All applications that irn addition or modification of impervious surface, including buildings, must include a stormwater plan that demonstrates compliance the City of Clearwater Storm Drainage Design Criteria manual. A reduction in impervious surface area does not qualify as an exem to this requirement. ANALYSIS: Site Location and Existing Conditions: This property of 0.75 acres is a corner lot located on the east side of U.S. Highway 19 N at the northeast corner of the intersection of State Road 590. The site has long been developed with an automobile service station and it is still in operation. There are only a few trees present on the site. The site is a stand-alone property. The site has two driveways on US Highway 19 N and two driveways on State Road 590. The site is surrounded by commercial uses, with retail sales & service to the north (Golf Store), east (small retail strip center), and. west (Walmart). Also located to the west are a limited vehicle service (Jiffy Lube) and a restaurant (Wendy's). To the south is another automobile service station (Exxon). Proposal: The proposal includes the complete demolition of all existing site improvements and the construction of a one-story, 6,944 square-foot commercial building for retail sales establishments. The building will include a number of individual tenants, including a 1, 512 square foot, Subway restaurant, and be oriented toward US Highway 19 N. Small-scale dine-in restaurants located within a retail strip center development maybe classified as a retail sales and service use so long they do not exceed 25 percent of the entire center's gross floor area. The proposed building is situated toward the north and east property lines to allow parking on the south and west portions of the site. The proposed building height complies with the Code requirements, but request an increase for architectural embellishments from 25 feet to 32.5 feet. This additional height is only along the fronts of the building and provides a more visually appealing building. The site design closes the existing driveways closest to the intersection of US Highway 19 N and State Road 590 and outer driveways will remain. Parking proposed along the southern and western portions of the site tie into the well-designed parking lot layout. A loading area has been designated on the south side of this site next to the dumpster enclosure. This site has historically has had direct access to US Highway 19 N and appears necessary for proper movement of vehicles and Fire Department trucks. To ensure proper Fire Department access, the site plan will need to show a minimum 28-foot turning radius for emergency vehicle ingress and egress. The applicant exceeds the parking requirement with 37 parking spaces where 35 spaces are required. While not submitted by the applicant, staff research of another site where a Subway restaurant was approved by the Community Development Board (FL O1-12-36, 2004 - 2010. Drew Street, approved March 19, 2002) provides usable parking data for a similarly sized tenant space. The Staff Report for that 2002 case indicated, "Subway will be open Sunday through Thursday 10:00 a.m. to 11:00 p.m. and 10:00 a.m. to 12:00 a.m. on Friday and Saturday. Subway restaurants of this size typically provide approximately 38 in-store seats. This proposal includes outdoor seating. The average customer visit time for dine-in is 20 minutes versus carryout of seven minutes. The average number of customers visiting during lunch (10:00 a.m. to 2:00 p.m.) is 20 per hour. This represents the daily peak demand and represents 45 percent of the business sales. There will be four employees on site at any one time." That Staff Report also indicated "Based on a survey of other Subways, the hours of operation, the average number of customers at certain times of day and the percentage of customers riding together, parking needed for the restaurant is between 2.86 to 4.5 spaces per 1,000 square feet of gross floor area." Therefore, based on the restriction of restaurant not exceeding 25 percent of the entire building, coupled with the parking information provided in this similar case, the proposed parking reduction by three spaces appears justifiable to avoid off-site parking. The proposal includes a reduction to the front (west along US Highway 19 N) setback from 25 feet to 15 feet (to pavement) and a reduction to the front (south along State Road 590) setback from 25 feet to 15 feet (to pavement). The proposal does not match the existing development to the north or to the east due to the unusual placement of the front property lines that protrude out past the adjacent properties in areas sometimes exceeding 15 feet (see aerial). However, the proposal provides front setbacks to pavement along the US Highway 19 N and State Road 590 frontages of 15 feet (which complies with the required landscape buffer width). This 15-foot front setback is a significant improvement over the existing conditions and over that the retail store to the north currently provides. The side (north) setback reduction from 10 feet to 8.67 feet (to building) is justified in placing the building as far away from the two street frontages to allow for acceptable vehicular and pedestrian traffic and interaction. The side (north) setback reduction from 10 feet to 6.5 feet will allow for the reuse of the existing north entrance to US Highway 19. The setback reductions to paving are a function of complying with the Code dimensional standards for parking lots, required pedestrian access from the parking to the tenant spaces in a safe and efficient manner and the ability to provide marketable tenant spaces. The proposed impervious surface ratio is 75 percent, providing considerably greater pervious areas than Code provisions allow. The proposed reductions to setbacks and the flexibility requested significantly improve these existing conditions and will upgrade and enhance the community character and visual appearance of the immediate vicinity along these portions of US Highway 19 N and State Road 590. The proposal is in harmony with, and compatible with, the scale, bulk, coverage and character of adjacent properties of this highly commercialized corridor of US Highway 19 N. Many of the businesses along this corridor of US Highway 19 N are one-story commercial buildings, however, there are some multi-story hotels and residential buildings within the vicinity. The subject 0.75-acre site is zoned Commercial District and is located in a highly commercialized corridor of US Highway 19 N; 2. The current use of the site for an automobile service station; 3. The proposal is to redevelop the site for retail sales and services within aone-story, 6,944 square-foot commercial building with various tenant spaces; 4. The proposal includes the elimination of one of the two driveways on US Highway 19 N; 5. The proposal includes the elimination of one of the two driveways on State Road 590; 6. The proposed reductions to setbacks and the flexibility requested significantly improve these existing conditions and will upgrade and enhance the community character and visual appearance of the immediate vicinity along this portion of US Highway 19 N; 7. The proposal will upgrade and enhance the community character and visual appearance of the immediate vicinity; 8. The proposed development is consistent and compatible in scale, bulk, coverage and character with other commercial properties in the vicinity; and 9. Staff concludes that the proposal complies with the Flexible Development criteria as a Comprehensive Infill Redevelopment Project per Section 2-704.C: 2. Based on the above findings and proposed conditions, Staff recommends approval of this application.
