All applications that invol addition or modification of impervious surface, including buildings, must include a stormwater plan that demonstrates compliance with 1 City of Clearwater Storm Drainage Design Criteria manual. The Sea Air Resort, a 23- room motel exists and is in operation on the property today. The motel was built in 1952. The property is a .38-acre parcel which would be entitled to 15 rooms (based on 40 rooms/acre) if the motel were being constructed today. The applicant is requesting simultaneous approval of a transfer of development rights (14 units) ("Development Rights") from this site to 715 South Gulfview ("Receiver Site"). Prior to the actual transfer, the existing motel on the site will be demolished so that the Development Rights will not be in use at the time of transfer. Following the transfer of the Development Rights to the Receiver Site, the applicant intends to convey the property, which will have 3 units of density remaining, to the City. Since there are currently no development plans for the property (Sender Site) which will be owned by the City, this application does not include a site plan for the property. The omission of a site plan has been discussed with the planning director. Section D. Written Submittal Requirements General Applicability Criteria: 1) The proposed development of the land will be in harmony with the scale, bulk, coverage, density and character of adjacent properties in which it is located. The 23-room hotel has been in existence at this location since 1952 and is in harmony with the surrounding properties. As described above, it is the applicant's intention to transfer density from the site and convey the property to the City. Given these circumstances, this request will actually result in demolition of the existing motel and reduction in the intensity of the use of 41 Devon Drive. 2) The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. The proposed termination of non-conforming status and demolition of the motel will not impair the land and buildings adjacent to the motel. The existing motel which is over 50 years old is functionally obsolete and is not consistent with current development standards. • • 3) The proposed development will not adversely affect the health or safety of persons residing or working in the neighborhood of the proposed use. The termination of non-conforming status will not adversely affect the health or safety of persons residing or working in the neighborhood of the proposed use. 4) The proposed development is designed to minimize traffic congestion. The applicant is not seeking any additional density or intensity to what is currently in existence on the site, so this will not create an impact on traffic. 5) The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The proposed transfers of density are contemplated by Beach by Design as a means of revitalizing and redeveloping Clearwater Beach. 6) The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts on adjacent properties. The eventual demolition of the motel on the property will minimize any impacts to surrounding parcels. Section 6-109 of the Code requires a level two approval to terminate status as a non-conforming use or structure with the following requirements: 1. Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be installed. 2. Off-street parking lots shall be improved to meet the landscaping standards established in Section 3-1202(D). 3. Any nonconforming sign, outdoor lighting or other accessory structure or accessory use located on the lot shall be terminated, removed or brought into conformity with this development code. The comprehensive landscaping and comprehensive sign programs may be used to satisfy the requirements of this section. Due to the proposed demolition of the motel and transfer of density offsite, these requirements do not apply to the proposed project.
