On April 23, 2009, a Comprehensive Sign Program (CSP) application was submitted requesting an additional attached sign on the southeast facade of the retail center. Following a determination that the application was complete on May 17, 2009, staff reviewed the request. CDC Section 3-1806.B.3.a.i and ii provides sign area to be calculated using area of building facade facing the street frontage to which the sign is to be attached or allowing a minimum of 20 square feet per business establishment with a principal exterior entrance. Review by staff determined that the attached sign does not meet the building far~ade facing street frontage criterion or the principle exterior entrance criterion as the sign is proposed to be attached to the south far~ade of the building which lacks street frontage or an exterior entrance. Community Development Board- August 18, 2009 APP2009-00002- Page 1 of 3 CDC Section 3-1807.C.1.a requires the signs proposed in a comprehensive sign program to be designed as a part of the architectural theme of the principal buildings proposed or developed on the parcel proposed for development Review by staff determined that the facade of the building to which the sign is to be attached is predominantly blank with limited architectural elements. The limited design of the facade is appropriate as the facade is secondary and generally screened from view by trees and vegetation. It is determined by staff that addition of signage to this secondary facade is inappropriate as the signage would be out of proportion to the facade and more appropriate to a primary facade designed with typical architectural elements. Furthermore, while it is understood that businesses rely on signage to attract attention, a site visit confirmed that the sign would be visible from north-bound traffic on McMullen Booth only when almost directly adjacent to the sight. Thus, the attached sign is found to conflict with the intended use of signage in that the facade in which to be attached is inappropriate due to its architectural theme and existing sight limiting conditions. CDC Section 3-1087.C.1.b requires that the design, character, location and/or materials of all freestanding and attached signs proposed in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel proposed for development under the minimum signs standards. The proposed sign is to be designed with channel letters mounted on a raceway which is allowed under minimum Code standards. Historically, under Comprehensive Sign Programs, the City has not approved a raceway design unless physically the surface to which the sign to be attached only allowed for a raceway attachment or the sign would be part of a shopping center where raceway design existed as the majority of attachment method. The reason for not approving raceway attachment design is due to this attachment method producing an aesthetically lower-quality design. Attaching channel letters directly to building facade is the preferred method and has been used in the majority of Comprehensive Sign Program approvals. And while raceway design has been used in the subject shopping center, channel letters mounted directly to building facade is also used and produced much higher quality signage. Therefore, the attached sign is not deemed demonstrably more attractive than signs otherwise permitted on the parcel proposed due to the raceway design. On June 5, 2009, the Planning Department issued a development order denying the application, based upon the following findings of fact and conclusion of law: Findings of Fact: 1. That the 20.169 acres is located at the southwest corner of McMullen Booth Road and State Road 590; 2. That the subject properly is currently developed with Retail use approved through FLD2007-11033 on Jan 15, 2008; 3. That the proposed sign is located on a building facade which does not front aright-of--way; 4. That the proposed sign is located on a building facade void of an exterior entrance; 5. That the proposed sign is not integrated into the architectural theme of the building to which to be attached; 6. That the proposed sign is not proportional to the space to which it is attached; and 7. That the attached sign is not demonstrably more attractive than signs otherwise permitted under the Community Development Code (CDC) minimum design standards due to its channel letter on raceway design. Conclusions of Law: 1. That the Comprehensive Sign Program application is not consistent with the Comprehensive Sign Program review principles as per Section 3-1806.B.3.a.i, 3-1806.B.3.a.ii, 3-1807.C.1.a and Section 3- 1807. l .b of the CDC. Community Development Board- August 18~ 2009 APP2009-00002- Page 2 of 3 An appeal from the above Level One (Comprehensive Sign Program) decision was filed on behalf of the property owner by Todd Pressman on June 10, 2009, consistent with the timeframe established for an appeal to be initiated in CDC Section 4-502.A. Pursuant to CDC Section 4-SOl.A.3, the Community Development Board (CDB) has the authority to hear appeals from Level One (Comprehensive Sign Program) decisions. Pursuant to CDC Section 4-504.A, the CDB shall review the application, the recommendation of the Community Development Coordinator, conduct a quasi judicial public hearing on the application, and render a decision in accordance with the provisions of CDC Section 4-206.D.5 granting the appeal, granting the appeal subject to specified conditions, or denying the appeal. It is noted that pursuant to CDC Section 4-504.B, in order to grant an appeal, overturning or modifying the decision appealed from, the CDB shall find that based on substantial competent evidence presented by the applicant or other party that each and every one of the following criteria are met: 1. The decision appealed from misconstrued or incorrectly interpreted the provisions of this development code; and 2. The decision of the CDB will be in harmony with the general intent and purpose of this development code; and 3. The decision of the CDB will not be detrimental to the public health, safety and general welfare. As part of the program, a!! sign types shall be reviewed for the business and/or the development parcel to achieve compliance in so far as possible with these current regulations. A master sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within the development parcel. These will be reviewed as a Comprehensive Sign Program application.
