Dear Mr. Lechowski:
In accordance with Section 133.09 of the City of Clearwater Code of Ordinances,
I have reviewed your request for a temporary sidewalk installation waiver.
The'- above-referenced property does not meet the requirements as set forth in
the aforementioned Code,. paragraph (e) because an existing sidewalk is located
within 200 feet of the property (on Otten Street). Therefore, I cannot grant
a temporaD' waiver of the sidewalk installation requirement on the above-
referenced property and your request is denied.
An on-site inspection of this property located a citrus tree, two small palm
trees, and two other trees in the approximate path of the sidewalk. Sidewalks
are required to be placed one foot from the property line and, since these trees
are very young and can be easily relocated, it is suggested that you do so to a
point where limbs as the trees mature will not interfere with the use of the
sidewalk. Also, the several short posts which have been installed in the right-
of-way must be removed.

Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

Sidewalk Waiver: 1794 Weston Drive

The above property is located on the southwest corner of Otten Street and Weston
Drive. Sidewalks are to be installed on Otten Street and is not disputed by the
property owner. The owner's main contention is that the sidewalk on Weston will
not go any place beyond his property. The city owns all the property to the
south and may elect to continue the sidewalks southward along the back of the
Kings Highway Recreation Center property. Since the sidewalk is to be installed
on Otten Street and the sidewalk on Weston Drive will connect to that sidewalk,
there does not appear to be a basis for granting the waiver.
Incidental to this request is the fact that the owner has planted a citrus tree,
two small palm trees and two other trees in the approxunate path of the sidewalk.
Since these trees are very young and can be easily relocat~d, it is my belief
that the owner should be instructed to remove the trees from the sidewalk area
and relocate them to a point where the limbs will not interfere with the use of
the sidewalk as the trees grow larger. Also, several short posts have been
installed in the right-of-way and are of the type which have been ordered r~~oved
from other locations in the city.
