Before me, the undersigned authority, personally appeared LAWRENCE W.
WOODEN, who being first duly sworn, deposes and says:
1. My present address is 1601 Bankhead Highway, Lot 162, Irondale, Alabama
35210.
2. I am the son-in-law of William Charles Rogers, now deceased, who
purchased the North 1/2 of Lot 73, Block 8, Clearwater Cemetery (referred to herein
as the Cemetery Lot), which consists of two spaces, from the City of Clearwater on
August 9, 1949.
3. In order to secure the availability of the vacant space in the Cemetery Lot
to my son, Richard C. Wooden, I state the following facts upon my personal
knowledge:
(a) William C. Rogers married Martha Jane Ineson, who was the mother
of olive Evelyn Rogers, their only child. Olive Evelyn Rogers became my wife and
Richard C. Wooden's mother.
(b) Martha Jane Ineson Rogers predeceased her husband in 1949 and is
interred in one of the two spaces in the Cemetery Lot.
(c) William C. Rogers remarried after the death of Martha Jane, his first
wife. His second wife, Fay Keogh Rogers, sent the deed to the Cemetery Lot to my
wife on August 15, 1970, with a letter acknowledging that she felt that my wife should
have the deed.
(d) My wife, Olive Evelyn Wooden, died on August 10, 1987, in
Birmingham, Alabama, without a will.
(e) To my knowledge, there are no other heirs of William C. Rogers and
no other persons who may claim an interest in the Cemetery Lot, except my son.
(f) It is my desire that the Cemetery Lot be made available to my son,
Richard C. Wooden, so that he may be interred next to his grandmother.
(g) My son's present address is 1601 Bankhead Highway, Lot 162,
Irondale, Alabama 35210.
4. It is the purpose of this Affidavit to induce the City of Clearwater to issue
a certificate acknowledging the right of my son, Richard C. Wooden, to be interred in
the vacant space in the Cemetery Lot. In consideration of the issuance of such

certificate, I promise to defend and indemnify the City of Clearwater in the event
that any other person should ever claim damages as a result of this transaction or the
subsequent interment of my son, and this promise is binding upon myself, my heirs and
assigns.
Further affiant sayeth not.

Your son has called me to remind me that I am overdue in responding to your
request, for which I apologize.
After reviewing the information that you have sent me to date, I have prepared
an affidavit setting forth the facts of your situation as you have explained them to me.
I request that you review this affidavit carefully, and note whether there are any
errors of fact. If there are any errors of fact, or if you wish to revise any statement
or add any new statements of fact, please write your changes in the margins of one
copy and mail it back to me, keeping the other for your file. I will retype the affidavit
to incorporate your changes, and will then mail it back to you.
If no changes need to be made, or whenever I send you the corrected affidavit,
we will require your signature before a notary public. The notary public will enter the
name of your county and complete the certificate on page 2. Upon receipt of the
completely executed affidavit, assuming that no changes have been made which defeat
the purpose of the affidavit, the City Clerk of the City of Clearwater will then issue a
certificate acknowledging the availability of the cemetery lot for your son, Richard C.
Wooden.
I appreciate your patience in resolving this matter. As I explained earlier, this
may seem like more trouble than it is worth, but the use of cemetery lots can be a
very sensitive matter to many people and the City of Clearwater does not desire to be
involved in disputes among heirs as to who is entitled to use a cemetery lot. By the
execution of this affidavit, you will be giving the City the assurances we need that
such a dispute is unlikely with respect to this lot.
Should you or your son have any questions regarding this matter, please let me
know. You may wish to review this matter with your attorney, in which case I will be
happy to hear from your attorney.
