E. STORMWATER PLAN SUBMITTAL REQUIREMENTS: (City of Clearwater Storm Drainage Design C
Manual and 4-202.A.21)
A STORMWATER NARRATIVE MUST BE SUBMITTED WITH ALL APPLICATIONS. All applications that in.
addition or modification of impervious surface, including buildings, must include a stormwater plan that demonstrates compliance
the City of Clearwater Storm Drainage Design Criteria manual. A reduction in impervious surface area does not qualify as an exeml
to this requirement.
If a plan is not required, the narrative shall provide an explanation as to why the site is exempt.
^ At a minimum, the STORMWATER PLAN shall include the following:
Existing topography extending 50 feet beyond all property lines;
Proposed grading including finished floor elevations of all structures;
All adjacent streets and municipal storm systems;
_ Proposed stormwater detention/retention area including top of bank, toe of slope and outlet control structure;
A narrative describing the proposed stormwater control plan including all calculations and data necessary to demonstrate compliance with the
City manual

the subdivision have been dedicated to the City of Clearwater per O.R. 6890 Pg. 1199 thru 1244.
2) Brick retaining wall shall not be constructed within the 5 ft. utility easement.
All of the above to be addressed prior to DO.
The following to be addressed prior to building permit:
1) A right-of-way permit is required prior to construction of brick paver driveway.
Contact Don Melone (727.562.4798) for permit information.
2) The existing sidewalk within the right-of-way is to be removed to the nearest joint beyond the
proposed drive apron/driveway and replaced per City standards by the applicant.
3) The City of Clearwater, at the applicant's expense, will remove/relocate any/all water and/or gas
meters that have to be relocated as part of this permit, including reclaim water meters. (No
meters shall be located within any impervious areas.)
4) Any new concrete driveway apron(s) constructed within the right-of-way shall be a minimum 6"
thick fibrous concrete, and a minimum 3000 psi with 6" x 6" / 10 x 10 w.w.f. [sidewalks shall not be
constructed within this apron area(s)].
General Note: DRC review is a prerequisite for Building Permit Review, additional

Stakes must include proposed grade cuts. Preliminary review results indicate that the proposed
construction impacts are too close to the tree and severe grade cuts too close to the tree can
render the tree hazardous and/or be detrimental to the trees health. If the field review, after
staking, is favorable, a root prune line will be established. Provide staking prior to building permit.

As a property owner within 200 feet of 2988 EAGLE ESTATES CIR E, the City of Clearwater Planning
Department gives notice that an application for Flexible Standard Development approval for site work
improvements to an existing single-familiy residence in the Low Density Residential (LDR) District and
includes a side (south) setback reduction from 15 feet to five feet (to pavement), per 2-103.A..
On January O5, 2006, the Development Review Committee (composed of the City's professional staff) will
review and determine whether the application demonstrates compliance with the City's Community
Development Code. Following that review and determiniation, the Planning Director will issue a
Development Order approving, approving with conditions, or denying the application. The earliest date that
the City will make a decision on the application will be January O5, 2006.

Dear Mr. Anderson:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On January 5, 2006, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval for site work improvements to an existing
single-family residence in the Low Density Residential. (LDR) District including a side (south) setback
reduction from 15 feet to five feet (to pavement), per 2-103.A.The DRC recommended approval of the
application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with Detached Dwelling criteria under the provisions of Section 2-103.A;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. The final design of the site work be consistent with the conceptual site plans submitted to the DRC;
2. Aright-of--way permit is required prior to construction of brick paver driveway;
3. The existing sidewalk within the right-of--way is to be removed to the nearest joint beyond the
proposed drive apron/driveway and replaced per City standards by the applicant;
4. The City of Clearwater, at the applicant's expense, will remove/relocate any/all water and/or gas
meters that have to be relocated as part of this permit, including reclaimed water meters (No
meters shall be located within any impervious areas.);
5. Any new -concrete driveway apron(s) constructed within the right-of--way shall be a minimum 6"
thick fibrous concrete, and a minimum 3000 psi with 6" x 6" / 10 x 10 w.w.f. [sidewalks shall not
be constructed within this apron area(s)); and
6. Field stake the north edge of the driveway and wall under the canopy of the existing oak tree.
Stakes must include proposed grade cuts. Preliminary review results indicate that the proposed
construction impacts are too close to the tree and severe grade cuts too close to the tree can render
the tree hazardous and/or be detrimental to the trees health. If the field review, after staking, is
favorable, a root prune line will be established. Provide staking prior to building permit.

I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the above conditions. The approval is based
on and must adhere to the application dated received November 30, 2005 and the revised site plans
dated received March 20, 2006.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (March 29, 2007). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.

Please find attached revised drawings to address the City's comments, this letter also
responds to your comments that may have or not required plan revisions. Comments are
as follows:
Engineering:
Comment #1 -Brick mailbox has been deleted from the plan.
Comment #2 -Brick retaining wall has been shortened to eliminate section within the
utility easement.
Building Permit:
Comment # 1 - If required, A right of way permit will be submitted, as requested under
separate cover.. (streets are private with public access easements not Rights of way, is
R/W permitting required?The burden is on the City to prove they own the roadway
areas.
Comment #2and #3 -Notes have been added to the plan as requested.
Comment #4 - My desire is to construct a brick driveway including. a brick apron. I will
address brick vs. concrete with the engineering department .All brick driveways in the
neighborhood include brick aprons.
Land Resource Condition:
Field stakes have been set for the northern limits of the drive as requested.
Zoning Conditions:
Comment #1 -Estimated value of the drive and wall are $7,500.00 (materials and labor)
Comment #2 - To my knov~Jledge and as shown on the attached survey my property
extends to the center of the street. This is consistent with the recorded plat, property
appraiser information,my title policy and my survey. This neighborhood has not been

replatted, nor have the rights of way been recorded under separate legal document to the
best of my knowledge.
Comment #3 -ISR will be reduced if the road easements are deleted from our lot area,
16' of the 25' roadway easement is impervious area, which equates to 64% impervious
per foot . The reduced ISR renders the outcome of comment #2 above irrelevant.
Submittal to the homeowners board will occur upon approval of the varriance and right
of way permit applications if required.
