Therefore, I am pleased to inform you that a temporary waiver of tne sidewalk installation requirement is granted. Section 133.09 of the Code of Ordinances of the City requires that all land that abuts a public right-of-way, which is to have new construction on it, either for residential, commercial, industrial or other purposes, shall have sidewalks constructed by the Owner on, across or adjacent thereto. Since the inability to construct a sidewalk due to the nature of the terrain is a condition for granting a waiver, it is my recorrmendationthat a waiver be granted. ~
