The development of this lot with a single family home, will be an upgrade for the community..It.will eliminate a vacant lot that.is now'growing weeds and grass, also the trash, rubbish and debris that collect there. 6. The design of the proposed residential infill project creates a form and function that enhances the community character of the immediate vicinity of the parcel proposed for development and the City of Clearwater as a whole. The design of the propose home,.should.in not way adversley affect other properties in anyway. Its anticipated that it will fit in with surrounding development. 7. Flexibility in regard to lot width, required setbacks, height and off-street parking are justified by the benefits to community character and the immediate vicinity of the parcel proposed for development and the City of Clearwater as a whole. The city as a hole can benefit by being flexible in thie regard. The taxes will be increased, elimination of a harboring place for unwanted pest, abandon vehicles and old refrigerators. Residential Infili 2005- City of,Clearwater • • City Application 701 Pennsylvania Ave #1 There are two adjacent properties, one developed and one vacant. Relative to the scale of the quality of the proposed development, it should be viewed as being equal to the developed property. The bulk of the proposed development is approximately 1400 s.f. total area, which is a little smaller than the adjacent developed property. The building coverage will be approximately 1/3 of the land area. The building on the adjacent property coverage of the land mass is less. The density of the proposed development will be higher than the density of the adjacent. I do not feel that the above will infringe on the character of the adjacent developed property. Therefore, its necessary to request a reduction of the required front set back on the south side of property. 92 Anew home was just completed a few months ago on the adjacent property, and a few years back, a new home was built just north of it. This proposed development will be compatible to those. I cannot believe that this development will discourage or hinder the appropriate development and use of the adjacent property, or impair the value thereof. Should there be any impairment of value, most likely it will be caused by dilapidation in the-area and the commercial property to the south. #5 The request for a thirteen (13') front setback from Eldridge Street, does not meet the normal setback requirement, but its not detrimental to the community. there are several homes along Eldridge Street, between Vine Ave and N. Greenwood Ave, with a front setback of approximately 5' to 15'. #7 Without some flexibility relative to the required setback, this property may never be developed, even if we could purchase the east portion, some flexibility will be required. Otherwise the building foot print could only be 20' wide. Development in this community/block should enhance the character of the community, as well as the immediate vicinity of the proposed development. On June 13, 2007, you submitted a request for a time extension to apply for a building permit to construct the improvements on this parcel. Your letter cited unsold new home inventory and slow sales as the reason for the request. In accordance with the provisions of Section 4-407 of the Community Development Code, I find your request timely and APPROVE a one-year time extension to July 18, 2008, to submit an application for a building permit to construct the site improvements conforming to the original development order for the case. All required Certificates of Occupancy shall be obtained within two years of the date of issuance of the initial building permit. The CDB may approve one additional extension of time after the Planning Director's extension to initiate a building permit application. Such extension shall not exceed one year, shall be for the project originally approved and shall be for good cause shown and documented in writing. The CDB must receive the request for this extension within the time frame granted by the Planning Director (period of validity after the original extension approved by the Planning Director). Good causes may include but are not limited to an unexpected national crisis (acts of war, significant downturn in the national economy, etc.), excessive weather-related delays, and the like. The CDB may also consider whether significant progress on the project is being made and whether or not there are pending or approved Code amendments that would significantly affect the project. The building will be oriented to the western property line facing Pennsylvania Avenue. The proposed building is situated toward the north property line to allow parking on the south portions of the site through the use of a circular driveway. The proposed building complies with all Code requirements except the front (south) setback along Eldridge Street. The proposal includes a reduction to the minimum lot area from 5,000 square feet to 4,143 square feet. The substandard lot was an established residential lot of record prior to March 8, 1999. The Planning Department recommends APPROVAL of the Flexible Development approval to construct a new single family residence in the Medium Density Residential district and the request includes a reduction in the minimum lot area from 5,000 square feet to 4,143 square feet and a front (south) setback reduction from 25 feet to 13 feet, as a residential infill project, per section 2-304.G. for the site located at 701 Pennsylvania Avenue, with the following bases and conditions: Bases for Approval: 1. The proposal complies with the Flexible Development criteria as a Residential Infill Project per Section 2-304.G. 2. The proposal is in compliance with other standards in the Code including the General Applicability Criteria per Section 3-913. 3. The development is compatible with the surrounding area and will enhance other redevelopment efforts. Conditions of Approval: 1. That no parked vehicle will block or obstruct the sidewalk in accordance with City Ordinance 30.041(1)(b); 2. That the site plan be revised to show the finished floor elevation and lot grading on NAVD 88 datum prior to the issuance of a building permit; and 3. That the final design of the building and site plan be consistent with those approved or modified by the Community Development Board.
