AGREEMENT AND BOND
THIS AGREE~~NT, by and between the CITY OF CLEARWATER, FLORIDA,
a municipal cerperatien, hereinafter called "CITY," and
LAURANCE & ASSOCIATES, a Florida corporation,
hereinafter called NCONTRACTOR,"
WIT N E SSE T H:
That in censideratien ef the mutual cevenants and agreements
herein centained, and in further censideratien ef the permits and
privileges granted hereunder, and the bend given fer the faithful
perfermance hereef, the parties hereto. mutually agree as fellews:
1. The City hereby grants to. Centracter the permit, right
and privilege to. install and censtruct the fellewing:for Florida
Power Corporation:
Construct underground electrical conduit, one manhole and necessary
appurtenances to connect to existing manhole at the intersection of South
Gulf View Blvd. and Clearwater Pass Avenue, continue in a Southerly
direction for approximately 300 feet to new manhole.
Construct underground electrical conduit and necessary appurtenances
to connect with existing conduit at Coronado Drive, continue in a Westerly
direction for approximately 200 feet to the entrance of existing pier.
2. Centracter agrees to. submit the plans fer the aferesaid
werk to. the effice o.f the City Engineer and receive appreval frem
said City Engineer befere preceeding with the aferesaid werk.
3. ICentractor agrees to. accemplish the werk in an erder
which shall be satisfactery to. the City Engineer.
4. Centracter agrees that the earth excavatien incidental
to. the abeve described werk may be dene by machinery er pewer driven
teels, except such pertien as may be designated by the City Engineer
which shall be dene by hand laber. Centracter further agrees to.
water-cempact all trenches during back-filling.
5. Centracter shall be whelly respensible fer the repair
and replacement ef utilities and other damage caused by the accom-
plishment ef the work as aferesaid and Centracter further hereby
cevenants and agrees to. replace paving remeved or damaged by or
because of the accomplishment ef the aforesaid werk, said paving to

be of a type and quality equal to the paving so removed or damaged,
and performed in a manner satisfactory to the City Engineer, of the
City of Clearwater.
6. Contractor hereunto binds himself, his successors and
assigns to the faithful performance of this Agreement; and further
binds himself, his successors and assigns to the forfeiture of the
sum of Two Thousand Dollars ($2, 000. 00)
to City in the event of Contractor's breach or default of any of
Contractor's covenants, agreements or obligations of Contractor here-
under. If all of the covenants, agreements or obligations of
Contractor hereunder be faithfully performed by said Contractor; then
this bond shall be null and void and of no effect.
7. The aforesaid work shall be accomplished within thirty
(30) days; provided, however, that this time for completion shall be
e:;~tended by a period of time equal to any delays caused by strike r
riot, civil commotion, Acts of God, Governmental restrictions, or
natural calamity.
