All applications that im addition or modification of impervious surface, including buildings, must include a stormwater plan that demonstrates compliance the City of Clearwater Storm Drainage Design Criteria manual. This is only four working days before the hearing on this subject. Fortunately I was in Minnesota and not Florida or somewhere else to receive it, and able to an~ange the time on short notice to respond to it. Otherwise I would have missed the hearing altogether. That would not have been good for either of us as you will see below_ I immediately called you this morning, and have not received a response so I have crafted this response without being able to discuss the matter with you. Forgive me if there are errors for that reason. I believe that this matter applies to the property immediately adjacent to mine, to the right as one faces the water, although I am not certain as the property is on another street. This property was, I believe, owned by Eric Julian, and subsequently sold to Carmen and Michelle Rowland or their company which is known as something like R & R construction. I object strenuously to his application for the following reasons: 1. When Mr. Rowland purchased the non-waterfront property between Julian's property and mine, he removed the seven foot high, beautiful natural hedge located on my property that provided privacy for both of us to create a view from his rear yard to the inland waterway. T complained to the authorities about the matter. He was in cleaz violation of my rights, but instead of taking action himself to restore my loss, he has shown significant hostility towazd me since. 2. I cooperated with either Mr. Julian and I suppose unknowing with Mr. Rowland by agreeing to a variance that enabled them to install a dock on what I believe is 107 Leeward. They purposefully installed an unnecessary tie pole right in front of my boat slip that is on their side of my dock. That tie pole constitutes a "navigational hazard" for entering my slip. In conversations with William Morris, Hazborrnaster, and reviewing with Section 3-601 of Division 6 of the City codes Community development standards, a tie pole that causes a navigational hazard is clearly disallowed by paragraphs C.1.b and C.8.i.ii. Mr. Roland has laughed at me when I have asked him to remove the tie pole so that I can have clear access to my slip, even though it is completely unnecessary for the use of his new docl~ Mr. Moms has pictures if you wish to see them. 3. Somehow Mr. Rowland arranged with Mr. Julian to split Julian's akeady-narrow waterfront into two tots so that Mr. Rowland could have a view of and access to the waterway. It would be interesting to know whether this was legally done or not. 4. This new application that you are reviewing seems to me to be highly excessive. Reducing a waterfront setback to only ten feet from two and a half times that much (i.e. 25 feet), on the surface does not seem reasonable. A few inches, perhaps, but this seems like a lot. Also elevating the pool to three times it's present level above grade seems unusual, and perhaps even a bad idea with regard to runoff during a significant storm. This is only four working days before the hearing on this subject. Fortunately I was in Minnesota and not Florida or somewhere else to receive it, and able to arrange the time on short notice to respond to it. Otherwise I would have missed the hearing altogether. That would not have been good for either of us as you will see below. I immediately called you this morning, and have not received a response so I have crafted this response without being able to discuss the matter with you. Forgive me if there are errors for that reason. I believe that this matter applies tv the property immediately adjacent to mine, to the right as one faces the water, although I am not certain as the property is on another street. This property was, I believe, owned by Eric Julian, and subsequently sold to Carmen and Michelle Rowland or their company which is known as something like R & R construction. I object strenuously to his application for the following reasons: 1. When Mr. Rowland purchased the non-waterfront property between Julian's property and mine, he removed the seven foot high, beautiful natural hedge located on my property that provided privacy for both of us to create a view from his reaz yazd to the inland waterway. I complained to the authorities about the matter. He was in clear violation of my rights, but instead of taking action himself to restore my lass, he has shown significant hostility towazd me since. 2. I cooperated with either Mr. Julian and I suppose unknowing with Mr. Rowland by agreeing to a variance that enabled them to install a dock on what I believe is 107 Leeward. They purposefully installed an unnecessary tie pole right in front of my boat slip that is on their side of my dock. That rie pole constitutes a `navigational hazard" far entering my slip. In conversations with William Morris, Harbormaster, and reviewing with Section 3-601 of Division 6 of the City codes Community development standards, a tie pole that causes a navigational hazard is clearly disallowed by paragraphs C.1.b and C.8.i.ii. Mr. Roland has laughed at me when I have asked him to remove the tie pole so that I can have clear access to my slip, even though it is completely unnecessary for the use of his new dock. Mr. Morris has pictures if you wish to see them. 3. Somehow Mr. Rowland arranged with Mr. Julian to split Julian's already-narrow waterfront into two lots so that Mr. Rowland could have a view of and access to the waterway. It would be interesting to know whether this was legally done or not. 4. This new application that you are reviewing seems to me to be highly excessive. Also elevating the pool to three times it's present level above grade seems unusual, and perhaps even a bad idea with regard to runoff during a significant storm. Residential infill. a. The development or redevelopment of the parcel proposed for develop- ment is consistent with the Island Estates Neighborhood Plan; b. Single-family detached dwellings and community residential homes with six or fewer residents are the only permitted uses eligible for residen- tial infill project application; c. The development or redevelopment of the parcel proposed for develop- ment is otherwise impractical with- out deviations from one or more of the following: intensity; other devel- opment standards; d. The uses within the residential infill project are compatible with adjacent land uses; f. The development of the parcel pro- posed for development as a residen- tial infill project will upgrade the immediate vicinity of the parcel pro- posed for development; g. The design of the proposed residen- tial infill project creates a form and function which enhances the commu- nity character of the immediate vi- cinity of the parcel proposed for de- velopment and the City of Clearwater as a whole; and h. Flexibility in regard to lot width, required setbacks, height, off-street parking, access or other develop- ment standards is justified by the benefits to community character and the immediate vicinity of the parcel proposed for development and the City of Clearwater as a whole. Utility/infrastructure facilities. a. The development or redevelopment of the parcel proposed for develop- ment is consistent with the Island Estates Neighborhood Plan; b. The siting and screening of the pro- posed utility/infrastructure facility protects the established character of the Island Estates neighborhood; c. No above ground structures are lo- cated adjacent to a street right-of- way; and d.
