The subject property is comprised of two properties located at the intersection of US 19 and Belleair Road. The two parcels are commonly referred to as the Commonwealth Shopping Center (16.3 acres) and the Harbourside Office Building (7.5 acres of upland and 1.6 acres of tidal/conservation).The character of the surrounding land uses can best be described as follows: The subject property is hounded on the east by the Grand Venezia and the Grand Bellagio, 336 unit and 311 unit luxury condominium developments, respectively. The applicant is the owner of the Grand Venezia community which was converted from apartments to a condominium ownership community. To the north is the Bay Aristocrat Village Mobile Home Park. located along the eastern three-quarters of the north property line. The remaining quarter of the north property is utilized as a Steak-n-Shake restaurant which fronts on US 19. The adjacent properties are connected to the subject property via a frontage access road located at the rear of the restaurant property. A large stonnwater drainage ditch parallels the north property and is a physical barrier separating the subject property from the adjacent restaurant and mobile home park. The 150 foot wide US 19right-of--way is the western border of the subject property. The land. uses across US 19 consist of mixed/strip commercial made up of a citrus/vegetable roadside shop and miscellaneous small commercial shops. The Florida Department of Transportation is scheduled to begin. the conversion and construction of US 19 from an arterial to an expressway with a planned overpass at Belleair Road in 2009. This overpass will be in excess of 36 feet in height at the Belleair Road intersection, thus creating a visual barrier between the western land uses and the subject property. The overpass will significantly reduce the visibility of, and access to, the proposed uses. The southern boundary of the subject property is parallel to Allen Creek which has jurisdictional mangrove vegetation running the entire length. Cove Cay, a large master planned waterfront golf course community in Pinellas County developed in the 1970's, is 1 of 12 ORIGINAL RECENED ~Ee 2 s zoos PLANNING DEPARTMENT located on the southern side of Allen Creek. The proposed development strengthens and is visually harmonious with the already attractive existing ltalianate theme of the Grand Bellagio and Grand Venezia waterside condominium properties. The scale and bulk of the proposed structures are in keeping with the mid rise and high rise structures of the Grand Bellagio, Grand Venezia, Harbourside Office Building and Cove Cay Community. The applicant is requesting to increase the bulk and density in order to offset the negative impact of the US 19 overpass and expressway. This request will create an economically successful project that can support the unique amenities and boutique retail commercial uses associated with a highly themed destination waterside resort hotel. 2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. The proposed uses are allowed within a "C" Commercial District of the Community Development Code and are consistent with the Future Land Use Map. With the approval of the requested deviations, the character and intensity of the proposed development will be in compliance with the zoning classification and compatible with the surrounding land uses. Additionally, the significant investment required to create a uniquely themed destination resort hotel and spa will increase the value of the subject property as well as the surrounding lands. 3. The proposed development will not adversely affect the health or safety of persons residiang or wor(~ing in the neighborhood of the proposed use. The proposed hotel and support commercial uses will require a higher level of site security than what is presently provided by the existing shopping center, thereby increasing the overall safety within the neighborhood. The new development will provide a storrnwater management system. that will greatly enhance the quality of the stormwater leaving the subject property well beyond its present condition and. improve the health of the environmental water adjacent to the property. The ability of the neighborhood to access the proposed development and partake in the amenities and experiences associated with a destination hotel/spa mixed-use commercial facility of this nature will provide opportunities that do not exist now and, therefore, will enhance the well being of the neighborhood. 4. The proposed development is designed to minimize traffic congestion. As indicated in the attached Traffic Impact Study, the proposed development will not have any significant or negative impact. to the adjacent road network or intersections. Since the proposed project generates fewer trips than the existing site, the project meets all concurrency requirements. Given that there is a construction project to convert US 19 from an arterial to an expressway adjacent to the project, scheduled to begin in FY 2009, the applicant is of the opinion that because the State law allows projects scheduled for construction within 3 years to be included as committed roadway improvements, a detailed traffic study requesting the analysis of specific intersections adjacent to and near the project for potential operational improvements should not be required. Because this project falls within that 3-year window for the US 19 project, additional capacity would be available and there would be little need for an operations study to be conducted. 5. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The property is contiguous to the Grand Venezia and Grand Bellagio condominiums representing 6471uxury units. These developments are highly themed Italianate in character and their previous approval by the City of Clearwater did much to establish a new character for the neighborhood community. The proposed development goes beyond the architectural character of those projects, but still. maintains the overall character already established. 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties. Traffic Study Impact Study: (Section 4-202.A.13 and 4-801.C) Prior to conducting an analysis of the potential traffic impacts generated by the proposed development, PBS&J met with City of Clearwater staff. During the meeting it was determined that the adjacent roadway (US 19} is currently over capacity and development along the roadway is being restricted. The City staff also noted that the potential trips generated by the existing uses on the site could be used to offset any new impacts. State and local concurrency rules allow redevelopments to generate up to 110% of the existing site's trips without being held responsible for any impacts. As depicted on Table 1, it is expected that the existing uses on the site could generate up to 12,172 daily trips and 1,254 PM peak hour trips. Perhaps in no other architectural style are the landscape elements as singularly idiomatic and unique. Our primary goals were: • To preserve the existing application • To put the application in a holding pattern until a decision is reached on the development strategy Gass Prol Development Program, Etc.) • To demonstrate progress to purchasers by beginning construction on the park area located on the L strip site using minimal dollars If the city holds to their position in the meeting on Tuesday, we can accomplish all three of the above. GENERAL • The city needs a letter describing the reasons far the delay and Cay Club's plans for the project. (See draft with next email) • We are fortunate to have Wayne Wells as the assigned planner. I don't know if the city has as a general policy of welcoming development but the reception and general attitude were certainly the best I have experienced in a long time. Mr. Wells seems motivated to help us, expressed willingness to find alternative ways to accomplish approvals (he even offered suggestions on solving setback problems), and seems eager to help us have this project approved. This is a radical departure from the norm. • Per Wells ..."the city approves 9fi% of the applications when staff recommends the project and there are no objections from vested stakeholders." He went on to say that if someone objects and doesn't have standing THE CITY WOULD NOT CONSIDER THLIR OBJECTION. This is excellent news in that it keeps the usual loonies who show up at every meeting to protest (which every jurisdiction has) from creating delays and problems. • For the purpose of approvals, Clearwater codes treat any man made improvement as a structure. This means the setbacks apply to things like pavement, walls, etc. • Once an application is approved, the application for a building permit must be within one year. i • Wells suggested that Cay Clubs engage the neighbors and stakeholders and try to diffuse any opposition. • The city has no interest in docks. Pinellas County has jurisdiction. • Cove Cay golf community and Cove Cay marina are in the county and the city has no interest in what happens in these areas. • The approval process is an intense process; we will have the same planner in charge from beginning to end; and..."nothing gets distributed until we finish with staff." • Per Welds, we.. "can totally avoid a public hearing" if we utilize the process outlined by him. This process would entail an ongoing dialog to address all aspects of the development and gain the approval of the COMMUNITY DEVELOPMENT BOARD {CDB).Their decision .is final and nothing goes to the City Council if they approve. • The fire dept. will have to sign off. •~ Parking has been tight in all versions of the master plan. We can get a relaxation of the parking requirements by preparing a PARKING DEMAND STUDY. This would allow us to demonstrate that all existing units and proposed units {or a substantial number of them) are already on site and would not need to be parked again. This is especially helpful on the parking requirements for commercial footage and is a simple document. • An interesting note: the city's issue with the length of stay was precipitated by an existing homeowner who sent a letter to the city requesting an exemption to the length of stay requirements. Also Wells was aware of a web link that seemed to indicate overnight stays were being booked. On the former issue the city sent a standard form response advising the homeowner of the necessary procedure. On the latter issue Jay Dempsey did a good job of explaining that once someone attempted to book far less that 30 days they would be advised of the 30 day minimum requirement. NOTE: Obviously the financial dynamics of the project would be greatly enhanced if short stays were possible. Wells didn't "know who would make that call"... but it is my feeling that he might become an ally if an effort was commenced to have this requirement waived. • King engineering generated no bad "vibes" with the city. • The construction of the park could be accomplished as part of this process. It would be, per Wells, an "interim phase" and included as part of this application. I was surprised that this was passible and even called Wells back immediately after the meeting to confirm. This gives us the ability to delay almost endlessly. (See Strategy belowj. Of greater importance to us is this allows a series of phased applications. • STRATEGY • Immediately send a letter explaining the delay and assuring Wells that we intend to proceed with all due diligence on the applications. (Draft being sent to you today) • Follow up with an application to include the park as our first phase. This does two things: First it gives us the necessary time to determine the development strategy. Second it allows a benign application (the park} to establish a working relationship with Wells and the city. We should start preparation of the park submission immediately and begin a dialog with Wells as we are preparing this application. During this time, we should be able to take the city's pulse on the larger issues of height and density. • Engage King Engineering for a limited fee to assist us with the application... especially to make sure the infrastructure (existing and future) is not compromised... Note: To save money, I did not hire King to attend this meeting and will get a quote for them to work only on the park site. ACTION ITEMS (Responsible Party) • MRAPA will prepare the first letter and distribute to Cay Clubs for approval prior to sending to the city. • Among the items we know are going to be required are those contained in the letter from Wells in response to our Dec. 2005 application.
