Dear Mr. Fritz: This letter constitutes a Development Order pursuant to Section 4-202.E of the Community Development Code. On March 31, 2005, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval to allow a 625 square foot accessory structure (playroom) to a proposed 3,785 square foot, single-family residence, located in the Low Medium Density Residential zoning district. The request includes reduction to the rear (south) setback from ten feet to five - feet and to increase the allowable area of an accessory structure from 10% (378.5 square feet) to 16.5% (625 square feet) of the square footage of the primary structure, per section 2-203.B. The DRC recommended approval of the application with the following bases and conditions: Bases for Approval: 1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2-203.B; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area. Conditions of Approval: 1. The accessory structure may not be permitted until the proposed 3,785 square foot primary structure (single family home) is permitted, per Section 3-201 (accessory use/structures); 2. That a lot Grading Plan indicating the finished floor elevation (FFE) on the plans be provided prior to the issuance of any building permits; and 3. That the final design of the accessory structure be consistent with the conceptual elevations submitted. I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the three above conditions. The approval is based on and must adhere to the site plan and application dated received February 24, 2005 and the revised site plans dated received March 7, 2005. BRIAN J. AUNGST, MAYOR-COMMISSIONER HOYT HAMILTON, VICE MAYOR-COMMISSIONER WHITNEY GRAY, COMibIISSIONER FRANK HIBBARD, COMMISSIONER ® BILL.JONSON, COMMISSIONER "EQUAL EMPLOYMENT AND AFFIRMATIVE ACTION EMPLOYER" April 7, 2005 Mr. Fritz - Page Two Pursuant to Section 4-303, an application for a building permit shall be made within one year of Flexible Standard Development approval (April 7, 2006). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Time frames do not change with successive owners. The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. Myrtle Ave. Clearwater, Fl. 337584576 RECEVED MAR 3 1 2001 RE: 323 Lotus Path Dear Ms. "Watkins, PLANNING DEPARTMENT CITY OF CLEARWATER I apologize for not being able to attend the DRC meeting tomorrow (Thursday), as we were called out of town for a funeral. However, I wanted to give you an update and responses to the concerns of the staff regarding our application.. I hope that this will suffice, and that the application will not be held up on account of my absence. I would also like to mention that Mr. Albee did in fact call we today, but I was only able to leave him a voicemail as it was after 4:30 pm when I returned his call. Please thank him on my behalf. There are two existing trees on our property that are shown on the plan as to remain. The first is on the street side of the sidewalk, and its location will not effect our proposed new curb cut location. (the canopy as drawn is slightly smaller than actual) However, there is no adverse effect on the project. The second is shown at the far Southwest corner of the property. It is a large multi-branch oak which we fully intend to keep intact. The canopy actually extends into the hospital parking lot and over the neighbors lot line to the West. This tree is integral to tbaoverall design of the property. There is also a multi-trunk palm in the existing front yard that will be transplanted and reused is the new landscape scheme. There is also existing shrubbery around the perimeter of the rear yard that we intend to preserve. Not shown on the plan is one palm tree in the Easterly neighbors side yard that will not interfere with anything, and one large oak at the rear portion of the Westerly neighbors yard that actually intertwines with our large multi-trunk oak. Again, I see no conflict with our proposal. I can appreciate Mr. Albee's concern about the pool being under the tree, and the maintenance concerns. However, this is exactly the look we are intending. I would also like to mention that I purposely placed our proposed accessory structure in that corner so that it "plays off" of the neighbors two story carriage house directly to the East. Therefore, his next concern about moving the proposed location of the accessory structure is not applicable. i- RECEIVED ?M-Owy r> I acknowledge that a grading plan and finished floor elevations must be established. The site is particularly flat and we plan on matching the floor elevation of the existing house, even thougb it will be demolished. I also understand that the accessory structure must be permitted. It is my intention to permit both structures under one building permit submission. I thank you in advance for your cooperation with our submission. We look forward to a successful project.
