We are proposing to construction a commercial office building with site improvements. Description of Requests: To construction afour-story office complex over parking, with associated parking and. retention pond area and with reductions to the required front setback from 25' - 19' 10" to pavement, 25' - 15' to building, side setback from 10' - 5' to building (south), 10'-0' to pavement (south), 10'-5' to pavement (north), and rear setback from 20'-5' to pavement. Additionally, a variance is being requested to allow the building height, from grade elevation to the top of roof to be 58' as opposed to the required 50', an increase in height to the maximum allowable parapet height from 30" to 6' and to the maximum allowable tower height from 16' to 1.9'4", along with a reduction in parking from 4 spaces per 1,000 s.f. to 3 spaces per 1,000 s.f. Floors 2, 3 and 4 will exhibit the same layout for stairs and elevators as the ground floor plan. Building permitting will proceed as a "shell" permit initially. Written Submittal Requirements 1. To the contrary, the redevelopment of this parcel of land should boost to the local economy by bringing additional businesses into our area. These reductions are severe and staff cannot support such reductions, especially for a building 58 feet tall to the roof deck. There are no other buildings in the close proximity so close to the property lines as proposed. 11 . The front triangulated parapet 25 feet higher than the roof deck cannot be supported by staff. Reduce in size/scale. 12 . North elevation on Sheet PS2 indicates a wall with windows in it between the driveway openings. In fact, this wall shouldn't be here due to the parking plan submitted, where there are parking spaces within this area that conflict. Revise the elevation. 13 . This application must track together on the same CDB agenda as the existing Hampton Inn application on the parcel to the south. 14 . Based on the submission of the deed recorded in February 1999, and the Code in effect at that time, the split of the property was required to be platted in accordance with Section 46.03(2). Revise. 9 . The required parking ratio for offices in the Commercial District is four spaces per 1,000 square feet. Based on the maximum of 38,420 square feet of floor area possible on this site, 154 parking spaces are required to be provided. The submitted site plan currently shows 132 parking spaces provided, or a deficiency of 22 parking spaces. Based on the required parking for the adjacent hotel and its current submitted site plan showing 204 parking spaces, there is an excess of 30 parking spaces. Potentially, a shared parking agreement between the two adjacent property owners could provide for the required parking for the office building on the hotel site. Alternately, a parking reduction must be requested and a Parking Demand Study submitted justifying the requested reduction. 10 . Setback reductions to the proposed building have been requested: front setback from 25 feet to 15 feet; side setback from 10 feet to five feet; and rear setback from 20 feet to five feet. These reductions are severe and staff cannot support such reductions, especially for a building 58 feet tall to the roof deck. There are no other buildings in the close proximity so close to the property lines as proposed. 11 . The front triangulated parapet 25 feet higher than the roof deck cannot be supported by staff. Reduce in size/scale. 12 . North elevation on Sheet PS2 indicates a wall with windows in it between the driveway openings. In fact, this wall shouldn't be here due to the parking plan submitted, where there are parking spaces within this area that conflict. Revise the elevation. 13 . This application must track together on the same CDB agenda as the existing Hampton Inn application on the parcel to the south. 14 . Based on the submission of the deed recorded in February 1999, and the Code in effect at that time, the split of the property was required to be platted in accordance with Section 46.03(2). Since the property was not subdivided in accordance with Code provisions in February 1999, the requirement still stands as a requirement. Code provisions for setbacks to pavement are now applicable. 15 . Address signage (freestanding and attached).
