The then property owner of the entire site, decided to split the property after the construction of the hotel for the purpose of developing an office complex. No changes will be made to this existing site. The existing signage will be maintained. The existing hotel has an overage in density. The hotel consists of 174 units @ 40 units per acre which required 4.35 acres. The current site consists of 6.39 acres. When density is averaged, the allowable building square footage in the adjacent site calculates to 48,874 square feet where only a 46,200 square foot building is proposed. The application is now before you for consideration with the reductions as noted herein. Description of Requests: To retain the existing hotel use with a reduction to the side setback from 25' to 0' for a sidewalk and parking on the newly proposed site. All other setbacks and variances have been previously approved for this site. Written Submittal Requirements The existing hotel site is in harmony with the scale, bulk, coverage, density and character of the adjacent properties as this project lies on a heavily trafficked major corridor (LJ.S. Highway 19). The existing site is developed in an area which is intensely developed with commercial and overnight accommodation uses which maintain similar setbacks. The proposed reduction for the existing hotel will not result in a building, which is out of scale with other existing buildings. 2. The proposed/existing development will not hinder or discourage the appropriate development and use of the adjacent lands and buildings or significantly impair the value thereof. 3. The proposed existing development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use. 4. The proposed/existing development minimizes traffic congestion as all traffic requirements are being met and parking/drive aisle areas will meet code. No adverse effects such as visual, acoustic, olfactory and hours of operation will be generated by this project as the existing use is remaining and has been previously approved. Comprehensive Infill Redevelopment Project Criteria The size of the existing parcel being utilized as is makes the site financially non-viable. By splitting the parcel, as it has been done, creates two viable sites. The existing hotel site housing 174 rooms, requires 174 parking spaces, currently the site accommodates 195 spaces (22 additional). Granting this setback will allow for overflow parking from the proposed site to flow into the existing site. 2. The proposed development will not adversely affect the fair market value of abutting properties. The existing motel uses are permitted uses within the Commercial zoning district. These types of uses are not only permitted within the district but are desirable within the immediate area along this heavily trafficked corridor. 4. The existing uses on site are compatible with surrounding uses, as all surrounding uses are commercial, including but not limited to retail sales and overnight accommodation. The proposed development is consistent with the community character. The existing uses will not be altered. A variance in requested setbacks will not alter the site. 6. The existing design was previously approved by CDB and has already up- graded the immediate vicinity. 7. The design of the proposed project will only help to enhance the community character of the immediate vicinity as the cross-access being proposed will help both sites function practically. 8. The variances being requested herein are justified as all conditions are existing and the setback variances being created will not adversely impact any surround uses. The plan subrruis very vague, submit a revised plan which clearly depicts the existing and proposed landscape materials and their respective locations. Add a legend which defines them. and includes size, height, caliper, quantity, etc. of each. 2 . Per Section 3-1202.E.1 Code requires a minimum of 10% interior green space of gross vehicular use area or 12% of gross vehicular use area if parking spaces area greater than 110% of the required parking. Interior islands shall be designed so that in most cases no more than 10 parking spaces are provided in a row. Interior islands shall be a minimum of 150 sq. ft., and be 8' of green space from back of curb to back of curb. There is no table indicating the % of interior green space, provide this prior to CDB meeting. 3 . Landscape Plan does not show the sight triangles as described in Article 3, Division 9, revise the plan to show these triangles at all the street and driveway intersections. 4 . Plan does not meet the requirements of perimeter plantings in Code Section 3-1202.D. 5 . Per Section 3-1202.B.1. Code requires trees to be 10' in height and 2 1/2" cal. at planting, ornamental trees can be 8' in height and 2" cal., and palms must be 10' clear and straight trunk at planting. Reihl-Gepford, Joseph B. Olivieri, and Erik and Ann Borgen. All owners must sign the Affidavit to Authorize Agent or a power of attorney granting signing authority to one individual or corporation maybe submitted in lieu of all owners signing the Affidavit. Additionally, Anthony Menna signed the Letter of Authorization. It is unknown Mr. Menna's signing authority on behalf of the Michigan corporations (president, managing partner, etc.). Provide documentation as to Mr. Menna's involvement. 2 . Site plan submitted for the adjacent property to the north for the office building indicates landscape buffering to be installed along portions of the northern perimeter of this site, yet this landscape buffering is not indicated on the site plan for this site.
