Dear Chief Holloway:
The purpose of this memorandum is to establish an understanding between our two
agencies with regards to the Clearwater Vet Center located at 29259 U.S. Highway 19
North, Clearwater, Florida 33761 . This agency is mandated by program policy, Office of
Security & Law Enforcement (OSLE), a Headquarters in Washington, D.C., to maintain a
letter of agreement for Law Enforcement Support regarding investigation and violations of
the law occurring on property under control of the Department of Veterans Affairs.
This property is under Proprietorial jurisdiction. This term is applied in those instances
wherein the Federal Government has acquired some rights or title to an area in a State, but
has not obtained any measure of the State's authority over the area. In this instance, the
State has sole criminal jurisdiction except for violations of Federal statutes. Accordingly,
Veterans Affairs Healthcare System Police Officers and Investigators, exercise arrest
authority under Title 38, United States Code, Sections 901, 902 and VA Regulation 2.6(a)
for violations of Federal statutes occurring within the property commonly referred to as the
Clearwater Vet Center.
