SUPPLEMENTAL AGREEMENT NO.1
THIS SUP LEMENT AL AGREEMENT, made and entered into this 'f 14-, day
of 1994, by and between the CITY OF CLEARWATER, an
incorporat d area in Pinellas County, Florida, hereinafter called the CITY, and HDR
ENGINEERING, INC., of 5100 West Kennedy Boulevard, Tampa, Florida 33609,
hereinafter called the ENGINEER.

WHEREAS, the CITY and the ENGINEER heretofore on November 20, 1990,
entered into an agreement whereby the CITY retained the ENGINEER to furnish certain
services in connection with Hiohland Avenue Improvements; and
WHEREAS, Paragraph I.B of Exhibit "B" of the original Agreement provided a
mechanism for the ENGINEER to provide additional services as authorized by the CITY;
and
WHEREAS, the CITY has determined it necessary, within the general description
of the project as originally planned, to require certain changes in services of the
ENGINEER and that the ENGINEER be granted an extension of time and increased
compensation;
NOW, THEREFORE, this Agreement witnesseth that for and in consideration of
the mutual benefits to flow each to the other, the parties agree that the ENGINEER
shall perform the services as modified by Exhibit" A", attached hereto and made a part
hereof and that the ENGINEER shall receive for his services hereunder the increased
maximum amount of $263.824 Dollars. It is further agreed that the ENGINEER shall
complete Design Services required of the ENGINEER by said original Agreement and
by this Supplemental Agreement No.1-in a timely manner as directed by the CITY.
Except as hereby modified, amended, or changed, all of the terms, conditions,
billling procedures, and other administrative procedures of said Agreement and any
supplements and amendments thereto shall remain in full force and effect.

I. DESCRIPTION
Engineering services are required in connection with design modifications to plans for
Highland Avenue from Gulf-to-Bay Boulevard (SR 60) to Sunset Point Road, a distance
of approximately 2.0 miles. Also included is the addition of side street intersection
improvements at Palmetto Street and Greenlea Drive, Utility Relocation Plans will also
be updated to match the revised roadway configuration,
II. OBJECTIVES
The Consultant shall provide necessary field design surveys and prepare complete
construction plans for all phases of construction within the project limits. Elements of
work shall include roadways, intersections, drainage, signing and pavement markings,
utilities relocation plans, maintenance of traffic, cost estimates, and incidental items,
III. SERVICES
A, Roadwav Design Revisions (to 90% Submittal)
Existing roadway plans shall be revised to incorporate a three lane typical section
along Highland Avenue between Gulf-to-Bay Boulevard (SR 60) and Union
Street. The widening will match existing approach widening at improved
intersections of Gulf-to-Bay Boulevard, Drew Street, and Union Street. The
design shall also include improved intersection side streets at Palmetto Street and
Greenlea Drive. Specific revisions are detailed below.
1. Roadwav Plans
a, Typical Section
The typical section for Highland Avenue will consist of 3 lanes -
2 at 14', 1 at 12' and a 6' sidewalk.
Additional laneage is anticipated at Cleveland Street, Palmetto
Street, Greenlea Drive and Sunset Point Road for exclusive right
turn lanes,
b. Improved Side Streets
Additional laneage and approach tapers to match eXIstmg are
anticipated at the Palmetto Street and Greenlea Drive intersections,
c. Maintenance of Traffic Plans
Traffic shall be maintained on all affected streets throughout the
construction duration of the project. The Maintenance of Traffic
plans shall detail construction phasing, patterns for traffic t1ow,

drainage, appropriate signing and pavement marking and itemized
quantities: A construction staging plan shall also be included.
(1) Provide Maintenance of Traffic (MOT) plans for each
construction section with these general objectives:
Maintain or improve, to the maximum extent
possible, the quality of existing traffic operations,
both in terms of flow rate and safety, throughout
the duration of the project.
Minimize the number of different MOT phases,
i,e" number of different detours for a given traffic
movement.
Take advantage of newly constructed portions of the
permanent facility as soon as possible, when it is in
theii' best interest of traffic operations and
construction activity,
Maintain reasonably direct access to adjacent
properties at all times,
(2) There shall be an overall presentation of each phase in plan
and narrative form, This will typically be accomplished
with a schematic plan sheet for each phase, supplemented
by plan notes,
(3) Detailed sheets such as cross-sections, construction
phasing, profiles, drainage structures, temporary retaining
walls or sheet piling, etc" shall be developed when
necessary to ensure that the contractor will implement the
MOT concept envisioned by the Consultant.
2. Drainage Design
The Consultant shall document the drainage design in the revised
Hydraulic Design Study including a description of existing and proposed
systems, storm sewer tabulation sheets, gutter spread calculations, and
stormwater treatment and attenuation calculations (if necessary).
The revision in roadway typical section will require analysis/re-design of
the proposed stormwater collection system, In general, the original
system will be moved horizontally towards the revised edge of pavement
locations and vertically to avoid underground utilities (sanitary sewer,
water, gas, and telephone). Pipe sizes may be altered due to the reduction
in impervious area within the drainage basin.

No modifications at the stormwater management ponds are anticipated,
A detailed letter will be prepared for the Permitting Agency describing the
proposed revisions to the plans, One coordination meeting will be held
in agency offices, if required, to explain the revised concepts.
3. Signing & Pavement Marking Plans
Signing and Pavement Marking Plans shall be revised to incorporate a
three lane typical section along Highland Avenue between Gulf-to-Bay
Boulevard (SR 60) and Union Street. Revisions to the following sheets
are anticipated: Key sheet, tabulation of quantity sheet, and 1" =40' scale
plan sheets.

intersection,
Drainage Structure Sheets - modify inlet and manhole locations, offsets,
elevations, inverts, pipe sizes, etc,
Pond Details - revisions to Highland Avenue roadway (edge of
pavements, curbs, sidewalks, inlets, pipe locations,
etc,) orifice sizes, DHW, etc,
Cross Sections - revise to show 3-lanes, revise side street profiles,
revise gravity wall locations, proposed utilities, etc,

5, Utility Coordination (GTE, Florida Power and Vision Cable)
The following services shall be performed by the Consultant and plans
shall be submitted by the Consultant for the City to proceed with utility
coordination.

The Consultant shall furnish copies of the approved
60 % Plans to each utility located within the project
limits, The plans shall consist of all plan
components as depicted in the 60 % Plans checklist.
The Consultant shall furnish one (1) full set of plans
and one (1) set of partial plans for each utility,
Partial plans shall consist of Key Sheet, Typical
Section, Plan and Profiles, Drainage Structures, and
Cross Section Sheets,

The Consultant shall attend the 60 % Plans utility
design meeting with all affected Utility Agencies
and the City. The Consultant shall be prepared to
discuss in depth the effects the utility corridor
locations have on the project design. The
Consultant shall be prepared to specifically identify
conflicts along with his recommendation for
resolution. The Consultant shall be prepared to
discuss in detail the proposed maintenance of traffic
phasing along with its special provisions, drainage,
highway lighting, traffic signalization, and
structures to the extent that they may have an affect
on existing or proposed' utility facilities. The
Consultant shall prepare and distribute summary
minutes including any commitments made by
attendees,
The Consultant shall review requests made by the
utilities for re-design due to identified conflicts,
The Consultant shall provide recommendations for
resolution of the identified conflicts to the City,
The Consultant shall provide mylar reproduction
services for those utilities participating in a Utility
Joint Project Agreement.

The Consultant shall confirm the location of all
electrical service points for highway lighting,
signalization, and signing,

The Consultant shall prepare a final summary to
identify utilities to be moved, to remain, to be
installed, and modifications to plans for utility
conflicts, et cetera.
b. Utility Coordination - 90 % Plans
1, The Consultant shall furnish copies of the approved
90% plans to each utility located within the project
limits, The plans shall consist of all plan
components as depicted in the 90 % Plans checklist.
The Consultant shall furnish one (1) full set of plans
and one (1) set of partial plans for each utility.
Partial plans shall consist of a Key Sheet, Typical
Section, Plan and Profile and Cross-Section Sheets.
2. The Consultant shall review each utility agency's
finert marked plans for completeness, accuracy, and
verification that no outstanding utility conflict
exists. The Consultant shall advise the City in
writing their review comments.
c. Utility Coordination - 100% Plans

The Consultant shall furnish copies of the Utility
Adjustment Sheets of the plans to each utility
located within the project limits, The Consultant
shall provide one (1) full set of the Utility
Adjustment Sheets for each utility,

The Consultant shall make any corrections that are
required due to an omission in transferring the
Utility Agency's Final Locations Design to the
Utility Adjustment Sheets of the plans.
3.
The Consultant shall provide copies of any revisions
to the plans, to' each utility located within the
project limits. The Consultant shall provide two (2)
copies for each utility,

B, Utilitv Relocation Design Revisions
The services shall include the revisions to Plans and Specifications, Pay/Bid
Items, and documentation to relocate or improve the sanitary sewer, natural gas,
and potable water distribution system facilities.
The following is a detailed list of tasks and deliverables associated with the
Project:
1, Revise Construction Plans and Specifications
a, Complete plans for sanitary sewer, gas main, water main, fire
hydrant, isolation valve and service connection relocations,
b, Complete specifications including Summary of Quantities and
Pay /Bid Items,
c. The design phase will include review submittals at the 50% and
90 % level.
d, Three (3) sets of Flans and Specifications shall be submitted for
the reviews to the City and two (2) sets of plans to each utility,
e. An Opinion of Probable Construction Costs shall be provided with
each review submittal.
f, Develop Maintenance of Traffic Plan for incorporation with the
plans and specifications.
g, Two (2) design review meetings with the City will be required at
the 50 % and 90 % level,
h. Two (2) meetings with each utility will be required during the
design phase.
2, Finalize Design
a. Update plans, specifications, estimate of probable construction
costs & Pay/Bid items,
3. Florida Department of Environmental Regulation Permit
a, Prepare permit applications for both wastewater and potable water
system for construction,
b. Submit permit applications with the appropriate attachments.
c. Respond to questions related to permit application submittals,

This work includes all items required to bring the construction plans up to 100 %
(Final) Plans including quantity calculations, summary of quantity sheets,
summary of drainage structure sheets, earthwork volumes, utility adjustment
sheets, general notes, and final utility and railroad coordination, A final
Engineer's Estimate of probable construction costs will also be tabulated,

Specifications
The Consultant shall provide Technical Special Provisions for all items of work
not covered by the Standard Specifications, Supplemental Specifications or
Recurring Special Provisions.
D. Miscellaneous Survey Services
The Consultant shall perform all survey services necessary to revise and update
the Construction plans for the limits of the Highland Avenue and Glenwood
Avenue projects as described herein:
1, Design Survey
a, Make a complete topographic survey for the limits of the project
on the improved side streets,

b. Take roadway and intersection cross-sections at 100 foot intervals,
major changes in grade, driveways, culverts, and drainage features
along the improved side streets.
c. Locate visible utilities both vertically and horizontally along the
improved side streets.
d. Make necessary outfall and detention pond, and mitigation area
surveys.
e, Provide alignment stake-out for subsoil investigation,
f. Make DER jurisdictional line surveys where applicable and tie
same to the centerline of survey,
g, Locations of specimen trees.
V. CITY RESPONSffiILITIES
The City will provide those services and materials as set forth below:
Project data currently on file.
Engineering standards and review services.
Environmental standards and review services.

All available information in the possession of the City pertaining to utility companies
whose facilities may be affected' by the proposed construction.
All future information which may come to the City during the term of the Consultant's
Agreement and which, in the opinion of the City, is necessary to the prosecution of the
work.
All available information in the possession of the City pertaining to subdivision plans so
that the Consultant may take advantage of additional areas that can be utilized for right-
of-way, stormwater ponds, etc,
Provide phase reviews of roadway plans, storm sewer plans and utility relocation plans,
VI. GENERAL
A.
Meetings

1, The Consultant shall attend a notice to proceed meeting scheduled by the
City to receive the official Notice to Proceed. The purpose of this
introductory meeting is three fold:
a. The City will render all relevant information in its possession, this
may include traffic data, planning information, and available as-
built plans.
b. The City will establish any ground rules upon which the plans
process will be developed,
c. The City will explain the financial administration of the contract.
2. The Consultant shall make such reviews, attend such meeting and make
such contacts as are necessary to maintain the project schedule and for
proper preparation of plans, specifications, special provisions,
coordination with utilities (including the utility pre-design conference) and
coordination with other projects,
B. Professional Endorsement
After the City approves the final plans, the original set of plans plus two (2) sets
of record prints shall be furnished to the City. The Consultant shall signify, by
affixing an endorsement of embossed seal and original signature on every sheet
of the record set, that the work shown on the endorsed sheets was produced by
a registered professional engineer. The original set of plans shall have the title
block placed on each sheet, an original signature shall be placed on the key map,
and an original or stamped signature on all other plan sheets.

C. Plans Reproduction
The Consultant shall furnish prints and sepias as required by the City to
adequately control, coordinate, and approve the plans.
D. Phase Reviews
Plans will be reviewed at intervals specified by the City, including three phase
review submittals (60%, 90% and 100% roadway), The Consultant shall be
responsible for all phase review coordination. The Consultant shall transmit
phase review plan sets to each reviewer by means of a document transmittal letter
which shall include the phase review meeting date, place and time.
E. Consultant's Schedule of Activities
The Consultant shall prepare ap.d submit a detailed schedule for Consultant
activities on the project, make "monthly progress reports and attend monthly
project meetings. This schedule shall be updated and resubmitted for the city's
approval should the Consultant fail to meet requirements for interim design
submittal dates. The schedule shall indicate submission dates for 60%, 90% and
100% complete roadway plans, including final quantities. For purposes of
scheduling, 'Consultant shall allow for three (3) weeks City review of each
roadway design submittal.
F. Progress Reporting
Progress reports which describe in detail the work performed on each task will
be submitted monthly. Progress reports shall be delivered to the City
concurrently with the monthly invoice.
