Respectfully, Mary & Reinaldo Valor 1 DRC Meeting Date: June 2, 2005 Case Number: FLS2005-04028 CITY OF CLEARWATER PLANNING DEPARTMENT STAFF REPORT BACKGROUND INFORMATION: APPLICANT: Mr. Eugene Leonard ~ ~ ~ ~ ~ O LOCATION: 904 Edenville Avenue REQUEST: Flexible Standard Development to reduce the side (north) setback from 5 feet to three foot for an accessory shed, as a Flexible Standard Development project, under the provisions of Section 3- 201.B.5. PLANS REVIEWED: Site plan submitted by Mr. Eugene Leonard SITE INFORMATION: PROPERTY SIZE: 0.133 acres; 5,802.5 square feet DIMENSIONS OF SITE: 52.75 feet of width by 110 feet of depth PROPERTY USE: Current Use: Proposed Use: PLAN CATEGORY: ZONING DISTRICT: Single-family dwelling Single-family dwelling with shed RU, Residential Low Classification LMDR, Low Density Residential District ADJACENT LAND USES: North: Single-family residential West: Single-family residential East: Single-family residential South: Single-family residential CHARACTER OF THE IMMEDIATE VICINITY: Single-family dwellings dominate the immediate vicinity. Staff Report -Development Review Committee -June 2, 2005 -Case FLS2005-04028 ~ ~ ANALYSIS: The 0.133 acres located on the west side of Edenville Avenue, approximately 350 feet south of Druid Road. It is located within a residentially developed area. The site contains an existing 990 square foot, single-story, single-family dwelling without an accessory storage shed. The shed is to be painted with matching colors of the primary residence. The proposal includes an accessory storage shed in association with an existing single-family dwelling. Surrounding properties have been developed with similar sized accessory storage sheds that do not meet the side setback requirements. Other accessory structures, such as sheds and decks on neighboring properties appear to have been placed at less than the required five-foot setback. After review of building permit histories for these properties it is uncertain how many of these accessory structures were legally permitted and constructed. The proposal does meet all Code requirements and applicable criteria. CODE ENFORCEMENT ANALYSIS: There are outstanding enforcement issues associated with this site for the accessory storage shed (SW02005-04001). A. There are many accessory structures placed at one foot or less in relation to side setbacks in this neighborhood and this shed will enhance the community character of the immediate vicinity at a three-foot side setback. D. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the Community Development Coordinator and the Community Development Board pursuant to a Level One or a Level Two Approval shall ensure that: 1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density, and character of adjacent properties in which it is located. The proposed development does aesthetically improve the immediate area and Clearwater as a whole by conforming to existing neighboring homes with sheds. The reduction in the side (north) setback is similar to other properties in the area. 2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. The site is zoned Low Medium Density Residential District and characterized by single- family dwellings. The character and intensity of the proposed development will be in compliance with that zoning classification. The development complies with density and impervious surface ratio standards within the District. The proposed setback is characteristic to surrounding properties in the neighborhood and should not impair the value of adjacent lands. 3. The proposed development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use. The proposed accessory use should not create any adverse health or safety impacts in the neighborhood and is permitted in the Low Medium Density Residential District. 4. The proposed development is designed to minimize traffic congestion. The proposal will have no effect on traffic congestion in the area. 5. Staff Report -Development Review Committee =June 2, 2005 -Case FLS2005-04028 The proposed development is consistent with the community character with regards to size, scale and setbacks to other structures in the immediate vicinity. 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties.
