AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING CERTAIN REAL PROPERTY LOCATED ON THE
NORTH SIDE OF ANNA AVENUE APPROXIMATELY 700 FEET
WEST OF DORA DRIVE, CONSISTING OF LOT 30, ROLLING
HEIGHTS, WHOSE POST OFFICE ADDRESS IS 2328 ANNA
AVENUE, INTO THE CORPORATE LIMITS OF THE CITY, AND
REDEFINING THE BOUNDARY LINES OF THE CITY TO
INCLUDE SAID ADDITION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the owner of the real property described herein and depicted on the map
attached hereto as Exhibit A has petitioned the City of Clearwater to annex the property into the
City pursuant to Section 171.044, Florida Statutes, and the City has complied with all applicable
requirements of Florida law in connection with this ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following-described property is hereby annexed into the City of Clearwater
and the boundary lines of the City are redefined accordingly:
Lot 30, Rolling Heights, as per plat thereof, recorded in Plat Book 43, Page 1,
Public Records of Pinellas County, Florida
(ANX2008-09016)
Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan. The City Council hereby accepts the dedication
of all easements, parks, rights-of-way and other dedications to the public, which have heretofore
been made by plat, deed or user within the annexed property. The City Engineer, the City Clerk
and the Planning Director are directed to include and show the property described herein upon the
official maps and records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk
shall file certified copies of this ordinance, including the map attached hereto, with the Clerk of the
Circuit Court and with the County Administrator of Pinellas County, Florida, within 7 days after
adoption, and shall file a certified copy with the Florida Department of State within 30 days after
adoption.

SUMMARY:
This voluntary annexation petition involves a 0.1928-acre property consisting of one parcel of land occupied by a
single-family dwelling. It is located on the north side of Anna Avenue, approximately 600 feet west of Dora Drive.
The applicant is requesting this annexation in order to receive sanitary sewer and solid waste service from the City.
The property is located within an enclave and is contiguous to existing City boundaries to the east and north. It is
proposed that the property be assigned a Future Land Use Plan designation of Residential Low (RL) and a zoning
category of Low Medium,Density Residential (LMDR).
The Planning Department determined that the proposed annexation is consistent with the provisions of Community
Development Code Section 4-604.E as follows:
• The closest sanitary sewer line is located in the adjacent Sharkey Road right-of-way and the applicant has paid
the City's sewer impact and assessment fees and is aware of the additional costs to extend City sewer service to
this property. Collection of solid waste will be provided by the City of Clearwater. The property is located
within Police District III and service will be administered through the district headquarters located at 2851 N.
McMullen Booth Road. Fire and emergency medical services will be provided to this property by Station #48
located at 1700 N. Belcher Road. The City has adequate capacity to serve this property with sanitary sewer,
solid waste, police, fire and EMS service. The proposed annexation will not have an adverse effect on public
facilities and their levels of service; and
• The proposed annexation is consistent with and promotes the following objective of the Clearwater
Comprehensive Plan:
Objective 2.4: Compact urban development within the urban service area shall be promoted through
application of the Clearwater Development Code.

• The proposed RL Future Land Alan category is consistent with the cunt Countywide Plan designation of
this property. This designation primarily permits residential uses at a density of 5 units per acre. The
proposed zoning district to be assigned to the property is the Low Medium Density Residential (LMDR)
District. The use of the subject property is consistent with the uses allowed in the District and the property
exceeds the District's minimum dimensional requirements. The proposed annexation is therefore consistent
with the Countywide Plan, City's Comprehensive Plan and Community Development Code; and
• The property proposed for annexation is contiguous to existing City boundaries to the north and east; therefore
the annexation is consistent with Florida Statutes Chapter 171.044.

AVENUE, INTO THE CORPORATE LIMITS OF THE CITY, AND
REDEFINING THE BOUNDARY LINES OF THE CITY TO
INCLUDE SAID ADDITION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the owner of the real property described herein and depicted on the map
attached hereto as Exhibit A has petitioned the City of Clearwater to annex the property into the
City pursuant to Section 171.044, Florida Statutes, and the City has complied with all applicable
requirements of Florida law in connection with this ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following-described property is hereby annexed into the City of Clearwater
and the boundary lines of the City are redefined accordingly:

Lot 30, Rolling Heights, as per plat thereof, recorded in Plat Book 43, Page 1,
Public Records of Pinellas County, Florida
(ANX2008-09016)
Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan. The City Council hereby accepts the dedication
of all easements, parks, rights-of-way and other dedications to the public, which have heretofore
been made by plat, deed or user within the annexed property. The City Engineer, the City Clerk
and the Planning Director are directed to include and show the property described herein upon the
official maps and records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk
shall file certified copies of this ordinance, including the map attached hereto, with the Clerk of the
Circuit Court and with the County Administrator of Pinellas County, Florida, within 7 days after
adoption, and shall file a certified copy with the Florida Department of State within 30 days after
adoption.

The City of Clearwater is hereby notifying the Pinellas Planning Council of its receipt of a new
application for voluntary annexation of property located at 2328 Anna Avenue (ANX2008-
09016) into its jurisdiction. The subject property is located within the City of Clearwater
Planning Area and upon annexation will be served by City of Clearwater sewer and solid waste
service. The proposed annexation is consistent with Florida law regarding municipal
annexations through their adjacency with existing city boundaries and their compact in
concentration.

I . Section 4-407 states that "unless otherwise specified in the approval, an application for a building
permit shall be made within one year of the date of the Level Two approval, and all required
certificates of occupancy shall be obtained within two years of the date of issuance of the initial
building permit. The permit must be obtained within six months of the initial permit application.
This timeframe may be extended for an additional six months for cause by the community
development coordinator." A building permit will be required to install the landscaping
proposed. Assuming this application is decided by the Community Development Board (CDB)
on December 16, 2008, this Section of the Code would require the submission of such building
permit for landscaping by December 16, 2009, and the issuance of that permit by June 16, 2010,
and then the improvements would need to be constructed and finaled. It appears unclear if this
time frame will work for this proposal. Need to know when the right-of-way improvements are to
be constructed to know if a longer time frame (two or three years) needs to be approved as part of
the CDB approval so that its approval doesn't expire before necessary. Provide information
(possibly from FDOT) regarding time frame.
2. DRC members - Section 6-110.11 states "In the event that an eminent domain action renders a site
nonconforming with respect to the development standards of this Code, the property shall be
required to comply with the development standards to the maximum degree physically and
financially feasible as determined by the community development coordinator. The community
development coordinator may require mitigation and/or improvements to the site that are related
to the specific conditions of the site, that adequately improve the public safety issues of the site
and which implement the purposes of this Code." Comments need to reflect this Code section.
3. Supplemental Information/Narrative - Description of Request - Remove the last paragraph.
4. Response to Comprehensive Infill Redevelopment Program criteria 46 - Need to address HOW
the proposal is in compliance with parts a-e of the criteria.
5 . Provide in the site data table the existing (pre-eminent domain taking) and proposed
(post-eminent domain taking) site data with all the required information on the site plan (less land
area).
6. Response to General Applicability criteria #2 - Statement in first sentence is incorrect, as there
are changes to stormwater management (State is taking the drainage that is in the area of taking
[?]) and landscaping is being reduced.
7. Application form - A Comprehensive Infill Redevelopment Program application form is required
to be filed and appears to have been filed. Unclear why whiteout has been applied over

8. Supplemental Information/Narrative - Summary of Right-of-Way Taking - Statement in the
second paragraph from Neil Thompson is incorrect. Remove statement.
9. Proposed FDOT improvements related to the overpass appear to relocate/reconfigure the
northern driveway. Provide site triangles on both the site plan and landscape plan for both sides
of the northern driveway at the property line.
Additionally, the redesign of the existing northern driveway creates an unnecessary triangular
paved area between the new driveway and the west property line. Remove this pavement, curb
the edge and lanscape this triangular area.
10. E. Stormwater Narrative - My understanding is that the stormwater drainage capacity that exists
in the front stormwater area will be accommodated in an off-site FDOT designed retention pond
and that what's left of the front stormwater area will be regraded. Existing stormwater pipes from
this site's catch basins will be directed to FDOT pipes. Please rephrase how this section is stated
as to what proposed changes will occur to this site.
11 . Observation If the plans are correct, the drive from US 19 to the mobile home park is not
located totally within the 33-foot wide access easement. It is recommended to correct the
easement (or in the alternative, relocate the drive to be within the easement).
12. Show on the plans the existing concrete truck access apron outside the dumpster enclosure.
13. Based on the statements in the application, FDOT has acquired a portion of the property for
additional right-of-way. A deed has been submitted from 1990. No legal description has been
submitted indicating what has been acquired by FDOT (1990 legal description less "xx'").
14. Unclear as to the address: Application says 20000 US 19; phone book says 20060 US 19;
Property Appraiser says 20000 US 19. Which is correct? The mobile home park to the west has
an address of 20000 US 19.

I . Prior to the issuance of a development order, evidence must be presented to show how the
proposal meets CDC Section 2-203.B. La (e.g., provide block surveys, property surveys, etc.).
2. The wall currently erected on the property was done under an expired permit (BCP2008-02003)
and was not erected as per the approved survey dated received February 1, 2008. Under CDC
Section 3-804A, fences and walls in front of a principal structure are limited to a height of three
feet; what is currently on site does not meet this regulation. In addition, under BCP2008-02003,
the wall on the Lime Street side of the property was only permitted at a height of three feet; what
is currently at the site is at a height greater than three feet. A Code Enforcement case is
forthcoming on this matter. A Development Order for this FLS case will not be issued until the
Code case has been addressed.
3 . Per CDC Section 3-903A, walkways encroaching in a setback are limited to a maximum width of
42 inches. The walkway shown on the site plan dated received October 13, 2008, indicates a five
foot wide walkway on the east front (Orange Ave.). Submit revised site plan that conforms to the
above mentioned regulation prior to the issuance of the Development Order.
4. Clarify the concrete built to the property lines on the northwest corner, indicated on the site plan
