On January 5, 2006 the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval to reduce the required rear (east) waterfront setback form 20 feet to two feet for a concrete in-ground swimming pool and deck, at existing grade, per section 2-203.C. The DRC recommended approval of the application with the following bases and conditions: Bases for Approval: 1. The proposal complies with the Residential Infill criteria under the provisions of Section 2-203.C; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area. Conditions for Approval: 1. That no structure(s) be constructed within the five foot utility easement in the rear of the subject property; 2. That the proposed pool and associated pool deck shall not exceed 12 inches above existing grade; and 3. That no pool enclosure will be permitted in the future. I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the above conditions. It would be impractical to not ask for a rear setback along the seawall. This will reduce the size of the pool deck and take away from the function of the pool for recreational uses. The applicant will have the pool and pool deck professional designed along with re-engineering of the tie-backs due to the proximity of the pool along the seawall. 2. The development of the parcel proposed for development as a residential infill project will not materially reduce the fair market value of abutting properties. (Include the existing value of the site and the proposed value of the site with the improvements.) The fair market value of abutting properties will only increase, especially residing on Clearwater Bay. The current value of this single-family residence is approximately $1,497,700.00, the pool will increase the residence approximately another $30,000.00 3. The uses within the residential infill project are otherwise permitted in the City of Clearwater. Swimming pool and pool decks are a permitted use within the City of Clearwater. 4. The uses or mix of use within the residential infill project are compatible with adjacent land uses. Swimming pools are a dime a dozen along Clearwater Beach and surround areas. The applicant will have the pool and pool deck professional designed along with re-engineering of the tie-backs due to the proximity of the pool along the seawall. 2. The development of the parcel proposed for development as a residential infill project will not materially reduce the fair market value of abutting properties. (Include the existing value of the site and the proposed value of the site with the improvements.) The fair market value of abutting properties will only increase, especially residing on Clearwater Bay. The current value of this single-family residence is approximately $1,497,700.00, the pool will increase the residence approximately another $30,000.00 3.
