AGREEMENT
The IMPERIAL COVE COMMUNITY ASSOCIA TION, INC. and,
I
the CITY OF CLEARWATER, FLORIDA, jointly and severally agree to
participate in the construction of an acces s road from plans dra:w-n by the
l

City of Clearwater from the Imperial Cove Condominium to the light at
Barn Boulevard.

For its part, the Imperial Cove Community As sociation, Inc. lS to
contribute $14,865.00 to cover all construction and advertising costs for
building the access road in accordance with plans drawn by the City of
Clearwater. The City of Clearwater shall set up and maintain an escrow
account to contain the money contributed by the Imperial Cove Community
As sociation, Inc. with the City Treasury responsible for that account.
Mr. Jeff Butler, Director of Finance of the City of Clearwater, is authorized
to release funds to the contractor from the escrow account upon instructions
from the Department of Public Works. The City further agrees to inspect
the construction during progress for compliance with City standards and
assume responsibility for follow-up maintenance once the roadway is completed.
All parties agree that any funds remaining in the escrow account after the
payment of all bills will be returned to the Imperial Cove Community
Association, Inc.
The above terms of reference are agreed to on this date, August 18,
1980, by the parties hereto.
