Manual and 4-202.A.21)
A STORMWATER NARRATIVE MUST BE SUBMITTED WITH ALL APPLICATIONS. All applications that invo
addition or modification of impervious surface, including buildings, must include a stormwater plan that demonstrates compliance with I
City of Clearwater Storm Drainage Design Criteria manual. A reduction in impervious surface area does not qualify as an exemption
this requirement.
If a plan is not required, the narrative shall provide an explanation as to why the site is exempt.

First and Second Parties hereby represent and warrant that each granting party is authorized to enter
into this Grant of Easement.
First and Second Party each reserves and retains all right, title, interest and privilege in the full use and
enjoyment in, over, and across the easement for all purposes not inconsistent with the uses and rights
granted hereafter. First Party further reserves and retains the rights to construct upon their respective
parcel real property improvements including but not limited to enclosed building structures, driveways,
walkways, landscape areas and other improvements which shall not constitute a violation of this
agreement or action contrary to the interest of Second Party. Second Party further grants unto first party
the rights, benefits and privileges to connect to and use all existing underground stormwater drainage
lines and stormwater retention areas which shall run for the benefit of first and second party. Any created
stormwater retention areas constructed upon First Party's parcel shall also be utilized for the benefit of
Second Party.
This easement is granted and accepted by First and Second Party subject to the following conditions that
Grantee covenants and agrees to perform:
1. To use the said easement with due care and good faith.

3. To use the easement granted hereunder in such manner as to prevent the creation of any
obstruction or condition that is or may become hazardous to either party, their guests,

4. To mutually indemnify and hold each other harmless from any and all claims for the payment
of any compensation or damages for injury to persons (including wrongful death) or damage
to property resulting from the use by the benefited party of the easement herein granted,
together with any and all court costs and attorney's fees incurred by the granting party in
connection with such claims.
5. Each party shall assume all liability and bear all expenses for the repair and maintenance of
the easement property on each of their respective real property parcels. Notwithstanding,
each party shall reimburse the respective burdened grantor for costs or repair and
maintenance caused by the negligence of the benefited party, their guests, employees,
invitees, licensees, heirs, assigns or successor in interest.
6. First and Second Party understand and agree that this easement is a nonexclusive easement
and agrees to use the same with due consideration for the rights of the property owner and
other easement holders, if any.

Dear Mr. Pappas:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On August 4, 2005, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to construct a 10,150 square foot, two-story
office building. The request includes an increase to the maximum building height from 25 feet to 36.5
feet, a side (north) setback reduction from 10 feet to three feet (to building), a side (north) setback
reduction from 10 feet to zero feet (to pavement), a side (west) setback reduction from 10 feet to zero
feet (to pavement), a front (east setback reduction from 25 feet to 20 feet (to pavement), and a front
(south) setback reduction from 25 feet to 20 feet (to pavement), per Section 2-703.I. The DRC
recommended approval of the applications with the following bases and conditions:
Bases for Approval:
1. The proposal complies with Office criteria under the provisions of Section 2-703.I;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That a tree preservation plan prepared by a Certified Arborist be provided, prior to the issuance of a
site or building permit
2. That the tree survey and landscape plan be revised to show all replacement trees in the same
location from which they were inadvertently removed, prior to building permit
3. That a sewer lateral constructed in accordance with City of Clearwater Contract Specifications and
Standards Index # 305 shall be installed at developer's cost, prior to the issuance of a building
permit;
4. That a Pinellas County right-of-way permit is required for all work taking place in

7. That a 35% Littoral Zone concentrated near the pond outfall be provided prior to the issuance of a
site or building permit;
8. That a written narrative, including discussion on methodology, history, hydrology, hydraulics and
basis for all assumptions made, to accommodate storm water calculations be provided prior to the
issuance of a site or building permit;
9. That a recorded copy of cross drainage agreement addressing water treatment on adjacent property
be provided prior to the issuance of a site or building permit;
10. That the site plan be revised to show turning template for a passenger car maneuvering at turns
prior to the issuance of a site or building permit;
11. That the site plan show parking spaces comply with City standard dimensions, including angle in
degrees used, prior to the issuance of a site or building permit;
12. That the site plan show an accessible path from a building's accessible entrance to a public
sidewalk and to multiple buildings on site compliant with Florida Accessibility Code for Building
Construction Chapter 11, Section 11-4.3.2, prior to the issuance of a site or building permit;
13. That sight visibility triangles at the driveways be shown on the site and landscape plans, prior to the
issuance of a site or building permit;
14. That a copy of the recorded cross-access parking agreement binding upon successive property
owners be provided, prior to the issuance of a Certificate of Occupancy,
15. That all site revisions including but not limited to: storm water, landscaping, and tree preservation,
required for 1834 Belcher Road be approved and completed, prior to the issuance of a Certificate of
Occupancy for 1822 Belcher Road; and
16. That all signage meet Code requirements and be architecturally integrated into the design of the site
and buildings.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with above 15 conditions. The approval is based
on and must adhere to the application dated received June 17, 2005 and revised site plans and building
elevations dated received November 17, 2005.
Pursuant to Section 4-303, an application for a, building permit shall be made within one year of
Flexible Standard Development approval (December 5, 2006). All required certificates of occupancy
shall be obtained within two years of the date of issuance of the building permit.
Time frames do not change with successive owners. An extension of time may be granted by the
Community Development Coordinator for a period not to exceed one year and only within the original
period of validity. The Community Development Coordinator may approve an additional extension of
time not to exceed one year for good cause shown and documented in writing. The coordinator must
receive the request for this extension within the one-year period of validity after the original time

The issuance of this Development Order does not relieve you of the necessity to obtain any building

permits or licenses that require this prior development approval.

1. Harmony with scale, bulk, coverage, density and character of adjacent properties.
The building proposed is 8,280 square feet in size, consisting of two stories. It is
less than the maximum buildable height. Adjacent constructs have features with
heights in excess of 20 feet. The two story construction will be within 10 feet of
the adjacent structures in overall height. The coverage on the first level is 3,600
square feet, to permit additional ground area for parking. The adjacent properties
consist of bank, restaurant, and office/warehouse uses. The proposed office is
consistent with the character of adjacent properties in that all but the restaurant
contain similar uses, in that they all contain offices.
2. How will office use not discourage or hinder appropriate development and use of
adjacent land and buildings or significantly impair the value thereof?
The office use is consistent with the land use, and has no negative impact on
adjacent land or buildings, and will not impair the value of those properties. The
adjacent restaurant site will be impacted through common use of driveways and
retention, however, will be improved during construction to improve/increase
retention and will further benefit from cross parking rights on the office site.
3. How will the office use not adversely affect the health or safety or persons
residing or working in the neighborhood?
There are no persons residing in the neighborhood. The office project will not
create any odors or hazardous emissions and will have minimal adverse impact on
the health or safety of persons working in the area. The property will improve
public access in that sidewalks will be installed to permit pedestrian traffic along
the West side of N. Belcher.
4. How is the office use designed to minimize traffic congestion?
The office utilizes existing curb cuts that service the adjoining restaurant, and
keeps traffic flow contained within the office and restaurant site. The flow is
directed around the proposed office in a one-way flow to minimize hazards and
congestion to get around the structure. Parking is evenly placed at the rear and
front of the office to avoid parking congestion. The office shall benefit from an
easement for ingress/egress over the adjoining restaurant site which aids traffic
flow around office site.
How is the office use consistent with the community character of the immediate
vicinity?

The office use is consistent with the land use and zoning for both Clearwater and
County use.
6. How does the office use minimize adverse effects, including visual, acoustic,
olfactory, and hours of operation impacts, on adjacent properties?
The office use doesn't adversely affect the adjacent property visually as the office
use is the cleanest use for the site. Solid waste is minimal, and traffic is minimal
and typically vehicular (not truck traffic). Acoustically, there are no sounds that
would emanate from the office, except for external mechanical units servicing the
structure which would be minimal. There are no odorous emissions anticipated
from the proposed office. Waste would be clean, non-odorous (primarily paper)
solid waste. The proposed use anticipates office hours of operation primarily
weekdays between 8 AM to 6 PM, which is complimentary to the hours of
operation of the adjacent restaurant which has higher use at evening and weekend
hours. All other adjacent properties would be minimally impacted by the
proposed office hours of operation, except to the increase in trips.
7. How is Flexibility Criteria being met: (building height) vs. site plan. Also,
address roof deck/parapet height-altered roof.
The proposed office will use a gable type roof, not parapet as originally proposed.
The overall building height is expected to be approximately 25'-28'.
8. How does side setback meet Flexible Criteria-emergency vehicle access.
Emergency vehicles will have access to the entire perimeter of the proposed
building, on three sides from within the building site, and on the fourth side
(North side) from the adjoining restaurant site which is used for shared parking
and driveways.
9. How side setback Flexibility Criteria being met. Reduction in side rear setback-
parking and design issues.
The parking and drive lanes have been designed to spread the parking between the
front and rear of the parcel, and to keep the traffic flow one direction around the
proposed structure. This will maximize the green space on the Belcher and
Sunnydale right of way sides which will permit enhanced aesthetics through
larger greenbelts and planting areas. There is a buffer between the North and
West boundary lines of the office and restaurant site which is consistent with the
typical parking islands on the restaurant site.
10. How side setback Flexibility Criteria being met-reduction of side and rear setback
does not reduce the amount of landscape area otherwise required.

As a property owner within 200 feet of 1822 N BELCHER RD, the City of Clearwater Planning Department
gives notice that an application for Flexible Standard Development approval to construct a 10,150 square foot ,
two-story office building. The request includes: an increase to the maximum building height from 25 feet to
36.5 feet, a side (north) setback reduction from 10 feet to three feet (to building), a side (north) setback reduction
from 10 feet to zero feet (to pavement), a side (west) setback reduction from 10 feet to zero feet (to pavement), a

On August 04, 2005, the Development Review Committee (composed of the City's professional staff) will

This letter collsti.tUtes a Development Order pursuant to Section 4202.E of the Community
Development Code. On August 4, 2005, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to construct a 10,150 square foot, two-story
office building. The, request includes an increase to the rn'aximum building height i'rom 25 feet to 36.5
feet, a side (north) setback reduction from. 10 feet to three feet (to building), a side (north) setback
reduction from 10 feet to zero feet (to pavement), a side (west) setback reduction ft6m. 10 feet to zero
feet (to pavement), a front (east setback reduction from 25 feet to 20 feet (to pavement), and a front
(south) setback reduction from 25 feet to 20 feet (to pavement), per. Section 2-7031 The DRC
recommended approval of the applications with the following bases and conditions:
Bases for Ap rp oval:
1. The proposal complies with Office criteria under the provisions of Section 2-703.1;
2, The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of Ag ro oval:
1. That a tree preservation plan prepared by a Certified Arborist be provided, prior to the issuance of a
site or building permit
2. That the tree survey and landscape plan be revised to show all replacement trees in the same
location from which they were i.naldvertently removed, prior to building permit
.3. That a sewer lateral constructed in accordance with City of Clearwater Contract Specifications and
Standards Index # 305 shall be installed at developer's cost, prior to the issuance of a building
permit;
4. 't'hat a Pinellas County right-of-way permit is required for all work taking place in
Belcher Road right-of-way;

11. That the site plan show parking spaces comply with City standard dimensions, including angle in
degrees used., prior to the issuance ofa site or building-permit;
12. That the site plan show an accessible path from a building's accemible entrance to a pcabl..ic
sidewalk and to multiple buildings on site compliant with Florida Accessibility Code for Building
Construction Chapter 11, Section 11-4.3.2,.prior to the issuance of a site or building permit;

and buildings.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with above 15 conditions. The approval is based
on and must adhere to the application dated received Tune 17, 2005 and revised rite plans and building
elevations dated received November 17, 2005.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (December 5, 2006). All required certificates of occupancy
shall be obtained within. two years of the date of i4uance of the building permit.
Time frames do not change with successive owners. An extension of time may be granted by the
Community Development Coordinator for a period not to exceed one year and only within the original
period of validity. T.he Community Development Coordinator may approve an. additional extension of
time not to exceed one year for good, cause shown and documented in writing. The coordinator must
