Re: Application for zoning to permit restaurant to sell
all alcoholic beverages - Joseph "Pepe" Rodriguez
Ladies and Gentlemen:
On February 5, 1976, the Commission voted to recommend
approval of alcoholic-beverage-zoning for the property located
at 2930 Gulf-to-Bay, Clearwater, Florida, with the understanding
that we would take as much action as possible and resolve as many
questions as possible relative to the issues which concerned the
Commission at the initial hearing on this matter.
I am pleased to report that through some superhwnan efforts
on the part of the owners, the architects, the realtor (Mrs. Ruth
Bush), and a number of employees in the various departments of
the City, we have made substantial progress as follows:
1. We have obtained a 53 year long term lease from Albert
Rogero. The lease provides us with sufficient parking for the
proposed restaurant. As of the writing of this letter, the lease
had not yet been prepared, but a copy of the lease will be pro-
vided you no later than the morning of February 19, 1975.
2. We have obtained the approval of Mr. Tracey with regard
to the treatment of the trees on the property. Mr. Tracey en-
dorsed his approval on the enclosed plan on February 18, 1976.
Since his endorsement was somewhat ambiguous, I spoke with Mrs.
Varner of his office and was advised that Mr. Tracey's intent
was to approve the plan since he thought that a disapproval of
it would be an infringement of the owner's property rights.
3. We have also obtained the approval of the City Traffic
Engineering Department with regard to our parking plan, and that
approval was endorsed onto the plan on February 17, 1976.

first reading of the amendment to the ordinance to permit sale
of alcoholic beverages on this property. By the second reading,
which is scheduled for March 4, 1976, we are confident that we
will have cleared all hurdles, all city departments will have
approved the project, and you will be in a position confidently
to approve the amendment on its final reading.
