8124-10ORDINANCE NO. 8124-10 AN ORDINANCE OF THE CITY OF CLE4RWATER, FLORIDA, ANNEXING CERTAIN REAL PROPERTY LOCATED ON THE WEST SIDE OF MCMULLEN BOOTH ROAD AND THE EAST SIDE OF LANDMARK DRIVE APPROXIMATELY 1,460 FEET NORTH OF UNION STREET AND 460 FEET SOUTH OF RENAISSANCE DRIVE, CONSISTING OF A PORTION OF SECTION 33, TOWNSHIP 28 SOUTH, RANGE 16 EAST, WHOSE POST OFFICE ADDRESSES ARE 3001, 3002, 3008, 3013, 3016, 3021, 3024, 3029, 3032, 3037, 3040, 3045, 3056, 3057, 3069, 3081 AND 3093 CREST DRIVE, INTO THE CORPORATE LIMITS OF THE CITY, AND REDEFINING THE BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITION; PROVIDING AN EFFECTIVE DATE. $o2:9 X RmZzm y 0 7?r. o n In .T z r o ? °T oo ?Na0 n WHEREAS, the owner of the real property described herein and depicted on the map ' - - attached hereto as Exhibit A has petitioned the City of Clearwater to annex the property into the City pursuant to Section 171.044, Florida Statutes, and the City has complied with all applicable requirements of Florida law in connection with this ordinance; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following-described property is hereby annexed into the City of Clearwater and the boundary lines of the City `are redefined accordingly: See attached legal description (ATA2009-04002) Section 2. The provisions of this.ordinance are found and determined to be consistent with the City of Clearwater Comprehensive Plan. The City Council hereby accepts the dedication of all easements, parks, rights-of-way and other dedications to the public, which have heretofore been made by plat, deed or user within the annexed property. The City Engineer, the City Clerk and the Planning Director are directed to include and show the property described herein upon the official maps and records of the City. Section 3. Notwithstanding any current or future provision of the City of Clearwater Community Development Code, the property owners shall have the right to engage in the permitted use of "general agricultural activities" which is currently allowed pursuant to Pinellas County Code Section 138-432(1) within the Pinellas County R-R, Residential Rural, Zoning District. Section 4. This ordinance shall take effect immediately upon adoption. The City Clerk shall file certified copies of this ordinance, including the map attached hereto, with the Clerk of the Circuit Court and with the County Administrator of Pinellas County, Florida, within 7 days after adoption, and shall file a certified copy with the Florida Department of State within 30 days after adoption.
