First, my tree on one of your diagrams that you show being 24 inches in diameter is actually more than 84 inches at the base, from which nine individual tree-size branches originate. In the attached photo, the T-square (I show with the tree) is about 40 inches long. You will also note that the tree sits immediately adjacent to the boundary line in my restricted setback. In fact, if they build to within 10 feet of the tree, their walls and roof line may now or eventually touch the tree limbs. I am very concerned that the only way the Pappas' can construct such a tall home so close ( 10 feet) to the tree is by both cutting roots and removing branches of this beautiful native tree. This tree is located on the boundary line, the trunks rise on my side of the boundary line, but its root system is in both yards of their existing setbacks. The tree branches out over both homes' yards. The tree was present many years prior to development of the lots and is native to this area of land. I am very concerned that if the Pappas' win an appeal for an exception to the setback, that I will loose the root system and face significant problems and costs and liabilities trying to remove such a large tree so proximate to their proposed house additions. The costs will be enormous if the tree become ill. I ask that the health of this native tree be protected by the City. If the City can not, I ask that the Pappas' be required to pay to safely remove the tree prior to construction to avoid endangering adjacent properties from what could become a very sick and/or dying tree due to damage to its root system from the construction and/or the high PH of adding so much adjacent concrete leaching into the root system. (2) If the City agrees to the appeal to reduce the setback for the Pappas lot, I ask that my rear setback concurrently be reduced to the same "uniform" distance as approved for the Pappas lot. I will want and expect the City provide me with identical options to build to the same height and proximity to the boundary line. I or some future owner may need to do so to re-gain privacy. (3) The "U-shaped" profile created by the two additions will broadcast noise from their pool area, proposed bonus room, and balcony directly into our home and act as a sound collector of any conversations or music at our home. Any way to move the west addition out to the south to create a "L- shape" to the south? (4) I request that the City ask the Pappas' to flip the proposed balcony to the front of the home which will not be viewable from the front street. From a practical standpoint, balconies are a lot more enjoyable on the southside of a home. In order to justify this setback, it must be justified by the benefits to the community character and the immediate vicinity of the proposed development. Julia Babcock May 31, 2006 Page Two The character community clearly would be adversely affected with absolutely no benefit to the community character due to the proposed development. This is a single family community, in which there are almost no two story residences, and there are no set back adjustments for such an addition that is in essence a new primary structure. As a homeowner that adjoins to the northeast corner of the parcel to be subject of the development, there is a substantial absolute adverse impact with no benefit. As we had discussed, building such a structure adjoining to my property, would have an adverse marketability impact. While I acknowledge that it is difficult to establish a loss of property value from having such an additional structure attached to the existing structure on Velventos Drive, upon speaking with numerous Real Estate Brokers and sales professionals, due to the community character of the neighborhood being primarily single story, single family residences, allowing a two story addition would turn the property into a multi family property. With the requested set back variance, the prospective buyers, should I decide to sell my house, would be reduced between 50% to 75%, due to prospective buyers not wanting to have such a two story multi-family dwelling overlooking the patio and pool of my property. I know this first hand due to the fact that one of the reasons that I purchased this property some 11 years ago (and paid high-end of per square footage costs) was due to the fact that the land behind my house is regulated by SWFWMD, and the existing set back requirements that would govern the property on the adjoining the southwest and southeast corner of my property. To allow such a variance waiver to allow a 2 story structure to be built 10 feet from the property line would result in the 15 feet, and 20 feet set back requirements to be meaningless. The proposed improvement to the property is not just an addition (most additions are either adding of a bonus room, extending off of a garage, adding a additional bedroom, or even adding a bathroom that would be in essence an outdoor bathroom for enjoyment of ones pool), but in essence it is an entirely self contained living unit which turns this property into that of a multi-family dwelling. It might as well be a condominium complex which clearly does not meet zoning requirements nor the community character. The proposed addition as evidenced by the photographs that I have provided, will clearly negatively and adversely affect the privacy, the enjoyment, and will damage the marketability of my property. The proposed second story balcony which will be within 10 feet of my property line, will allow for residences of the multi unit dwelling to have an unobstructed view of my pool and private entertaining area of my family residence, and there is no benefit that I will derive from having my privacy and the right to enjoy my property adversely affected. 0 0 Julia Babcock May 31, 2006 Page Three Inasmuch as the addition will establish more concrete, and the pouring of the footers and foundation on a level basis will in essence need to be built up, storm water and rain run off will also adversely affect my property. The southern end of my property, due to the close proximity to the regulated SWFWMD property, during heavy rains already becomes soggy and some standing water will accumulate. By allowing the square footage addition of the structure, as well as the driveway and other concrete proposed improvements to this property will do nothing but increase the storm water run off from any rains or events of nature directly on my property. As you can also see by the photographs I have provided there are numerous foliage and root systems in the corners of the three adjoining pieces of property. To allow such an extensive construction project that is proposed, will clearly weaken root structures, and will greatly enhance the probability of damage to my property from the weakened root systems of the trees and foliage. I cannot object strongly enough that this proposed addition establishes a 2 story multi- family dwelling 10 feet from my property line. The set back requirements are designed and promulgated to protect property owners. The only benefit of this proposed development is to the owner of Velventos Drive. All other owners of surrounding/adjoining property will be adversely affected and irreparably harmed by the damage to the community character and the immediate vicinity. Where will they be adding fireplaces, and vents? What materials will they be using? Our"initial reaction" is that the current location of this large two-story home should not be any closer to us. It is now crammed into the smallest corner of their lot, and in the most proximate location to ours and adjacent homes, and already severely towers over and invades the privacy of all adjacent single-story homes. Their exisitng backside windows look direct down into our yards, lanai, pool, bedrooms, kitchen and livings room. Our privacy in our master bedroom and liviing rooms are extremely compromised. In our "opinion" and especially from the perspective of our master bedroom and living room, the two-story home is already way too, too close! Their two-story home was the wrong house for that lot, located in the wrong location on the lot, and by being a two-story home, is very inconsistet with the construction of adjacent single-story homes whose designs assume compete privacy, if a privacy fence is erected. If not done properly, any further expansion towards our home and adjacent properties in the established deeded setback may cause more harm to our view and privacy. Since their home was built, the owners of my home have been forced to let their ground level bushes go wild in a very unattractive way in hopes of regaining some privacy. This has required giving up any practical use of the yard immediately behind the home and pool area. We recently purchased an additional four hundred dollars worth of bamboo trees in hopes of gaining more privacy in future years. That means we will be loosing further use of our yard for more more attractive plantings.
