WITNESSETH:
WHEREAS, the Owner owns the following described real property situated in the
City of Clearwater, Pinellas County, Florida, to wit: 1843 Springtime Ave.,Lot 18
Block E, First Addition to Sunset Point, Plat Book 5, page 95, O. R. Book 3182, Pg. 716
And
WHEREAS, Section 7-6 of the Code of Ordinances oftheCity'reql.1i:res that a 11 larid
that abuts a public right-of-way, which is to have new construction on it, either ~or resi-
dential, commercial, industrial or other purposes, shall have sidewalks constructed by
the owner on, across or adjacent thereto; and
WHEREAS, the Owner is erecting certain new construction on said property and has
requested the City at this time not to require the immediate installation and construction
of sidewalks in connection therewith; and
WHEREAS, the Owner has agreed that if in the future the City, in its sole discretion,
determines that it is advisable and necessary to have such sidewalks installed, that the
Owner will, upon notification by the City, have sidewalks immediately installed at his ex-
pense, and if he should fail to do so then the City may have said installation made and
impose a lien against the described real property for the cost hereof:
NOW, THEREFORE, in consideration of the foregoing premises and other good and
valuable consideration between the parties, receipt of which is hereby acknowledged, the
parties hereto covenant and agree as follows:
~~1n- 1. The City will not at this time require the installation and construction of
sidewalks as part of the erection of the building and improvements by the Owner on their portio]
of the above described real property abutting Douglas Avenue (See attached survey WO 4tr-45335-V
because such installation ar.d construction would work an undue hardship on the property owner.
2. The City may at any time in the future notify the Owner, his heirs, personal
representatives, successors or assigns that the City in its sole discretion has determined
that it is advisable and necessary to have sidewalks installed in connection with said
described real property.
3. The Owner or his heirs, personal representatives, successors or assigns shall
at his expense within ninety (90) days from the notification by the City have sidewalks in-
stalled for said described real property in accordance with City specifications and standards
as established.
4. If the Owner or his heirs, personal representatives, successors or assigns
shall fail to have sidewalks installed for the described real property in accordance with
City specifications and standards within ninety (90) days from the notification by the
City, then the City may have the sidewalks installed and assess and impose a lien against
the described real property for the cost of the work.
5. This agreement is to be regarded as a covenant running with the land regardless
of whether it is specifically mentioned in any deeds or conveyance subsequently executed,
and this agreement shall be binding on all parties, the heirs, personal representatives,
successors or assigns.
6, All notices pursuant to this agreement shall be furnished to the respective
parties at the following addresses, until receipt of written instructions notifying the other
party of a different address:

Sign the attached sidewalk installation waiver agreement which provides
that the Marchants will construct a sidewalk on their property fronting
on Springtime Avenue, but waives on the basis of hardship, a require-
ment for installation of a sidewalk at the rear of their property, which
abuts Douglas Avenue.
Background
Mr. & Mrs. Marchant's property is unique in that it abuts City right-
of way on the front and in the rear. They originally requested a waiver
on installing any sidewalks. I visited the property and discus sed the
matter with Mrs. Marchant. This discussion revealed that installation
of both sidewalks at this time would work an undue hardship on the
Marchants. A letter from Mrs. Marchant dated February 23, 1976,
affirms this. Mrs. Marchant agreed that they could install a side-
walk on Springtime Avenue, if the Douglas Avenue installation were
waived.

Mr. &:Mrs. Glenn ~ Marchant have constructed a home at 1843 Springtime Avenue,
lot 18, blockE, First Addition to Sunset Point, Plat Book 5, page 95, O. R. Book
3182, page 716. This property abuts street rights of way on Springtime Avenue and
Douglas Avenue. The property is described in the attached copy of survey dated
February 28, 1975 (W.O. No.S-45335-V)
Mr. &: Mrs. Marchant requested a waiver on insta!lation of sidewalks on their
property as they maintained such costs at this time would work an undue hardship
on them. The City Manager has granted a partial waiver on the basis of hardship.
Mr. &: Mrs. Marchant will be required to install a sidewalk and they have agreed to
do so on the Springtime Avenue portion of their property, but will not be required at
this time to install a sidewalk on the Douglas Avenue side of their property.
Paragraph 1 of the standard sidewalk installation waiver agreement was modified
to reflect this.
Since the wai ver was granted on the basis of hardship, the property owners are not
required to pay into the sidewalk account for that applicable portion of sidewalk.
