Gentlemen:
On May 13, 1988, I sent a letter to you by certified mail in response to your
request for temporary sidewalk installation waivers for the above-referenced
properties. The denial of your request was based on my understanding that the
sidewalks along Old Coachman Road could be installed on the roadside of the
existing drainage ditch even though such installation would be at variance with
the City standard of one foot off the property line.
Such installation on a County road requires approval from Pinellas County Public
Works Department. You recently made a statement to City Traffic Engineer Keith
Crawford regarding the County policy of prohibiting sidewalks in the roadside
recovery area. We have discovered with the speed limit on Coachman Road the
roadside recovery area is a 14-foot setback from the edge of pavement.
Since the sidewalks cannot physically be built where they can be permitted and
cannot be permitted where they can be built, it is my duty to inform you that
your request for temporary sidewalk installation waivers on the above-referenced
properties has been approved. Should it be determined that sidewalks are
required at this location in the future and can be safely constructed, they will
be installed by the assessment process.
Please accept my apology for any inconvenience which may have been caused by my
previous letter of May 13.

The above-referenced requests were denied by the City of Clearwater in accordance
with the appropriate sections of the applicable ordinance. Keith Crawford met
with the owner of the property and showed him where the sidewalks could be
installed in lieu of the City standard of one foot off the property line or the
County standard of two feet off the property line. At this point we thought
everything would be running smoothly and the sidewalks would be installed soon.
However, the sidewalks in questions go on a County right-of-way (Coachman Road)
and a permit must be received from the County Public Works Department. When
Keith discussed this matter with Del Fernandez of that department, he was told
that Pinellas County does not permit sidewalks to be constructed in the "roadside
recovery area." The recovery area for the speed limit on Coachman Road requires
a 14-foot setback from the edge of the pavement. Accordingly, the County's
restrictions make it physically impossible to build these sidewalks and I have
attached a letter for your signature to the applicant granting the requested
waiver. Also attached is a drawing showing two of the three requested waiver
sites. This drawing is not to scale but gives you a good idea of the difficulty
in this location.
