Clearwater will tolerate the encroachment of a portion of the garage on the property
located at 830 Bay Esplanade into afive-foot utility easement along the north property
line. Based upon the As-Built Survey, it is understood that the subject portion of the
structure currently encroaches 2.9-feet to 3.1-feet into the easement over a distance of
22.2-feet. Should this garage be demolished, it may not be rebuilt within the easement.

Dear Mr. Martin:
This letter constitutes a Development Order pursuant to Section 4-202.E of the- Community
Development Code. On March 3, 2005, the Development Review Committee (DRC) reviewed your
application for Flexible Standard. Development approval to allow for the addition of a swimming pool,
deck, and .fence in association with an existing single-family residence, in the Low Medium Density
Residential zoning district. The request includes a front (east) setback reduction from 25 feet to 19.9
feet to the swimming pool; a front (east) setback reduction from 25 feet to 14.4 feet to the pool deck; a
front (west) setback reduction from 25 feet to 9.9 feet to the pool deck; a front (east) setback reduction
from 25 feet to 14.4 feet for a PVC fence, six feet in height; and a front (west) setback reduction from
25 feet to 9.9 feet for a PVC fence, six feet in height, as a Residential Infill Development Project, per
Section 2-203.C. The DRC recommended approval of the application with the following bases and
conditions:
Bases for Approval:
1. .The proposal complies with Detached Dwellings criteria under the provisions of Section 2-203.B;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That a three foot landscape buffer be provided and maintained along the outside perimeters of the
six foot high wood fences along the Bay Esplanade and Narcissus Street rights of ways; and
2. That the mechanical and pool equipment shall be screened on four sides by a fence, gate, wall,
mounds of earth, or vegetation from view from public streets and abutting properties.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the two above conditions. The approval is
based on and must adhere to the site plan and application dated received January 04, 2005.

Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (March 7, 2006). All required certificates of occupancy shall
be obtained within one year of the date of issuance of the building permit. Time frames do not change
with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.

My first point of clarification would be on the. swimming pool,. if the FSD. is necessary for the.
installation of a pool then why was. the pool. installed about four months ago?..The pool.
contractor installed the pool not in the approved. location and walked off the job. The general
contractor doing repairs. to the house has. taken over trying to salvage. the error..
Is an FSD. applied for after the fact or prior to construction? A FSD application can be applied
for either way..
As for the fencing,. if approved will the six foot PVC fencing require a certain amount of
landscaping or does it allow the property owner to install a stark PVC. fence within a reduced
setback? Landscaping will. be required along the outside. perimeter of the fencing on both the.
Bay Esplanade. and Narcissus. frontages..
Also,. as in regard to fencing,. will the. reduced setback hinder the installation of a sidewalk
around the property,. especially along the. legal frontage. of the property along Bay Esplanade,. as
designated by the. property's. legal address. (830. Bay Esplanade)? .The fencing will. be at 9'-9"
inside the. Narcissus. property line and 14.4'. inside the Bay Esplanade. property line.. No this
fencing and landscaping should not interfere with an installation of a sidewalk on either frontage.

proposal is allow an existing in-ground swimming pool that was installed in an unapproved location at 19.9 feet from
the east, front property line along Bay Esplanade. The existing single-family residence of approximately 1,210 square
feet is currently under remodel and will be consistent with the community character of the immediate vicinity.
The proposed new pool, deck and fencing will maintain the established reduced front setback that is characteristic to
the existing building along both Bay Esplanade and Narcissus. The proposed six foot fence will be required to
maintain a minimum three foot landscape buffer along the outside perimeter of all fencing located in the front setbacks
along Bay Esplanade and Narcissus.

As a property owner within 200 feet of 830 BAY ESPLANADE, the Cfty of Clearwater Planning Department
gives notice that an application for Flexible Standard Development approval to allow for the addition of a
swimming pool, deck, and. fence in association with an existing single-family residence, in the Low Medium
Density Residential zoning district. The request includes a front (east) setback reduction from 25 feet to 19.9
feet to the swimming pool; a front (east) setback reduction from 25 feet to 14.4 feet to the pool deck; a front
(west) setback reduction from 25 feet to 9.9 feet to the pool deck; a front (east) setback reduction from 25 feet to
14.4 feet for a PVC fence, six feet in height; and a front (west) setback reduction from 25 feet to 9.9 feet for a
PVC fence, six feet in height, as a Residential Infill Revelopment Project, per Section 2-203.C..
On March 03, 2005, the Development Review Committee (composed of the City's professional staff) will
review and determine whether the application demonstrates compliance with the City's Community
Development Code. Following that review and determiniation, the Planning Director will issue a
Development Order approving, approving with conditions, or denying the application. The earliest date that
the City will make a decision on the application will be March 03, 2005.

conditions:
Bases for Approval:
1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2-203.B;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions ofApproval:
1. That a three foot landscape buffer be provided and maintained along the outside perimeters of the
six foot high wood fences along the Bay Esplanade and Narcissus Street rights of ways; and
2. That the mechanical and pool equipment shall be screened on four sides by a fence, gate, wall,
mounds of earth, or vegetation from view from public streets and. abutting properties.

My first point of clarification would be on the swimming pool, if the FSD is necessary
for the installation of a pool then why was the pool installed about four months ago?
The pool contractor installed the pool not in the approved location and walked off the
job.. The general contractor doing repairs to the house has taken. over trying to salvage
the error.
Is an FSD. applied for after the fact or prior to construction? A FSD application can be
applied for either way.
As for the fencing, if approved will the six foot PVC fencing require a certain amount
of landscaping or does it allow the property owner to install a stark PVC fence within a
reduced setback? Landscaping will be required along the outside perimeter of the
fencing on both the Bay Esplanade and Narcissus frontages.
Also, as in regard to fencing, will the reduced setback hinder the installation of a
sidewalk around the property, especially along the legal frontage of the property along
Bay Esplanade, as designated by the property°s legal address (830 Bay Esplanade)? The
fencing will be at 9'-9" inside the Narcissus property line and 14.4' inside the Bay
Esplanade property line. No this fencing and landscaping should not interfere with an
installation of a sidewalk on either frontage.
