is hereby vacated, and the appropriate officials of the City of
Clearwater are hereby authorized and instructed to execute a dead
on behalf of the City of Clearwater, Florida, conveying the lands
occupied by said right-of-way to A. Waller Smith and Eva Smith, his
wife, or the abutting owners, upon the assurance from the said Smiths'
that they will refund to the City its costs for the improvements re-
cited in the premises, to-wit: the sum of $27,172.07, not later
than January 15, 1961, or upon the sale or development of the said
property as referred to in the premises, whichever occurs sooner.
2. That the said A. Waller Smith and Eva Smith, his wife,
will simultaneously execute and deliver to the City of Clearwater
their properly executed deed dedicating to the public generally a
strip of land lying on the North boundary of said "Smith Finger"
20 feet in width, running parallel with the said North boundary,
and extending Westerly a distance of 225 feet, measured from the
existing mainland seawall, lying immediately West of Pierce Boule-
vard, more particularly described as follows:
