The proposed retail off-premises alcoholic beverage sales facility shall be located at 1575 Highland Avenue South, within an existing - 85,000 square feet shopping center (La Belle Plaza). La Belle Plaza has a number of retail stores and the addresses vary between 1521 and 1595 Highland Avenue South, Clearwater, FL 33756. On June 26, 2004, the Community Development Board (CBD) APPROVED the application to permit the sale of alcoholic beverages at La Belle Plaza pursuant to SECTION 4-206.D.6. The said Development Order (Case FLD2003-0900 cgog2 expired because the application for building permit was not submitted within one year. The retail store that is to be approved is approximately 1,800 sq ft, so that is consistent with the facility and La Belle Plaza. 2. The proposed alcoholic beverage sales facility shall be located in an existing retail shopping center, and therefore should not have any impact on existing facilities or adjacent properties. 3. The proposed facility will not adversely affect the health and safety of persons residing or working in the neighborhood since it will be selling products for off- premises use only. 4. The proposed use is consistent with the already-approved retail use for the site. 5. It is consistent for shopping centers of this size or magnitude to include an alcoholic beverage sales facility for off premises consumption. For example, a similar shopping center at Highland Avenue North, anchored by Kash n' Kerry has a much larger liquor store. 6. The store space is already designed and the operations will be within an already approved area or facility within the shopping center. COMPREHENSIVE INFILL REDEVELOPMENT PROJECT CRITERIA 1. Alcoholic beverage sales, for off-premises consumption, cannot be approved if within 500 feet of residential properties, so this shopping center facility cannot have such use and occupy a deviation from the development standards. The first criterion regarding the Alcoholic Beverage Sales use is that the location of the business is not to be contiguous to a parcel of land designated as residential in the Zoning Atlas. As the location does not meet this criterion, the application has being filed as a Comprehensive Infill Redevelopment Project under the provisions of Section 2-704.C. It is noted that at its meeting of January 20, 2004, the Community Development Board (CDB) approved subject to conditions a Flexible Development application for Alcoholic Beverage Sales on the subject Community Development Board - November 15, 2005 Case FLD2005-08082 - Page 1 0 0, property. This approval expired on January 20, 2005, necessitating the filing of the application that is presently before the Board. Development Proposal: The proposed use (Alcoholic Beverage Sales) will occupy a 1,800 square foot tenant space within the Plaza, which equates to approximately two percent of the Plaza's total floor area. Given the scale of the proposed use in relation to the size of the Plaza, the Alcoholic Beverage Sales use will be subordinate in nature to the balance of the development. Additionally, located along the east property line is a six-foot high, solid wooden privacy fence that buffers the Plaza from adjacent residential properties. This buffer along the property line and the scale of the proposed use in relation to the balance of the Plaza establishes the proposed use (Alcoholic Beverage Sales) as a compatible use with regard to the adjacent land uses. The applicant is proposing that the business (Alcoholic Beverage Sales) would be open between the hours of 10:00 a.m. and 9:00 p.m., Monday thru Saturday and between 2:00 p.m. and 9:00 p.m. on Sunday. These hours are consistent with those previously approved by the Board for this use at its meeting of January 20, 2004, which are in turn compatible with the hours of operation for the Publix Supermarket (anchor tenant) within the Plaza. I feel the location of this store would be an accident waiting to happen. The location is very close to a residential area on Belleair Road. This particular side of the plaza already has a large amount of traffic congestion and many drivers refuse to obey the "No Left Turn" sign when exiting the plaza. As a parent, I am very upset that they would place an alcoholic beverage store in a family oriented plaza. I can not understand why or how anyone has the right to place such an establishment next to a family pet store. There are so many children and families that visit that store on a daily basis.
