Dear Mr. Simpson:
In accordance with Section 133.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installa-
tion waiver.

Since a drainage ditch is located along Belcher Road in front of the above-
referenced property which would make the sidewalk installation unreasonably
difficult due to the nature of the terrain, you meet the requirements as set
forth in the aforementioned Code section. Therefore, I am pleased to inform
you that a temporary waiver of tne sidewalk installation requirement is
granted. Should it be determined tnat a sidewalk is required at this location
in the future, it will be installed by the assessment process.

REASON FOR REQUEST The project is located in an industrial area (Clearwater Industrial Park)
and all existing developments adjacent to the North and South plus all other developments
in the Industrial Park presently do not have sidewalks.
Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

I have reviewed the request for waiver at the above location and found that there
is a drainage ditch located along Belcher Road in front of the property which would
make the sidewalk installation unreasonably difficult. Since the inability to
construct a sidewalk due to the nature of the terrain is a condition for granting
a waiver, it is my recorrmendationthat a waiver be granted.
