We have reviewed the subject sidewalk waiver request and found that there are no sidewalks
along Jurgen Street, it is not part of a school walk route, and the absence of a sidewalk
does not create a pedestrian hazard.
Since the requirements

Since the above-referenced property is not part of a school walk route, there are no
sidewalks along Jurgens Street In this lrea, and the absence of a sidewalk does not
create 8 pedestrian hazard, this location IIHts the requirements set forth in Section
138.09. Therefore. a tttftPorary wIlverof the sidewalk requirement Is granted on the
above-reference property. Should It be detenalned that a sidewalk is required at this
location in the future. it wi 11 be Installed by the assessment process.

REASON FOR REQUEST By variance granted, front set back is only 10 feet with
considerable grade elevation from street level'. Additionally, there are numerous
palm trees and a fence which have long existed at this site. There are currently
no sidewalks on Jurgens Street and this is not part of a school walk route.
Similar Sidewalk Waivers have previously been granted --1or Jurgens Street
properties.
Section 138.09 of the Code of Ordinances of the City requires that all land that
abuts a public right-of-way, which is to have new construction on it, either for
residential, commercial, industrial or other purposes, shall have sidewalks
constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the Owner for the full cost of said
sidewalks.
