A STORMWATER NARRATIVE MUST BE SUBMITTED WITH ALL APPLICATIONS. All applications that inv
addition or modification of impervious surface, including buildings, must include a stormwater plan that demonstrates compliance

Six (6) General Applicability Criteria:
The proposed development of the land will be in harmony with the scale,
bulk, coverage, density, and character of adjacent properties in which it is
located.
The single-family residential lots along Bay Esplanade in this area, along the bay,
are generally larger homes, which involve improvements extending within the
existing rear setback lines. Secondly, the seawall in this area is curved, so that
vistas are not significantly impacted by construction into the rear setback areas,
so the requested construction within the rear setback areas, and the increased
elevations, will not have any adverse impact on the community and will in fact be
in harmony with the adjacent properties.
2. The proposed development shall not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair
the value thereof.
All properties in the area are developed, and the trend in the community is
consistent with the Applicant's plan to remove an existing home and construct a
new home generally in accordance with FEMA requirements, which has been
happening in the neighborhood over the past several years.
3. The proposed development will not adversely affect the health or safety of
persons residing or working in the neighborhood of the proposed use.
The proposed development should have no impacts at all on the health or safety of

The development or redevelopment of the parcel proposed for development
is otherwise impractical without deviations from the intensity and
development standards.
It is impractical to locate a swimming pool and related facilities to support the
pool facility without extending into the rear 25'setback area.
2. The development of the parcel proposed for development as a residential
infill project will not materially reduce the fair market value of abutting
properties. [Include the existing value of the site and the proposed value of
the site with the improvements].
The residential Infill project should be a positive event for the neighborhood. The
present just/market value of the house as reflected by Pinellas County Tax
Assessor is $1,634,000. The proposed development will enhance the property but
the economic impacts are unknown.
3. The uses within the residential infill project are otherwise permitted in the
City of Clearwater.
The uses are permitted; the only question is location.
4. The uses or mix of use within the residential infill project are compatible
with adjacent land uses.
The development is consistent with adjacent land uses and development. As and
when new construction occurs within this area, improvements are being sited at
the rear of the property, and generally maintaining the front setbacks along Bay
Esplanade, since the street and access area is quire narrow. This protects some
vista or openness along Bay Esplanade, and there are no adverse impacts from
moving improvements towards the rear of the site. l

Approval of the requests will maintain the integrity of the front setbacks, and will
allow full development of the site without adverse impacts on the community at
large, or on the specific abutting neighbors, whose properties appear to have
construction within the rear setbacks as well, without any adverse impact on the
community at large.

First, thank you for your assistance in correcting the exhibits to the above-referenced

In our last conversation you indicated the DRC was to be on September 29`h; in looking
at my calendar 1 note that I have a prior commitment that will have me out of the office virtually
all afternoon, so 1 would request, if possible, that the DRC for Crespo be scheduled as early as
possible in the morning. I do not think it will be a very complicated issue and should not take
too long. Also, I understand that if it has to be in the afternoon, I will simply have to get
someone else from my office to attend, but hopefully that will not be necessary.

This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On November 3, 2005, the Development Review Committee (DRC) reviewed
your application for Flexible Standard Development approval to reduce the rear (east) waterfront
setback from 25 feet to 18 feet per section 2-203.13.2. The DRC recommended approval of the
application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2-203.B.2;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions for Approval:
1. That prior to building permit, a site data table including ISR ratios is provided per section 4-202.A.;
2. That any future pools, decks or patios in the 18 foot east (waterfront) setback shall not exceed 12
inches above existing grade per section 3-201.B.10;
3. That prior to building permit, all existing trees are shown on the site plan;
4. That prior to building permit, a grading plan is provided to the Engineering department
demonstrating no adverse impacts to adjacent properties; and
5. That all mechanical and pool equipment in the side or rear setbacks be screened from the public
right-of-way and adjacent properties per section 3-903.H. I.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the above conditions. The approval is based
on and must adhere to the site plan and application received August 24, 2005.

I understand from a phone message left with my assistant a few days ago that we
are to get a new signed and sealed survey with tree survey included, and that is ongoing
and will be filed with you on or before October I O'h.
If she took the message correctly, she has indicated that you have again requested
a traffic impact study. I have prepared and forward herewith a proposed addition to the
application, but it is simply a common sense response to the fact that we are tearing down
a single-family home, and building another one so there are zero traffic impact changes.
If this is not satisfactory, please let me know and I want to meet with Mr. Delk since this
does not seem to be an appropriate requirement in spite of what the Code might say.
Thank you for your continued help and we will file the survey data you have
requested on or before the suspense date, so we can be on the October DRC hearing.

Dear Mr. Kurleman:
Forwarded herewith please find letters of no objection from the immediate
contiguous owners, north and south.
Regarding our hearing before DRC on November 3, 2005, we understand that the
final site plan and building permit request must meet code in all respects other than the
requested relief from the rear setbacks which we have requested, assuming of course that
they are finally approved. We also understand that all trees must be identified, both those
to remain and those to be removed, with the landscaping plan showing where all trees
will be finally located. We also understand you need a grading plan, all of which
comments or conditions are acceptable to the property owners.
Lastly, regarding § 2-20313.2, as envisioned by subparagraphs c. and d., the
placement of the pool results in an efficient house layout, placing the pool on the same
level as the living area of the house, and this is without detriment to the adjoining
property owners as confirmed by the attached or enclosed letters from the neighbors. We
obviously have significant vegetation on the south. On the north, where you had your
picture, that is of course taken from the property line from the seawall, but the view
corridors from the house to the north are not oriented in that direction at all, but are to the
east out over the water, and a pool is not going to interfere with their normal vista. Also
the pool is consistent with the Browns' construction immediately to the south, as well as
979 Bay Esplanade, two (2) more houses south, all new construction.

Dear Mr. Delk:
As City files will reflect, we represent Dr. and Mrs. Crespo, relative to their property
identified above. The City issued its Development Order December 14, 2005, a copy being
attached. It recites that "an application" for a building permit shall be made on or before June
14, 2006.
The Crespos have retained Alvarez Homes to build their new house. Although plans
have been processed to a point, there are still City comments that are not resolved, and I am not
sure they will reach a point where a permit application can be made by June 14, 2006. I do not
want to lose the City approval that we now have, in case these comments or plan issues are not
resolved within the next few weeks.

provisions in subsection 3-804(B) above
provided the fence is consistent with the
character and placement of any struc-
tures and setbacks on the adjoining prop-
erties, including the placement of the fence
on the property line.
E. Double frontage lots. For the purposes of
fence placement on double frontage lots,
the front yard shall be the side of the
property from which the property is ad-
dressed. The placement of any fence on
this side of the property shall adhere to
the front setback provisions in Section
3-804(A) above. The other side of the
property shall be considered a rear yard.
A fence may be erected in compliance with
the rear yard setback provisions in Sec-
tion 3-804(B) above provided the follow-

2. The pattern of the dwellings across
the street is also oriented with the
rear yard facing the lots across the
street.
3. If both of these conditions can not be
met, such fence in the rear setback
shall not exceed three feet in height.
F. Exception for attached dwellings. No fence
or wall over six feet in height shall be
permitted on any attached dwelling lot,
except where the fence or wall is installed
along the boundary of the property, in
which case the fence or wall shall be
uniformly designed and shall meet the
height limits and other standards other-
wise applicable to the fence or wall.

B. Front setback. Chainlink fences shall not
be permitted in the front yard setback
area. Chainlink fences shall only be lo-
cated on a parcel to the rear of the front
building line of the principal building,
unless permitted pursuant to Section
3-802(E) above.
C. Side and rear setbacks. Chainlink fences
located in a side or rear yard shall not
exceed 48 inches or six feet if clad with
green or black vinyl. If such side or rear
yard is adjacent to a public right-of-way,
however, such chainlink fence shall not be
permitted.
D. Landscaping requirements. Chainlink
fences which are not otherwise required
to be landscaped by Article 3 Division 12
shall be landscaped with a continuous
hedge or a nondeciduous robust growing
vine at frequent intervals. Such landscap-
ing may be located on the external or
internal side of the fence along the entire
length of the fence.
E. Public or private recreational facilities.
Chainlink fences for public or private ten-
nis courts, golf courses and driving ranges,
athletic fields, play courts, batting cages
and other similar uses are exempt from
height regulations contained in this sec-
tion and the location restriction of Section
3-805(B) above.

Section 3-905. Coastal construction control
line.
A. Purpose. This section establishes within the
city the coastal construction control line as the
line of reference from which setbacks shall be
measured along the Gulf of Mexico for buildings
and structures pursuant to F.S. § 161.053 in order
to protect the safety, economic, environmental,
recreational and community appearance objec-

C. Residential infill projects:
Single-family detached dwellings are the
only permitted use eligible for residential
infill project application;
2. The development or redevelopment of the
parcel proposed for development is other-
wise impractical without deviations from
one or more of the following: intensity;
other development standards;
4. The uses within the residential infill project
are otherwise permitted in the district;
5. The uses within the residential infill project
are compatible with adjacent land uses;
6. The development of the parcel proposed
for development as a residential infill
project will upgrade the immediate vicin-
ity of the parcel proposed for develop-
ment;
7. The design of the proposed residential
infill project creates a form and function
which enhances the community character
of the immediate vicinity of the parcel
proposed for development and the City of
Clearwater as a whole;
8. Flexibility in regard to lot width, required
setbacks, height, off-street parking access
or other development standards are justi-
fied by the benefits to community charac-
ter and the immediate vicinity of the
parcel proposed for development and the
City of Clearwater as a whole.
D. Utility/ infrastructure facilities.
1. No above ground structures are located
adjacent to a street right-of-way;
2. Any above ground structure other than
permitted telecommunication towers and
utility distribution lines located on or
along a rear lot line shall be screened
from view by a landscaped opaque wall or
fence which is at least two-thirds the
height of the above ground structure and
shall be landscaped with trees and hedges
which five years after installation will
substantially obscure the fence or wall
and the above ground structure.
