Request: To construct a pool and pool deck as a Comprehensive Infill Redevelopment
Project with deviations to the required east side yard setback from 10' x 5' (to pavement), west
from 10' x 0' (to pool deck); 4.3 to sidealk and to the required rear yard setback from 18' x 0' (to
pool deck), from 6.8' to sidewalk.
WRITTEN SUBMITTAL REQUIREMENTS
1. This redevelopment project was approved through the CDB on September 20, 2005
(FLD2005-07070) for 15 attached dwelling units. This application is a request to
modify to the approved site plan to include the approval of a small pool and pool deck
in the rear northeast corner of the site. The proposed pool and deck will be in
harmony with the scale, bulk, coverage, density and character of adjacent properties
as the Clearwater Pass District consists of mixed uses including high-rise
condominiums, resort hotels, retail, recreational and tourist oriented uses. All along
Bayway Boulevard, newly constructed townhomes and condominium buildings are
being or are already constructed with similar pools running along the waterside of the
parcels.
2. The proposed improvements to the site include the additional construction of a
swimming pool and pool deck. These improvements will serve as an incentive to
surrounding property owners to upgrade and/or redevelop their sites and could lonely
add increased value to the immediate community.
3. There will be no adverse affects to the health or safety of persons residing or working
in the neighborhood associated with this proposal. The pool and pool deck will The
located to the rear of the property, enclosed by a fence with a gate and will be used
solely by the residents and their guests.
4. The proposed development will not have any affect on traffic congestion as the pool
will be for residents of the development only.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel. This parcel cannot be compared to the parcel to the
west, as this is a police sub-station. The property to the east and further west, past the
police sub-station are condos and townhouses. These developments have pools on

site for their residents along the seawall and many pool decks are at a 0' setback to
the seawall
6. The proposed pool and pool deck addition will not have an acoustic, olfactory or
hours of operation impacts. The pool will not affect the water sight triangles. The
patrons of the pool will be the residents and their guests and there will be regulations
as to the time of operation of the pool, usually 9:00 a.m. -10:00 p.m. There will also
be a fence and gate surrounding the pool.

PROJECT CRITERIA
1. The development of the parcel proposed is impractical without deviations. The entire
block of Brightwater Drive has asked for relief on rear setbacks to accommodate
swimming pools and decks. In order to accommodate retention, retention ponds,
parking and required landscaping, deviations are required.
2. The fair market value of the surround properties will not be reduced. An addition to a
pool will increase the already just market value of $4,800,000.00 by another $15-
$20,000.00.
3. The use of a pool is a permitted within the City of Clearwater.
4. The requested pool and variances to the setbacks to accommodate the swim spa are
compatible with adjacent land uses. Paradise Cove is to the west of this property has
a pool as well as other parcels on the same block.
5. The project has already been approved. The owners wish to have a swim spa on the
same site they currently own.
6. The swim spa will be consistent with the surrounding parcels and will upgrade the
vicinity.
7. Adding a swim spa to an already approved site which is under construction will
benefit the community character and Clearwater as a whole.
8. No variances are being requested in regards of lot width, height, or off-street parking.
The setback variances have been minor adjustments to prior approved setbacks. East
from 4.5' to the building was approved, we are proposing the setback to now be to the
pool deck; a south setback already approved from 0' to a boardwalks is now being
requested to the swim spa deck.
9. All parking has been previously been approved through FLD2002-11042 and is not
applicable in this application. The pool is for residents and their guests only.
10. The Tourist District or Downtwon District do not apply to this proposed development
site.

DRAINAGE NARRATIVE

The project is located in section 17, township 29 and range 15 in the City of Clearwater.
The contiguous owned property is 15,264 sf and consists of the construction of
condominium dwelling units with associated utilities, parking and road infrastructure,
storm management system and utilities and results in the following:
• Removal of 1,006 S.F. of impervious vehicular use area and 11,120 S.F. of
new building, sidewalk and pool area.
• Construction of 4,940 S.F. of impervious vehicular use area and 5,593 S.F. of
new building, sidewalk and pool area.
• This will yield a 3,934 S.F. INCREASE of impervious vehicular use area and
overall there will be a 1,593 S.F. DECREASE in total impervious area.
3/4" water quality treatment over the entire site equal to a volume of 954 cf is provided
within two retention vaults which each have a treatment capacity equal to 552 cf
between the bottom of vault elevation 2.60 and design high water elevation of 4.10
yielding a total volume capacity of 1,104 cf. Each vault's treatment volume is recovered
within 15 hours by 10' of 6" underdrain. Overflow beyond the water quality treatment
requirement is discharged into Clearwater Harbor so quantity attenuation is not provided.

Subject: Maintenance and Operation of the Detention Vaults
Dear Mr. Newkirk:
Per the rules and regulations of the Southwest Florida Water
Management District, we are required to furnish you with a set of
instructions for maintenance and operation of the detention
vaults.
The detention vaults are designed to maintain certain volumes of
rainfall runoff corresponding to specific water elevations in the
area.
The control structure regulates the level of the water in the vault.
The volume above the slot should be discharged under a grease
skimmer and through the slot within a few hours following a
storm event. The volume below the slot should take less than 36
hours to be discharged through the underdrain and the vault
should be dry within 36 hours following a storm event, assuming
there is no interceding rainfall.
Here are some suggested procedures to keep the system
functional:
The bottom of the vault should be inspected
regularly to assure that excess siltation has not
occurred. Siltation of the vault shall be controlled
to assure that the storage volume is not affected.
Periodic cleaning of the vault bottom and
removal of silts is required. It is required that
cleaning be done every six (6) months.

Dear Mr. Ghovaee:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On February 21, 2006, the Community Development Board reviewed your requests
for Flexible Development approval to permit the addition of a pool to a previously approved attached
dwelling project (FLD2005-07070, approved September 20, 2005) in the Tourist District with a reduction
to the side (west) setback from 10 feet to zero feet (to pool deck) and a reduction to the rear (north)
setback from 20 feet to zero feet (to pool deck), as a Comprehensive Infill Redevelopment Project, under
the provisions of Section 2-803.C. The Community Development Board (CDB) APPROVED the
application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Comprehensive Infill
Redevelopment Project per Section 2-803.C.
2. The proposal is in compliance with other standards in the Code including the General Applicability
Criteria per Section 3-913.
3. The development is compatible with the surrounding area.
Conditions of Approval:
1. That all conditions of approval adopted by the CDB for Case No. FLD2005-07070 are still in effect;
and
That there be no landscaping (other than sod) within waterfront sight visibility triangles.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of Flexible
Development approval (February 21, 2007). All required certificates of occupancy shall be obtained
within two years of the date of issuance of the building permit. Time frames do not change with
successive owners. The Community Development Coordinator may grant an extension of time for a
period not to exceed one year and only within the original period of validity. The Community
Development Board may approve one additional extension of time after the community development
coordinator's extension to initiate a building permit application.

GENERAL ENGINEERING
1. Prior to the issuance of building permits, plans will be provided, signed and sealed by
a Florida registered engineering depicting how seawall tiebacks are to be constructed
to accommodate swimming pool and pool deck construction
LANDSCAPING
1. Sheet L1.l has been revised to remove all landscaping except sod in the water site
visibility triangle.
STORMWATER:
1. SWFWMD permit or letter of exemption will be provided prior to building permit.
2. Site grades have been revised to a minimum of .5% and elevation at the property line
of the driveway is a minimum of .25 above the grate elevation at the vault.
3. The storm pipe discharge pipe has been revised.
TRAFFIC
Accessible path from the buildings accessibility entrance to the swimming pool has
been provided on Sheet C3.1.
PLANNING
1. The pool has been relocated to the northwest corner.
2. Sheet C3.1 has been revised to show a non-opaque fence.
3. Sheet C4.1 has been revised. The seawall is not being increased and a cross section
between the pool deck and east property line, including existing and proposed6rrad

2. Revise Exhibit A for Description of Request: a) The proposed side (east) setback is three feet (not

setback from 20 feet to 18 feet (to building), from 20 feet to 10.8 feet (to pavement) and from 20

The project value for this pool is included in the application narrative.
4. While the Community Development Board approved the project with a front setback to building
of 18 feet, a Minor Revision was approved on November 21, 2005, approving a reduction of the
building to a front setback of 16 feet. The Site Data Table on Sheet C 1.1 should reflect the Minor
Revision setback and the site plan drawings should also reflect this dimension. Revise. The site
data table is corrected to show 16' front setback.

IMMEDIATE VICINITY: The surrounding area is a mixture of attached dwellings
(condominium and townhomes), overnight accommodation uses and
commercial uses. A City police substation abuts to the west.

ANALYSIS:
Site Location and Existing Conditions: The 0.35 acres is located on the north side of Bayway
Boulevard, approximately 300 feet west of Gulf Boulevard. The site has approximately 135 feet
of frontage on Bayway Boulevard and was formerly developed with 16 attached dwellings
(Demolition Permit #BCP2005-10528 issued November 23, 2005). Parking for the former
development was located partially within and backs into the right-of-way. The former building
was primarily one-story in height, except the front portion that was two-story in height, and
wrapped around a pool in the center of the building.
On June 21, 2005, the Community Development Board (CDB) denied Case No. FLD2005-03031,
a proposal to permit 16 proposed attached dwellings. Based on a determination that a new
proposal with greater setbacks, especially to the side and rear of the site, was a substantial change
over that previously denied, the CDB approved Case No. FLD2005-07070 on September 20, 2005,
permitting 15 attached dwellings on this site.
A City police substation abuts the west side of this site. There are attached dwellings (townhomes
and condominiums) east and west of this site on the north side of Bayway Boulevard. An existing
overnight accommodation use is southwest across Bayway Boulevard (proposed to be redeveloped
as a mixed use - see FLD2005-07071, 678 S. Gulfview Boulevard, on the same agenda as this
case), while a shopping center (retail sales) is south across Bayway Boulevard.
Proposal: The proposal is to add a pool area to the rear of the property adjacent to the seawall.
This pool was not proposed with the original application approved by the CDB. This proposal
includes a reduction to the side (west) setback from 10 feet to zero feet (to pool deck) and a
reduction to the rear (north) setback from 20 feet to zero feet (to pool deck). Current development
practices place the pool area at the rear of the property, which is generally the most private area of
the property, with a pool deck at a zero setback. Most of the redevelopment projects approved by
the CDB along the north side of Bayway Boulevard have had pool decks at a zero setback. The
reduction to the west side setback is due to the approved location of the building and parking
(approved under FLD2005-07070), the necessity for a pool of adequate size and the need for
sufficient decking around the pool for access and safety purposes. The Police Substation is located
on the property to the west, where impacts of the pool will be negligible. The landscape plan
presently indicates podocarpus shrubs proposed within the waterfront sight visibility triangle on
the east side. In accordance with Section 3-904.B, there can be no landscaping within waterfront
sight visibility triangles.
All applicable Code requirements and criteria including, but not limited to, General Applicability
criteria (Section 3-913) and Comprehensive Infill Redevelopment Project criteria (Section 2-
803.C) have been met.
Code Enforcement Analysis: There are no outstanding enforcement issues associated with this
site.

FINDINGS OF FACT AND CONCLUSIONS OF LAW:
FINDINGS OF FACT
1. The subject 0.35 acres is zoned Tourist District and is located within the "South
Beach/Clearwater Pass District" of Beach by Design;
2. The site was formerly developed with 16 attached dwellings, which was nonconforming to
current density maximums;
3. On September 20, 2005, the CDB approved Case No. FLD2005-07070, which included the
Termination of Status of Nonconformity for the existing 16 attached dwelling units, to
permit the redevelopment of the property with 15 attached dwellings in a residential
building 87.25 feet tall;
4. This proposal is to add a pool area to the rear of the property adjacent to the seawall, which
was not included in the original proposal, at a zero-foot rear and west side setbacks;
5. Current development practices place the pool area at the rear of the property;
6. Most other properties along Bayway Boulevard have been approved by the CDB with a
pool in a similar location and setback as this proposal;
7. The Police Substation is to the west of this property where the impacts of the pool at a zero
west side setback will be negligible;
8. The proposal is compatible with the surrounding development; and
9. There are no active code enforcement cases for the parcel.
CONCLUSIONS OF LAW
1. Staff concludes that the proposal complies with the Flexible Development criteria as a
Comprehensive Infill Redevelopment Project per Section 2-803.C;
2. Staff further concludes that the proposal is in compliance with the General Applicability
criteria per Section 3-913 and the other standards of the Code; and
3. Based on the above findings and conditions, Staff recommends approval of this
application.

SUMMARY AND RECOMMENDATION:
The Development Review Committee reviewed the application and supporting materials on
January 5, 2006. The Planning Department recommends APPROVAL of the Flexible
Development application to permit the addition of a pool to a previously approved attached
dwelling project (FLD2005-07070, approved September 20, 2005) in the Tourist District with a
reduction to the side (west) setback from 10 feet to zero feet (to pool deck) and a reduction to the
rear (north) setback from 20 feet to zero feet (to pool deck), as a Comprehensive Infill
Redevelopment Project, under the provisions of Section 2-803.C, for the site at 706 Bayway
Boulevard, with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Comprehensive Infill
Redevelopment Project per Section 2-803.C.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area.
Conditions of Approval:
1. That all conditions of approval adopted by the CDB for Case No. FLD2005-07070 are still in
effect; and
2. That there be no landscaping (other than sod) within waterfront sight visibility triangles.

The Community Development Board of the City of Clearwater, Florida, will hold public
hearings on Tuesday, February 21, 2006, beginning at 1:00 p.m., in the City Council Chambers,

RE: Development Order - Case No. FLD2005-11110 - 706 Bayway Boulevard
Dear Mr. Ghovaee:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On February 21, 2006, the Community Development Board reviewed your requests
for Flexible Development approval to permit the addition of a pool to a previously approved attached
dwelling project (FLD2005-07070, approved September 20, 2005) in the Tourist District with a reduction
to the side (west) setback from 10 feet to zero feet (to pool deck) and a reduction to the rear (north)
setback from 20 feet to zero feet (to pool deck), as a Comprehensive Infill Redevelopment Project, under
the provisions of Section 2-803.C. The Community Development Board (CDB) APPROVED the
application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Comprehensive Infill
Redevelopment Project per Section 2-803.C.
2. The proposal is in compliance with other standards in the Code including the General Applicability
Criteria per Section 3-913.
3. The development is compatible with the surrounding area.
Conditions of Approval:
1. That all conditions of approval adopted by the CDB for Case No. FLD2005-07070 are still in effect;
and
2. That there be no landscaping (other than sod) within waterfront sight visibility triangles.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of Flexible
Development approval (February 21, 2007). All required certificates of occupancy shall be obtained
within two years of the date of issuance of the building permit. Time frames do not change with
successive owners. The Community Development Coordinator may grant an extension of time for a
period not to exceed one year and only within the original period of validity. The Community
Development Board may approve one additional extension of time after the community development
coordinator's extension to initiate a building permit application.

The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit of
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.
Additionally, an appeal of a Level Two approval (Flexible Development) may be initiated pursuant to
Section 4-502.B by the applicant or by any person granted party status within 14 days of the date of the
CDB meeting. The filing of an application/notice of appeal shall stay the effect of the decision pending
the final determination of the case. The appeal period for your case expires on January 31, 2006 (14 days
from the date of the CDB meeting).
