D. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-913.A) ~ Provide complete responses to the six (fi) Gf=NERAL APPLICABILITY CRITERIA- Explain how each criteria is achieved, in detail: 1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density and character of adjacent properties in which it is located. The proposed dock structure will replace existing. structures. The entire shoreline of Mandalay Channel in t e vicinity of the project is seawalled and. contains numerous docks. For these reasons, the proposed structure will not introduce an anomalous characteristics to adjacent areas. 2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. The proposed dock structure will be located at least 30 feet from both adjacent riparian rights lines and will not interfere with the development of adjacent lands or significantly impair the value of those lands. 3. The proposed development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use. The proposed dock structure will replace existing structures and therefore will not present any further safety hazards to persons in the neighborhood than already exist. 4. The proposed development is designed to minimize traffic congestion. The proposed dock. structure has only nine (9) wetslips while there are twelve (12) upland units. Having fewer boat slips than upland units decreases the navigational hazard of the dock by occupying a smaller area and minimizes the amount of boat traffic associated with the upland units. 5. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The immediate vicinity of the parcel proposed for development consists of multi-family residences. As mentioned in Response 1, because there are numerous existing docks in the vicinity of the proposed structure the community character will not be adversely affected as a result of the construction of the proposed structure. 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties. The proposed dock will be associated with upland private condominiums and will not introduce activity that is incongruent with private residential living. Two existing structures wiR be replaced with a new, more aesthetically pleasing structure. For the reasons provided in numbers 1-F, adverse effects resulting from the proposed dock will be minimal. p Provide complete responses to the applicable Flexibility criteria for the specific land use as listed in each Zoning District to which the waiver is requested {use separate sheets as necessary) -Explain how each criteria is achieved, 'sn detail: NIA ~ 1?ECEIUEp, Pj-ANNING DEPARTMENT CIY OF GLEARWATER Page 2 of fi -Flexible Development Application 2005- City of Clearwater E. Pursuant to Community Development Code (CDC} Section 3-60LC.3.h.iii., the width of a commercial/multi-use docking facility shall not exceed 75% of the width of the subject property as measured at the waterfront property line. The development proposal indicates a width of 138 feet, which is within the allowable maximum of 142.5 feet; however this measurement does nat extend to the full width of the dock proposed, specifically to the eastern extent of catwalk # 1. Provide revised plans that accurately dimersion the proposed dock and ensure the dimension. complies with the above referenced Section. This comment must be addressed prior to proceeding to the Community Development Board I(CDB). 2 . Install lighting at the ends of the docks to make the docks more visible to both recreational boaters and to slip owners finding their slips at night. 3 . Boats moored at the docks and/or slips shall be for the exclusive use by the residents and/or guests of the condominiums and will not be permitted to be sub-leased separately from the condominiums.
