TI-IIS AGREEMENT, made and entered into this 23rd

FLORIDA, a municipal corporation, hereinafter referred to as IICityll, and
M. K. KENT and R~VA C. KENT, his wife,
hereinafter referred to as "Ownerll;
WITNESSETH
WHE REAS I the Owner noW o\vns the following des cribed real
property and intends to construct a residence thereon:
From the Northeast corner of the Southeast 1/4 of the Southwest
1/4 of Section 1, Township 29 South, Range 15 East, run South
00 1714811 East, along the North-South centerline of said Section 1
(centerline of Country Road 34-Hercules Avenue) 200.03 feet; thence
run N 890 1412411 West, parallel to the North line of the Southeast 1/4
of the Southwest 1/4 of said Section 1; 263 feet for a point of beginning;
thence run South 00 17'4811 East, 210 feet; thence run North 890 1412411
West 70 feet, thence run North 00 17'4811 W, 210 feet, thence run South
890 1412411 East 70 feet to point of beginning,

WHEREAS, the Owner desires to connect to the City sewer main
and is agreeable to signing an agreement with the City for n~unicipal sewer
services; and
WHEREAS, the City is agreeable to furnishing said services upon
certain conditions and considerations;
NOW I THEREFORE, the pa.rties hereto hereby covenant and agree
as follows:
1. The City does hereby agree, subject to the terms of this agreement,
to permit the Owner to connect to its sanitary sewer main at the Owner's
expense, The City does agree that such connection for the treatlnent of
sewage will at all times be continuous, however, the City shall not be liable
for any damage resulting from any unavoidable cessation of treatment caused
by act of God, necessary maintenance work, or any cause beyond the control
of the City.
2. In consideration of the covena.nts contained in Paragraph 1
immediately above on the part of the City, the Owner agrees:
