FLD2005-02023/PLT2005-00005 111 Kenwood Avenue Dear Ms. Damiani: This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community Development Code. On May 17, 2005, the Community Development Board reviewed your requests for (1) Flexible Development approval to permit two attached dwellings with a reduction to the minimum lot area from 15,000 square feet to 9,486 square feet, a reduction to the minimum lot width from 150 feet to 70 feet and a deviation to permit parking that is designed to back into the public right-of-way, as a Residential Infill Project, under the provisions of Section 2-404.F; and (2) Preliminary Plat approval for a two lot subdivision, under the provisions of Section 4-702. The Community Development Board (CDB) APPROVED the applications with the following bases and conditions: Bases for Approval: 1. The proposal complies with the Flexible Development criteria as a Residential Infill Project per Section 2-404.F. 2. The proposal is in compliance with other standards in the Code including the General Applicability Criteria per Section 3-913. 3. The development is compatible with the surrounding area and will enhance other redevelopment efforts. Conditions of Approval: 1. That the final design and color of the building be consistent with the conceptual elevations submitted to, or as modified by, the CDB; 2. That a Final Subdivision Plat be approved by City Council and recorded in the public records prior to the issuance of any permits; 3. That prior to the issuance of any permits, the Landscape Plan be amended, acceptable to the Planning Department, to indicate the site visibility triangles, ensure the provision of foundation and perimeter landscaping to Code requirements, provide a variety of trees in concert with the existing tree canopy of the site and adjacent parcels, ensure proper irrigation of the property and ensure that plant quantities are accurate; 4. That trash containers stored outside the dwelling be screened from view; 5. That all Parks and Recreation fees be paid prior to the issuance of any permits; 6. That all Fire Department requirements be met prior to the issuance of any permits; and BRIAN J. That, prior to the issuance of any permits, the site plan be revised to show the building designed at a setback 38 -39 feet from the front property line in order to accommodate two vehicles front to back in the driveway and/or the driveway be widened on both sides to have a flared, paved parking space adjacent to the driveway shown, acceptable to the Traffic Engineering Department. Pursuant to Section 4-407, an application for a building permit shall be made within one year of Flexible Development approval (May 17, 2006). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Time frames do not change with successive owners. The Community Development Coordinator may grant an extension of time for a period not to exceed one year and only within the original period of validity. The Community Development Board may approve one additional extension of time after the community development coordinator's extension to initiate a building permit application. The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. Additionally, an appeal of a Level Two approval (Flexible Development) may be initiated pursuant to Section 4-502.B by the applicant or by any person granted party status within 14 days of the date of the CDB meeting. The filing of an application/notice of appeal shall stay the effect of the decision pending the final determination of the case. Ms. Liliana Damiani 111 Kenwood Avenue CITY OF CLEARWATER PLANNING DEPARTMENT STAFF REPORT GENERAL INFORMATION: ORIGINAL REQUEST: (1) Flexible Development approval to permit two attached dwellings with a reduction to the minimum lot area from 15,000 square feet to 9,486 square feet, a reduction to the minimum lot width from 150 feet to 70 feet and a deviation to permit parking that is designed to back into the public right-of-way, as a Residential Infill Project, under the provisions of Section 2-404.F; and (2) Preliminary Plat approval for a two lot subdivision, under the provisions of Section 4- 702 (PLT2005-00005). EXISTING ZONING/ Medium High Density Residential (MHDR) District; Residential LAND USE: High (RH) Category PROPERTY SIZE: 0.217 acres; 9,486 square feet PROPERTY USE: Current Use: Vacant Proposed Use: Attached dwellings (two units - townhomes) ADJACENT ZONING/ North: Medium High Density Residential District; Vacant and LAND USES: attached dwellings East: Medium High Density Residential District; Detached dwellings South: Medium High Density Residential District; Attached and detached dwellings West: Medium High Density Residential District; Detached dwellings CHARACTER OF THE IMMEDIATE VICINITY: The surrounding area is a mixture of attached dwellings and detached dwellings. Commercial uses are to the south along Staff Report - Community Development Board - May 17, 2005 Cases FLD2005-02023/PLT2005-00005 - Page 1 of 7 Cleveland Street. The Verizon utility/infrastructure facility and parking lot is farther to the east. ANALYSIS: Site Location and Existing Conditions: The 0.217 acres is located on the east side of Kenwood Avenue, approximately 300 feet south of Drew Street. The site is currently vacant and has 70 feet of frontage on Kenwood Avenue. The parcel was previously developed with a detached dwelling that was demolished in September 2003, due to it being unsafe. A similarly sized lot abuts to the north, which is also vacant. The parcel to the south is developed with a four-unit apartment building, with the building oriented east/west, but with the units oriented north/south. The surrounding area is developed with both attached and detached dwellings. Parking for the apartments to the northwest of the subject property at the southwest corner of Drew Street and Kenwood Avenue is located partially located within the right-of-way and requires vehicles to back into the street to exit. Proposal: Due to the size of the parcel and the maximum density allowed under the Residential High land use category, this parcel could be developed with a maximum of six dwellings. The proposal, however, is to develop the property with two attached dwellings, townhome-style, in a two-story building. Each unit is proposed with 2,127 square feet of enclosed floor area, including the one-car garage. An optional, large 10-foot deep by the width of the dwelling patio at the rear of the unit is proposed. The residential building meets and exceeds all required setbacks. The building is proposed to have a stucco finish, painted "Homestead Resort Tea Room Yellow" with white trim, and will have a shingle roof. Trees along the front of the lot will be removed, as these trees have been severely trimmed due to overhead utility lines within the right-of-way. Each dwelling will have black barrel trash collection service, with the black barrels stored to either side of the building. These trash barrels will need to be screened from view from the public right-of- way. A sidewalk will be constructed within the right-of-way of Kenwood Avenue for pedestrian safety, where no sidewalk presently exists. The two proposed townhome dwellings are compatible with adjacent lands uses, which is a mixture of attached and detached dwellings. The townhome units proposed for this parcel, processed as a residential infill project, will also upgrade the immediate vicinity. With two-story attached dwelling buildings abutting to the south and on either side of Kenwood Avenue at Drew Street, the proposal will be in harmony with the scale, bulk, density and character of the surrounding area. The proposal includes a reduction to the minimum lot area from 15,000 square feet to 9,486 square feet and a reduction to the minimum lot width from 150 feet to 70 feet. While the lot area amounts to a 36.8 percent reduction from that required and the lot width reduction amounts to a 53.3 percent reduction from that required, these reductions should be viewed in light of the proposed number of units. The proposed density is 9.21 units per acre, which represents a 66.7 percent reduction from the 30 units per acre allowed within the Residential High Category. The applicant is not attempting to build to the maximum allowable or overbuild this parcel, which is also reflected in the proposed setbacks (to building). The parcel to the south is the same lot area and lot width as the subject parcel and is developed with four attached dwelling units. The vacant parcel to the north is also the same lot area and width, which would also allow for the same allowable Staff Report - Community Development Board - May 17, 2005 Cases FLD2005-02023/PLT2005-00005 - Page 2 of 7 0 0 density. The flexibility requested in regard to lot area and width are justified by the benefits to community character of the immediate vicinity of this parcel, which includes detached dwellings, and the City of Clearwater as a whole. As mentioned above, each townhome dwelling is proposed with a one-car garage, with a singlewide driveway (11 feet wide each). The design requires that cars back out into the right-of- way to exit the site, which is a deviation requested as part of this proposal. The Community Development Code prohibits "back out" parking for any uses other than detached dwellings. The driveway length will permit a vehicle to completely "back out" of the garage, thus eliminating the garage walls as a potential view obstruction of the sidewalk and street. The development will operate as, and have the characteristics of, single-family detached homes, including the individual garages. The site is located on Kenwood Avenue, which is only one block in length between Grove Street and Drew Street, and only used by persons living or visiting homes or apartments on this street. From a traffic standpoint, this concept of "back out" parking for townhomes may be acceptable on a low volume street such as this. It should not be considered, however, as a precedent for deviation from the Code provision of restricting "back out" movement into the right- of-way for single-family residential uses only, and will be reviewed on a case-by-case basis. Due to the proposed front setback to the dwellings of 36.58 feet and the depth of the lot, the applicant could increase the front setback to 38-39 feet and be able to have two cars (one behind the other) within the driveway (as well as the one car in the garage) or be able to widen the driveway to have two cars side by side in a flared parking area (again two cars outside of the one-car garage). This could provide for off-street visitor parking. The proposal will minimize traffic congestion. The proposal includes the subdividing of this parcel into two townhome lots. The northern townhome lot is proposed with an area of 4,771 square feet and a lot width of 34.83 feet. The southern townhome lot is proposed with an area of 4,761 square feet and a lot width of 35.083 feet. A Final Subdivision Plat will need to be approved by City Council and recorded in the public records prior to the issuance of building permits. The Preliminary Plat otherwise meets Code requirements. Prior to the issuance of any permits, the Landscape Plan will need to be amended to indicate the site visibility triangles, ensure the provision of foundation and perimeter landscaping to Code requirements, provide a variety of trees in concert with the existing tree canopy of the site and adjacent parcels, ensure proper irrigation of the property and ensure that plant quantities are accurate. All applicable Code requirements and criteria including, but not limited to, General Applicability criteria (Section 3-913) and Residential Infill Project criteria (Section 2-404.17) have been met. Code Enforcement Analysis: There are no outstanding enforcement issues associated with this site. With the existing!Pte elevations at the proposed building being 39. 0 40.8, unclear why the FFE is proposed at 43.4 when the top of bank of the highest retention pond is 41 (?). Provide additional proposed grades at the front of the property. Provide cross sections through the proposed retention ponds. 2. Provide reduced (8.5" x 11 ") copy of the revised site plan for presentation purposes for the CDB meeting (and colored rendered if possible). 3. Provide the lot width for Lots 1 and 2 on the Preliminary Plat. 4. Provide the proposed height on Sheet C-1 from the mean elevation of the existing grade to the midpoint of the peak and eave heights of the primary, pitched roof structure. If the midpoint is over 30 feet, then a request to increase the building height from 30 feet to "x" feet must be part of the request. 5 . Unclear how northern unit will back out of unit and turn around on-site to head out onto roadway. Alternately, if it is the intent that they back into the right-of-way, this must be part of the request. 6. Suggested redesign of project: Code does not permit parking that is designed to back into the public right-of-way for attached dwellings generally, but the Planning and Engineering Departments have permitted such for town houses on a case-by-case basis, based on the street the property fronts upon. This location may be a good candidate to permit such vehicular movements (would need to be part of the request). Suggest possibly centering the building on the lot so that Lot 1 and Lot 2 are each 35 feet wide, running all the way through from front to rear property lines (thereby eliminating the common area), but need to look at existing tree locations. Parking would then be one car in the garage and one in the driveway. Each lot could also have a second (or third) parking space flaired off to the side (for visitors or so that the car in the garage could back out without moving the other car. The driveway apron needs to be shared between the two lots. This way each lot can "operate" independently without this common area (open parking area). 7. Revise the proposed density on Sheet C-1 to 9.216 units per acre. 8. If the site plan is revised to show parking backing into the right-of-way, suggest having a screened location on each lot for the black barrel. 9. All electric, telephone and cable lines must be underground on-site. 10. Show proposed location of outdoor air condensing units. Must be screened from adjacent properties and the street by Code approved materials. 11 . Show front door and adjacent window in front elevation. 12. If the project is redesigned to have only two lots, each running from front to rear property line (common area eliminated), then we can reduce the subdivision of the property to a Division of a Lot of Record. This is a reduce, non-City Council subdivision process that is cheaper and quicker. Advise. In reviewing the proposal. and the city of Clearwater Staff Report, I oppose the current plan. Living on Kenwood and watching the current parking situation I am concerned with the proposed parking layout. I would want the building to be moved to accommodate 2 cars parking end to end in the driveway without encroaching into the public sidewalk. I would also like to see the driveway widened to allow for an additional 2 cars. This would give the property ample parking and thus remove any potential need for street parking. These adjustments are the only items that I want to be made on the current proposal and with these adjustments I would then be in full approval of the proj ect. Thank You, 'J-0?? FLD2005-02023/PLT2005-00005 111 Kenwood Avenue Dear Ms. Damiani: This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community Development Code. On May 17, 2005, the Community Development Board reviewed your requests for (1) Flexible Development approval to permit two attached dwellings with a reduction to the minimum lot area from 15,000 square feet to 9,486 square feet, a reduction to the minimum lot width from 150 feet to 70 feet and a deviation to permit parking that is designed to back into the public right-of-way, as a Residential Infill Project, under the provisions of Section 2-404.17; and (2) Preliminary Plat approval for a two lot subdivision, under the provisions of Section 4-702. The Community Development Board (CDB) APPROVED the applications with the following bases and conditions: Bases for Approval: 1. The proposal complies with the Flexible Development criteria as a Residential Infill Project per Section 2-4041. 2. The proposal is in compliance with other standards in the Code including the General Applicability Criteria per Section 3-913. 3. The development is compatible with the surrounding area and will enhance other redevelopment efforts. , Conditions of Approval: 1. JONSON, COMMISSIONER "EQUAL EMPLOYMENT AND AFFIRMATIVE ACTION EMPLOYER" a May 18, 2005 Damiam - Page Two 7. Additionally, an appeal of a Level Two approval (Flexible Development) may be initiated pursuant to Section 4-502.13 by the applicant or by any person granted party status within 14 days of the date of the CDB meeting. The filing of an application/notice of appeal shall stay the effect of the decision pending the final determination of the case. The appeal period for your case expires on June 1, 2005 (14 days from the date of the CDB meeting). If you have any questions, please do not hesitate to call Wayne M.
