The City has ready access to determine the granting of permits for decks at these locations. Obtaining such information is beyond what can be reasonably expected of my client. What is of particular import is the deck adjacent to the deck at issue. Taking an action that would inevitably harm the neighbor (except as directed by the HOA) is beyond comprehension. 2. Any presentation regarding setback, easement and restoration issues must be developed in consultation with the HOA. The exact request is currently indeterminable because the HOA has not completed its initial evaluation and does not yet have a plan. You appear to confuse the term "setback" with "easement" and this is something you need to take another look at. The structure is within the easement of the HOA and the HOA already agreed. The "only" issue before the DRC is whether the "upper deck" stays. I understand there is a turbidity curtain in place. We have entered the hurricane season. What happens to the lower deck is up to the HOA. What happens to the use of the Common Area (and that portion of my client's property over which there are easements) will be coordinated with the City so any concerns you have should be addressed. 3. This particular property is very attractive and the structure itself is functional in that it has prevented the shore line from eroding away. This is (1) homeowner who took it upon himself to preserve as much property as he could, unlike the other dozen or so owners that are losing more and more land as a result of their inaction as well as the inaction of the HOA as a whole. Due to the ignorance of the community, there is no longer any common property around this particular lake (that is above water). It is a crime that this land has been lost, in my opinion. As the community awareness of this crisis escalates, I am hopeful that the other lake front homeowners apply for a reduction in an effort to preserve not only the remaining land but their homes as well. Please keep in mind that although the applicant is requesting a reduction in the rear setback there is much more involved here than that simple matter. understand you have three options for resolution of the application and those are approval, approval with conditions or denial. I request you choose approval with conditions and my reasoning is as follows: 1. For several years we have been experiencing a severe erosion problem from lot 2 through about lot 21. 2. At one time there was land between the rear yard lotlines and the lake. The lake and that land between the lake and the lotlines belongs to the Springlake Homeowners Association (HOA). Over the past 20 years or so the HOA has failed to maintain its land described above and that land has eroded into the lake. 3. The subject property owner built, without City permits, the deck which is the subject of the encroachment. However, this was done to stop the erosion and prevent the owners home from sliding into the lake. 4. About a year ago we invited the Mayor, City Engineer, and the City Environmental lady to attend a HOA meeting where the erosion problem and solution to same was the subject of the meeting. (I'm sorry that I can't find my minutes of the meeting containing the names of the referenced people). The environmental lady said many of the lots were encroaching on the required 25 foot setback from the lake. She advised the HOA Board to come up with a solution to stop the erosion for the entire lakefront currently affected. She advised that a solution for each individual lot was not a solution at all and that it had to be one master plan to solve the problem. Also, she advised that she would be able to approve one variance for the 25 foot setback from the lake for all of the lots at one time rather than on a lot by lot basis. 5. Now that the HOA Board has new members a greater effort has been made to discover the cause of the erosion and a solution to that problem. The HOA Board has retained the services of an engineering firm that has promised to provide the description of the cause of the erosion and several alternative solutions to solve the problem. 6. It appears that to deny the application at this time and require the applicant to remove the deck would put her home again at risk of sliding into the lake. Many of us along the lake have the same fear as the applicant but we did not take the drastic measures the applicant did to protect her home. 7. 1 suggested that you approve the application with conditions. The conditions that I suggest would be that the encroachment and the decking be allowed to remain in place until such time as a solution to the erosion problem is approved by the HOA and the City. When the solution is approved then the applicant would be required to remove the deck to accommodate the installation of the permitted erosion solution. 8. 1 believe this will allow the City to ultimately comply with its Development Code while allowing the City to refrain from putting the applicants home in danger.
