On February 2, 2006, the Development Review Committee reviewed your request for Flexible Standazd Development to construct a retail sales and service strip center in the Commercial (C) District and includes an increase to building height from 25 feet to 32.5 feet for architectural embellishments and where the main roof deck is at 18.33 feet, a reduction to front {west) setback from 25 feet to 15 feet {to pavement}, a reduction to the side (north) setback from 10 feet to 8.67 feet (to building), a reduction to the side (north) setback from 10 to 6.5 feet {to pavement), and a reduction to front (south) setback from 25 feet to 15 feet (to pavement), pursuant to Section 2-703.R. The Development Review Committee (DRC) APPROVED the application with the following bases and conditions: Bases for Approval: 1. The proposal complies with Flexible Standard criteria as a Retail Sales anal Service Use, per Section 2-703.R. 2. The proposal is in compliance with other standards in the Cade, including the General Applicability Criteria per Section 3-913. 3. The proposal is compatible with the surrounding area and will enhance redevelopment efforts. Conditions of Approval 1. The final design and color of the building be consistent with the conceptual elevations submitted to, or as modified by, the DRC; 2. The final design of the site plans be consistent with the conceptual site plans submitted to, or as modified by, the DRC; 3. Restaurant uses shall not exceed more than 25 percent of the gross floor area of the entire building. All proposed utilities (from the right-of--way to the proposed buildings) be placed underground, including outdoor lighting lines; 12. Removal of Underground Storage Tanks (UST's) must be done in accordance with FDEP and Pinellas County ^ales and regulations. Proviso letter must be obtained from Pinellas County and submitted with plans prior to the issuance of any site or building permits; 13. Prior to the issuance of any building permits, a tree preservation plan that .has been prepared by a. certif ed arborist, consulting arborist, landscape architect or -other specialist in the field of arboriculture is provided. This plan must show how the proposed building, parking, stormwater and utilities impact the critical root zones (drip lines) of trees to be preserved, and how these impacts (i.e. crown elevating, .building lintels, root pruning and/or root aeration systems) are proposed to be addressed. Other data required on this plan must show the trees canopy line, actual tree barricade limits (2/3 of the drip line and/or in the root prune lines if .required}, the tree barricade detail and any other pertinent information the arborist feels relates to tree preservation; 15. The final design of the landscaping be consistent with the conceptual landscape plans submitted to, or as modified by, the DRC; 16. All Fire Department requirements be met prior to the issuance of any permits; and 17. All signage meet the requirements of Gode and be architecturally-integrated with the design of the building and site with regard to proportion, color, material and finish as, approved by Staff prior to th_ e issuance of any sign permits. , - _.. - - . - _ -_ I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the above conditions. ~ The approval is based on and must adhere to application dated received December 28, 2005, and the revised site plans and building elevations dated received July 7, 2006. The location of this property is at the NE corner of Coachman Road and Highway ~ 19. The present use is a gas station "C" store. The adjacent property uses are a combination of retail and office. The south side of Coachman is another gas station "C" store- The property on the other side of US 19 (now being separated by the elevated highway under construction) is Jiffy Lube, ~Ialmart, and Wendy's. With IHOP and a hotel. being located diagonally to the SW on the other side of US 19. , The orientation of our building will toward US 19 and Coachman Road as will be the ` parking and the dumpster collection. This orientation will act as a bui~er to tl-e adjacent properties: Tlie redesign of this site creates less interaction with vehicles and the neighbors than the existing station plan. The building it self is designed to appear as multiple stores vs. a single box. This will. be more pleasing than the adjacent buildings that exist, which vary in size and height from 1 story #0 2 .stories. The decrease in access from Coachman Road as well as US HGWY 19 plus the increased landscaping will enhance the corner will decreasing the impervious area ofthe site. The hours of operation should not be a factor to the neighbors due to their similar nature of business and the fact that the existing business is a gas station and we are facing a six lane road. Please-look at the attached photos of the immediate neighbors, I think you will i end thin area to be very diverse in the types ofbusinesses and the types of buildings that exist. Based on the proposed redevelopment plan and the impact the new structure will. have on the existing trees my recommendation is removal. {3} of {5} Oaks on the East Curb, {2} Elms South and {2} Elms North. {2) Oaks Southeast to remain and be barricaded during construction.- ~r See attached photos by number 1. New building to be in place of fence leaving unbalanced root system with canopy less than 10' from new building As attached photos show the location of the new~building does not provide enough space for tree barricades out to the drip line. Existing roots would be,eliminated resulting in an unbalanced root system within 10' of the new structure. Existing trees are already to claw to power lines with wires touching limbs and one tree is near a lift station which is to remain in place. The Elm trees have been planted to close together and are in poor condition. Removal of these potential hazards would allow the builder to install new plants in the right place that will better serve the community now and well into the future.
