A G R E E MEN T
THIS AGREEMENT made and entered into this

day of May, A.D.,
1981, by and between the CITY OF CLEARWATER, FLORIDA, a municipal corpor-
ation, hereinafter called, "City", and HAROLD F. HEYE and ALICE M. BIRD,
now known as ALICE H. RHOADES, hereinafter called "Owners";
WIT N E SSE T H:
WHEREAS, Owners have petitioned to have the land described in
Exhibit "A", attached hereto and made a part hereof, annexed into the
City of Clearwater; and
WHEREAS, prior to the completion of such annexation, there are
several additional requirements that need to be dealt with; and
WHEREAS, it is the desire of both parties to treat the additional
matters relating to rights-of-way for Pineland Drive and Sunset Point
Road and parkland requirements by agreement; and
WHEREAS, the annexation process has already commenced;
NOW, THEREFORE, ~t is mutually covenanted and agreed as follows:
1. Owners agree that on or before thirty (30) days after the final
reading of the ordinance annexing the property described in said Exhibit
"A", which final reading is presently estimated to occur on May 7, 1981,
they will convey by warranty deed the rights-of-way set out in Exhibit "B",
attached hereto and made a part hereof.
2. Owners further agree that as to Tract I and Tract II that on or
before sixty (60) days after the final reading of the ordinance annexing
the prop/!;f/ described in said Exhibit "A", they will provide a cash sum
equal t~.value of such land, which sum will be used in the area where

the annexed land is located to acquire and provide park services. Owners
further agree that as to Tract III that on or before the expiration of
six (6) months after the final reading of the ordinance annexing the pro-
perty described in said Exhibit "A", they will provide a cash sum equal
to ten percent (10%) of the value of such land, which sum will be used in
the area where the annexed land is located to acquire and provide park
services.

3. Owners agree that the terms and provisions of this agreement
shall be a commitment and obligation which shall not only bind the present
owners of the tract of real property described in Exhibit "A", but shall
be covenants which shall run with the land and shall bind and be enforce-
able against all subsequent owners of such property whether or not such
covenants are mentioned in the deed to such new owners.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to
be executed the date and year first above written.
