The current development was approved on May 18, 2004 as a Level Two Flexible Development Application number FLD2004-02014, which requested the development of the existing Dunkin Donuts/Baskin Robbins drive-through restaurant. Due to the size and location constraints of the site, the applicant requested the following reductions in the FLD2004-02014 submittal: front (north) pavement setback along Gulf to Bay Blvd. from 25 feet to 15 feet, front (west) pavement setback along Bypass Drive from 25 feet to five feet, side (south) pavement setback from 10 feet to zero feet, side (east) pavement setback from 10 feet to three feet, and a reduction to the parking space requirement from 15 spaces per 1,000 square feet to 9.7 spaces per 1,000 square feet. With the approval granted by the Community Development Board for all of these requests, the subject property was a legal, conforming site. Since the approval and the subsequent development of the property, the Florida Department of Transportation acquired by eminent domain a 1,519 square foot strip along the northern boundary of the parcel, ranging in depth from 6.6 feet to 9.2 feet. As a result, the existing 15 foot landscape buffer and setback to pavement were reduced to a range of 5.8 feet to 8.4 feet. Due to this decreased buffer width, four trees and 68 shrubs planted in accordance with the landscape specifications of CDC 3-1202 must be removed. Rather than meeting the specified landscaping of one tree every 35 feet and 100% opacity required for an arterial perimeter, the reduced buffer contains 39 shrubs ranging from 24 to 36 inches in height. The purpose of this application is to request a 3001 N. Rocky Point Drive, Suite 300, Tampa, FL 33607-5810, Telephone 813 282-3855, Fax 813 286-2308 variance in the landscape buffer and pavement setback requirements to make the property in its condition after the taking legal and conforming to all current requirements. The valuation portion of the FDOT acquisition is still pending, and any future impact to property must be determined prior to settlement of the eminent domain case. The variance requested at this time will result in certainty for both the property owner and the FDOT regarding any additional site improvements or mitigative measures necessary to make the property conforming, if required by the DRB. The only change to the site since the approval of FLD2004-02014 has been the FDOT taking, as indicated on the enclosed site plan. Due to the nature of the request, many of the supplemental submittal requirements are not applicable, for reasons indicated upon the attached addendum. The 0.66-acre site is on the south side of Gulf-to-Bay Boulevard, approximately 400 feet west of US19. Gulf-to-Bay Boulevard, a commercial corridor, runs east to west from Tampa to Clearwater, with predominately retail and restaurant uses. The proposed site is an outparcel in the northwest corner of Sam's Wholesale Club lot. The existing 3,575 square-foot, single-story building on the parcel originally was developed as a drive-thru fast food restaurant. The last use to occupy the parcel was an adult entertainment business. The property has three access points on the south and eastern portions of the property and 37 existing parking spaces. The request is to permit a drive-thru restaurant (combined Dunkin Donuts and Baskin Robbins) use to occupy the building. The applicant proposes to renovate approximately 3,308 square-feet of the existing structure. This store will provide baking services for other area stores, with approximately 1,200 square-feet, devoted exclusively to kitchen and storage uses. The remaining 2,108 square feet will be used for seating and serving area. A restaurant use requires 15 parking spaces per 1,000 square-feet of gross floor area as a minimum standard development. The applicant requests a reduction in the amount of parking from 50 required spaces, at 15 per 1,000 square-feet, to 32 parking spaces, at 9.7 spaces per 1,000 square-feet of gross floor area. The flexibility criteria under restaurant states that fast food restaurants shall not be eligible for a reduction in the number of off-street parking spaces. If the large kitchen area (non-traffic generator) were deducted from the parking calculation, the parking requirement at 15 parking spaces per 1,000 square-feet would be 36 spaces. The request is desired due the Florida Department of Transportation acquiring by eminent domain 1,519 square feet along the northern boundary of the parcel. While this nonconformity as a result of eminent domain does not require the applicant to go through flexible development, the applicant chooses to make the property after the taking legal and conforming to all current code requirements. Section 3-1202.D.1 of the Community Development Code requires a fifteen (15) wide landscape buffer consisting of one (1) tree every 35' and 100% shrub coverage along the northern perimeter of the parcel. As a result of the taking, the landscape buffer along the northern perimeter will be reduced to 5.8 feet at the eastern side and 8.4 feet at the western side. As a result, the proposed buffer will consist of three shade tree equivalents and 100% shrub coverage where four shade trees are required. To mitigate the loss of buffer width the applicant has applied for the Comprehensive Landscape Program. Comprehensive Landscape Program: Section 3-1202.G of the Community Development Code allows the landscaping requirements contained within the Code can be waived or modified if the application contains a Comprehensive Landscape Program satisfying certain criteria.
