2000-10064) Mr. Steven Everitt, As a homeowner within 500 feet of 507 N. Lincoln Ave. I am in strong objection with the addition of an apartment dwelling at this location. This is not in the best interest of the Country Club Estates neighborhood. I also believe it is not in compliance with the residential zoning of the Country Club Estates neighborhood. This would not even be considered in some other Clearwater neighborhoods, why here? I went to look over the said property and observed no two-car garage. The only out building I observed was what I would refer to as an oversized shed. I really do not believe that the square footage of this measured 267 square feet unless it was the roof over hang the was used for this measurement. Increasing this area to 660 square feet would be an increase of 147%. Based on what I observed, information in said NOTICE is not correct. I am not sure why this is even being considered. In 1989 when I was adding on to my home, the fact that the plans indicated an electrical outlet and sink connections in the lanai area required that I and my wife sign a court document stating that we would not turn the house into duplex living under the penalty of a $500 a day fine. Foster [chevy.mac3@verizon.net] Sent: Thursday, November 09, 2006 6:45 PM To: Everitt, Steven Subject: Notice of filing an application for flexible standard development approval at 507 N. Lincoln Ave (FLS22006-10064) Mr. Everitt, I am a property owner within 500 feet of 507 N. Lincoln Ave. If I understand the notice you sent out correctly, an application has been filed to increase the square footage normally allowed on a two car detached garage from 267 square feet to 660 square feet at 507 Lincoln Ave N. I appreciate being notified. As it happens, I have very strong feelings about this. I am very much against this for two reasons. One, I am concerned about the aesthetics from my property. Two, and most importantly, I am extremely concerned about the probable transient tenants who will occupy the structure above the garage. I am sure the petitioner will tell you that it is for a "relative" or "friends" or "storage." However, we have other neighbors who make this same claim. None of the multitude and constantly transient "friends" are in actuality friends, nor are they family. Neighbors have filed complaints, but nothing has been done. I have children and am very concerned about their safety. I do not want to see 507 add more living area as it is, but to change zoning in order to do so is totally unacceptable to us. Thank you for giving me this opportunity to express my view. Please contact me if there is anything else I can do to participate in the review of this application. 443-3640 Home 743-7507 Cell Sincerely, Barbara Foster 11/20/2006 BUILDING PLANNING 6 R303.4.2 Exhaust openings.
