WRITTEN SUBMITTAL REQUIREMENTS: (Flexibility Criteria)
A waiver is requested for the minimum front yard setbacks for a detached single-family
dwelling. Narrative responses to Section 2-203.B.1 are as follows:
a) Aerial research (utilizing the Pinellas County GIS viewer & measurement tool)
indicates there are other existing houses in the surrounding area that were built to
the Flexibility Criteria; specifically with front yard setback reductions.
Subsequently, the setback pattern is somewhat irregular.
b) A reduction in the setback will have no adverse affects because precedence has
been established. Furthermore, a means for the waiver is provided for through this
Application. The proposed structure will have a positive affect on the neighboring
property values. The dwelling will replace an existing house that was originally
built in 1947. Consequently, it will increase the City's tax revenues. In fact, it's
probable that the project will encourage further development of the area.
c) It appears that several residences on Mandalay Ave., Gardenia St., Lantana Ave.,
Verbena St. and Bruce Ave. have been granted a front yard setback waiver. The
requested reduction in setback along Bruce Ave. is for the sole purpose of
improving the Entry fagade to the residence. The Entry Portico is an essential
element to the architectural design (Italian Renaissance). Within the setback
encroachment, this element is only one story in height, and comprises no living
area. In fact, there is no roof over this Portico, but rather a Terrace accessible
from the structure's second floor. This results in a less obtrusive encroachment.
Simultaneously, it provides the level of detail that's consistent with the existing/RIGINAL

neighborhood character. Furthermore, the requested waivers are not to increase
the living area; as all living areas (on the second and third floors) are within the
25' setback restriction.
d) A reduction in the front yard setbacks will allow for greater architectural
creativity, in addition to providing for the best utilization of the lot and efficiency
in the layout. It is desirous to minimize the structure's impact on the SW corner of
the lot. This is the intersecting street corner. The submitted design reserves this
area for a heavily landscaped Courtyard with low privacy walls and columns, and
a Pool area properly screened for privacy with walls, columns and decorative
wrought iron. The result is an open "green space" that's visible to both street
facades, further enhancing the public's perception of the project. This permits an
efficient and narrow `L' shaped building extending along the North and East
property lines. The intent is to increase the setback distance along these property
lines, so that the majority of the structure is approximately 10' from said lot lines,
instead of the minimum 5'. In addition, the area will be heavily landscaped,
primarily with relocated trees from the property. The increased horizontal
separation and dense landscaping will provide a privacy buffer for the adjacent
neighbors. Without the waiver, it is conceivable that a new design would emerge;
perhaps necessitating the use of the SW corner for a three story structure and
reducing the side yard setbacks to the minimum 5'. With the latter scenario, the
side yards will not be sufficient for abundant landscaping.

confirmed by telephone with the City Public Works Administration Engineering

Dear Mr. McCoy:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On August 31, 2006, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to construct a single-family home in the Low
Medium Density Residential (LMDR) District. The request includes a reduction to the front (west)
setback from 25 feet to 15 feet and reduction to the front (south) setback from 25 feet to 19 feet under
the provisions of Section 2-203.B.1. The DRC recommended APPROVAL of the application under
the following bases and conditions:
Bases for approval:
1. The proposal complies with Flexibility criteria for detached dwellings under the provisions of
Section 2-203.B.;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions for approval:
1. That the elevator equipment room enclosure is the only structure projecting higher than the
allowable 30 feet;
2. That all fences and walls are permitted separately; and
4. That the final design and color are consistent with the elevations submitted to the DRC.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development. The approval is based on and must adhere to the
site plan and application dated received September 11, 2006.
Pursuant to Section 4-303, an application for a building permit shall be made within six months of
Flexible Development approval (April 16, 2007). All required certificates of occupancy shall be

1. All existing trees have been located per the survey, and identified as to whether
they are to remain or are to be removed (sheet #1 - Site Plan). Every effort will
be made to save those trees indicated as remaining, if practical, but no guarantee
is expressed.

1. Existing grade elevations have been indicated per survey. The proposed finished
grade elevations, direction of drainage and a stipulating drainage note have been

Dear Mr. Kurleman:
My wife and I reside at 844 Bruce Avenue and vote against approving the application.
The undivided lot in question was originally laid out as one house lot because it wasn't appropriate for two
houses. Building another house, that close to Bruce Avenue and jamming it in beside the existing house would
detract from the neighborhood ambience and do nothing to enhance property values. As far as we can tell,
every other home on Bruce Avenue complies with the 25 foot front setback and we vote to keep it that way.
Please deny the application.

To Surrounding Property Owners:
As a property owner within 500 feet of 829 BRUCE AVE, the City of Clearwater Planning Department gives
notice that an application for Flexible Standard Development approval to construct a single family home in the
Low Medium Density Residential (LMDR) District. The request includes a reduction to the front (west) setback
from 25 feet to 15 feet and reduction to the front (south) setback from 25 feet to 19 feet under the provisions of
Section 2-203.B. L.
On August 31, 2006, the Development Review Committee (composed of the City's professional staff) will
review and determine whether the application demonstrates compliance with the City's Community
Development Code. Following that review and determiniation, the Planning Director will issue a
Development Order approving, approving with conditions, or denying the application. The earliest date that
the City will make a decision on the application will be August 31, 2006.
