CITY OF CLEARWATER, FLORIDA, 'a munic,ipa.l corporation; , hereinafter for convenience called'' the Donee, WITNESSETH: • THAT WHEREAS, the ,sa.i'd,Donor is the owner of a: collection .of` dolls and puppets comprising a total of „#". 'Items; collected; from various countries of the world; and. being. =of the ap:proxi_mate value. of s,300.00,, a detailed list of succi dolls and puppets being hereto. • attached, marked "Exhibit A, " and made -aa . part .;here.of•; AND WHEREAS, the said Donee- has prepared a.'. room in:. the civic building in, Clearwater, ' Florida, known as the Clearwater Public Library,. and has furnished su en room .with Niall .cases and display cases' enclosed with substantial woodwork; and glass for the display.of"'.'the; said -collectiai,, of dolls and- for their preservatioi and for their. exhibition' to the public as in a museum,. ,without .d'anger" of damage to' said collection or any of the Items thereof through improper handling or pilfering; NOW THEREFORE, IT IS AGREED BY . AND BETWEEN THE PARTIES' "HERETO, AS FOLLOWS: (1) . That . the said Donor., in= consideration, of the premises, and of the ,mutual covenants. and agreement"s .the-rein.-"set...forth; has 6on- veyed and given ,•to- .the Donee all the said collection of dolls or puppets as per. the catalogue; •or .orlist hereto ,attached, , . harked' "Exhibit A,'H and made. a part hereof;; (2) said collection and. keep,, them and all -of them .en:cl.osed :in locked .cases. The Donee shall' *ell and truly ,care for anal preserve the so that they shall not be provided, or may be availab efor' the; view of the visiting public, removed from suchcases but except by. the .Donor as hereinafter any necessary care,- attention.or re-arrangement,as may be proper on 'the part of, the, head Libreri an of. the " said Clearwater' Public Library,. o .,by "trusted and competent salaried assistants of such Librarian. (3) The ,Donor:, for, herself. and for her. daughter, Edith, Putnam, also of 307 North Osceola:Avenue; Clearwater; . Florida, ' specifically . reserves the right at ,proper times and. in .a ..proper. manner. and for limited periods to remove all' or ::any-.port"ion of said collection for the`purpo'se of.. display at churches, halls; or other public" places, and for the . giving' of lectures on the-,subj.ect of.said'collection, but such renoval:for such pur- pose shall 'be 'quietly and corripetently done at. a time when' the r'eguaar functions of the Glearwater. Public Library- and" the'`duties of its staff shall not be immoderately or 'unneces'sarily interfered, with,.. and. any .items. so taken by the Donor or her daughter ;s.hali ,be.., for limited periods only,.; and the .items . or articles so removed shall be replaced in competent, prudent and crafts manlike manner. (4) In the event the. Donee shall be:. unable or 'shall fail or ,refuse to, continue to carefor' the: said collection .:and to maintain .it sub's.tanti ally es itis at the present., time established. and -maintained iri a manner. suit ' able for proper exhibition to the public, or to. keep the room' -and the dis- play or exhibit casesin proper condition and repair for the.. preservation and continued 'exhibition; of said ,collection; 'the Donor shall heve.•the-right and 'Hereby reserves the right -to -revoke• ,her said gift and. to repossess and ' remove and.r•e-gain full title. and ownership: to the said collection and each and every .part .thereof (5) Upon the death o.f the ''s id Donor; her- right s ' in and to, the. said collection and. the preservation• thereof'.are recognized by.the parties hereto as passing t_o the. said daughter 0f. the Donor, Miss -Edith :_'Putnam, subject nevertheless to.'the.c'ovenants and agreements -herein set forth,. .providing only .that the said daughter `shall: 'survive the Donor, ° -Upon, the death of both the Donor and her : daughter,;;.: this agreement.,on the ' pert. of the Donor is rude an absolute bill of sale, and ,all .right, title and interest whatsoever in and to the said collection shall forthwith .pass to the said Donee, ,free and clear of . any and „all restrictions. -(6) In the. event the' Donee- shall find, i.t:impossible .or ,inconvenient to care for the said collection in a proper manner, or shall for any other reason desire to terminate .this., agreement during the lifetime of the Donor or her daughter, the Donee shall thereupon notify the Donor or her daughter to that effect. The Donor shall be given ample time and opportunity to arrange other facilities, for the care of'said col- lection, and when such arrangements'have been completed the,Donor or her daughter shall thereupon remove the collection from, the custody of the Donee and this agreement shall then'terminate. (7) .The Donee agrees that the said collection will be kept in its present location in the Clearwater Public Library, or in some other location satisfactory to the Donor. IN WITNESS WHEREOF, the said Donor has subscribed her name and set her seal, and the said Donee has caused its official, seal to be placed hereon, attested by the signatures of its officers thereunto duly authorized, all on the day and year first above written.
