Encroachment Agreement between Heinemann's of
Florida, Inc. and the City

Responding to your memorandum of June 5, 1980, relating to the

above agreement, I do not believe that it will be necessary to
draw up a new agreement since paragraph 5 of the old agreement
provided that the agreement was to bind the parties and "their
successors and assigns. "
If the encorachment still exists, I would ascertain the new owner and
then notify the owner of the agreement and requirement for insurance.

If the premium has been paid, the excess premium will be refunded on demand or* as soon as practicable after cancellation becomes

insurance expiration covering the four planter pylons,
we learned the property has changed hands.
If the encroachment still exists, will it be necessary
to draw up an agreement with the new owner in addition
to having him provide us with evidence of insurance?
