In accordance with Section 138.09 of the Code of Ordinances of the
City of Clearwater, I have reviewed your request for a temporary
sidewalk installation waiver.
The above-referenced property does not meet the requirements as set
forth in the aforementioned Code, paragraph (e), because an
existing sidewalk is located within 200 feet of the property.
Therefore, I cannot grant a temporary waiver of the sidewalk
installation requirement on the above-referenced property and your
request is denied.

Section~8.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

This property is 10cated on the southwest corner of S.R. 590 and Owen Drive. We have
reviewed' the reqllest--foradsidewalk--waiver and found that there is an- existing sidewalk
along the S.R. 590 frontage.
It has been our policy to not grant sidewalk waivers where a new sidewalk installation
butts up to an existing sidewalk. It i~therefore, my recommendation that a sidewalk
waiver riot be granted.
