prepared illustrative site plans for several of the schematic site plans
presented to you at our meeting on August 29th. The purpose of the
illustrative site plans is to provide a pictorial representation of the
the various structures that could be built within each of the building
envelopes and open areas described in the corresponding schematic site plans.
We are forwarding via Federal Express, but in a separate package, 50-scale
illustrative site plans for each of the following schematic site plans:

Attached is the requisite response letter to Mr. Cobb in accordance with the Sand Key Court
Settlement for Parcel II, the Ultimar site located at 1520 Gulf Boulevard. The site plan for phase 2
of the development was submitted on September 19, 1990 and reviewed by the Development Review
Committee on September 27, 199. As you probably recall from the previous submittals on Sand
Key, the Court Settlement Stipulations require that "within fifteen (15) days after such submission,
the City Manager shall determine; in writing, whether or not the proposed site plan is in conformity
with the provisions of this Stipulation." Therefore, attached is the letter for your response to the
applicant's submittal.

Dear Mr. Cobb:
As provided for in Article 14 of the Settlement Stipulations (Circuit Civil No. 78-4765-7), City staff has reviewed
your site plan for Parcel II received by the City on September 19, 1990. The site plan follows the basic parameters
of Settlement Stipulation Parcel II Schematic Site Plan 2 of Exhibit "B" (as shown in the approved Development
Order) and proposes 173 dwelling units in Phase 2 (in addition to the 142 units for Phase 1) within a multi-level
building envelope (maximum dimensions of 140' x 240' x 210' height) and a parking deck/townhouse envelope
(maximum 15'/60' consecutive heights) with 258 parking spaces (min. of 1.25 spaces per unit required by
settlement).
We find the site plan to be in general conformity with the provisions of the Stipulation. Please refer to the attached
copy of the motions from the City's Development Review Committee meeting on September 27, 1990 for conditions
of site plan approval.

Please find attached twelve (12) signed and sealed copies of the
civil and architectural site plans for Ultimar Two. We would
appreciate this item being placed on the agenda for the
Development Review Committee meeting scheduled for September 27,
1990.
Please note that the Phase 1/2 boundary shown on the previously
approved site plan contains more acreage than does the Phase l
construction boundary as shown on that same site plan. Since all
site data on Phase 1 was computed using the Phase 1/2 boundary
which encompasses a portion of the Phase 2 building, we have
computed the site data based on the combined Phase 1 and Phase
2 areas.
In addition, please note that this document is submitted for
approval of Phase 2 only. The building/parking area designated
as Phase 3 is shown for conceptual purposes only and may change
upon the submittal of Phase 3 for formal approval at a later
date.
Please let me know if you have any questions, of if any
additional information must be submitted in order for this
document to be reviewed at the Development Review Committee
meeting scheduled for September 27.

The Development Review Committee at its meeting of September 14, 1989 approved the above d~ e ~~ UR~,gN

1. Prior to certification the site plan shall clearly indicate that no structure (12" or greater in height) will be
located seaward of the coastal construction control line and that minimum setbacks will be provided for
all structures, including the minimum required. 20 ft. waterfront setback.
2. All site data calculations must be placed on the site plan, prior to certification,
3. Prior to certification, the entire parcel must be drawn on the site plan and site calculations must be
reflective of the entire parcel, unless a subdivision plat is submitted for review.
4. Signs and fencing/walls are subject to separate review and permitting processes
5. Additional hydrants shall be provided as required by the Fire Marshal and shown on the site plan prior to
certification.
6. A 10 ft. utility easement to include a 5 ft. pedestrian easement should be provided along the north property
line and shown as such on the site plan prior to certification.
7. Prior to certification, the engineer shall meet with City Environmental to discuss the aspect of water quality
on the site.
8. The developer shall meet with the Traffic Eng~' eer to discuss the vehicular layout/flow and revise the site
plan to show pazking prior to certification of the site plan.
9. Existing access points on the other side of Gulf Blvd. should be shown on the plan for Traffic Eng~' Bering
review and recommended changes in propposed access ppoints for this site, prior to certification. The access
points will be subject to permit approvalby Pinellas (:ounty.
10: Required open spaces/recreation fees must be paid prior to certification.
11. Prior to certification, SWFWMD and DER permit applications shall be provided to the Public Works
Department.
12. The proposed water distribution system must be revised as required by Utilities prior to certification.
13. A Pinellas County Public Health Unit Permit, Pinellas County Utility Permit and a 10' utilities easement
over water mains aze required prior to the issuance of a building permit.
14. The Dempster Requirement Data Form must be completed and returned prior to Site Plan certification.
NOTE: This site plan addresses the currently proposed development on the northerly 3.5 acres of the 8.6 acre
undeveloped site identified as Parcel II in the Court Settlement of U.S. Steel Corp. vs. City of Clearwater.
As conditions #1, 2, 3, 5, 6, 7, 8, 9, 10, 11 12 and 14 have been satisfied, please certify the attached plans subject

27,.1990 required these calculations to be corrected on the site plan prior to certification, however,

day response letter deadline; the response letter addressed the calculations given on the site plan for. _
phases 1 and 2 which still would have met the settlement restrictions for the entire site (as the last ~`
'phase has not yet been submitted for site plan approvall.
A .revised site plan was submitted on October 17, 1990 which includes corrections to unit and
' parking, calculations. The developer's engineer has requested that the response letter be corrected
,: for the record as the figures may later be misconstrued from that letter and restrict development for
' Phase :3.
Attached is the letter for your response to the applicant`s revised submittal. Also, attached is a copy
of the previous memo and letter for your reference.

Dear Mr. Cobb:
This letter is being sent in response to your revised site plan for Phase 2'of Ultimar; revisions include corrections
to unit and parking calculations. As provided for in Article 14 of the Settlement Stipulations (Circuit Civil No.
78-4765-7), City staff has reviewed your revised site plan received by the City on October 17, 1990. The site
plan follows the basic parameters of Settlement Stipulation Parcel II Schematic Site Plan 2 of Exhibit "B" (as shown
in the approved Development Order) and proposes 138 dwelling units in Phase 2 (in addition to the 114 units for
Phase 1) within amulti-level building envelope (maximum dimensions of 140' x 240' x 210' height) and a parking
deck/townhouse envelope (maximum 15'/60' consecutive heights) with 172 parking spaces (in addition to the 143
spaces for Phase 1, a min. of 1.25 spaces per unit required by settlement).
We find the revised site plan to be in general conformity with the provisions of the Stipulation. Again, please refer
to the attached copy of the motions from the City's Development Review Committee meeting on September 27,
1990 for conditions of site plan approval.

Attached is the requisite response letter to Mr. Cobb In accordance with the Sand Key Court
Settlement for Parcel II, the Ultimar site located at 1520 Gulf Boulevard. The site plan for phase 2
of the development was submitted on September 19, 1990 and reviewed by the Development Review
Committee on September 27, 199if. As you probably recall from tfle previous submittals on Sand
Key, the Court Settlement Stipulations require that "witflln fifteen (15) days after such submission,
the City Manager shall determine; in writing, whether or not the proposed site plan is in conformity
with the provisions of this Stipulation." Therefore, attached is the letter for your response to the
applicant's submittal.

Dear Mr. Jensen,
You have requested a letter from the City of Clearwater stating the
circumstances under which the Ultimar II Condominium development could be rebuilt in
the event of casualty loss. You faxed me correspondence from Holly Sharpless of S &
D Appraisals, Inc. stating that a staff member of the City of Clearwater had opined that
the project could be rebuilt if over 50% destroyed but must meet "FEMA guidelines
including stricter construction guidelines and other zoning -set back. anal: height
requirements." Code of Ordinances Section 6-102, Nonconforming Structures,
subsection F., provides that any nonconforming structure which is destroyed or
damaged to fifty percent or more of the assessed value may be repaired or restored
only if the structure conforms to the standards of the Development Code for the zoning
district in which it is located. `
The subject property is listed in the Zoning Atlas as being zoned "B". This
indicates that it is part of a group of properties involved in previous litigation, U.S. Steel
v. City of Clearwater, Case No. 78-4765-7. A Settlement Stipulation and Final
Judgment were entered in that case in early 1987. The Settlement Stipulation recites
that the development rights agreed to therein would remain in force for a period of
twenty years. The provisions of the Settlement Stipulation regarding Parcel II, of which
the Ultimar II appears to be a part, state that the property will be developed as shown on
an attached site plan [see paragraph 11.]. Modifications to the site plan, unless they fall
within certain parameters, must be approved by the City Manager, with an appeal
procedure if such approval is denied (see paragraph 14.]. Coincident with the Final
Judgment an assignment of forty residential units from Parcel IV to Parcel II occurred.
Therefore, the City would take the position that any redevelopment of the
property following casualty loss must be in accordance with Section 6-102 and the
provisions of the Settlement Stipulation. Following the expiration of the Settlement
