The proposed dock structures will replace existing structures. The entire shoreline of Clearwater Harbor in the vicinity of the property is seawalled and densely populated with docks. For these reasons, the proposed structure will not introduce any anomalous characteristics to adjacent areas.. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. Furthermore, the proposed structures will meet Clearwater Dock Standard 3-601(C)(3)(h)(i) regarding setbacks and as an amenity to the planned upland condominiums will only serve to increase property values. 3. The proposed development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use. The proposed docks are replacing existing structures and will not affect the health or safety of persons in the neighborhood. 4. The proposed development is designed to minimize traffic congestion. The proposed dock structures will extend waterward of the seawall no greater than 14% of the adjacent waterway width. A shortened slip configuration was designed to minimize the length of the docks. 5. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. There are many multi-family residential properties in the vicinity of the proposed dock location. As mentioned in Response 1, because there are numerous existing docks in the vicinity of the proposed structure, the community character will not be adversely affected as a result of the construction of the proposed structure. 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties. The proposed dock will be associated with upland private condominiums and will not introduce activity that is incongruent with private residential living. Existing structures will be replaced with new, more aesthetically pleasing structures. The existence and use of the proposed dock shall not have a detrimental effect on the use of adjacent waters for navigation, transportation, recreational or other public conveniences. Response: The proposed structure extends from the seawall approximately 14% of the waterway width and will not create a navigational hazard for the adjacent waterway, or interfere with recreational and other public conveniences. d. Impacts on marine environment. Docks shall be sited to ensure that boat access routes avoid injury to marine grassbeds or other aquatic resources in the surrounding areas. Response: No seagrass beds or other aquatic resources are located in the vicinity of this project. ii) Docks shall not have an adverse impact upon natural ,marine habitats, grass flats suitable as nursery feeding grounds for marine life, or established marine soil suitable for producing plant growth of a type useful as nursery or feeding grounds for marine life; manatee sanctuaries; natural reefs and any such artificial reef which has developed an associated flora and fauna which have been determined to be approaching a typical natural assemblage structure in both density and diversity; oyster beds; clam beds; known sea turtle nesting site; commercial or sport fisheries or shell fisheries areas; and habitats desirable as juvenile fish habitat. Response: No seagrass beds or other aquatic resources are located in the vicinity of this project. e. Impacts on water quality. All turning basin, access channels, boat mooring areas and any other area associated with a dock. shall have adequate circulation and existing water depths to ensure that a minimum of a one foot clearance is provided between the lowest member of a vessel (e.g. skegs, rudder, prop) and the bottom of the waterbody at mean or ordinary low water (-0.95 NGVD datum). Response: Adequate water depths exist in the areas of the wetslips to avoid scouring of the bottom of the waterbody. ii) The dock shall not' effectively cause erosion, extraordinary storm drainage, shoaling of channels, or adversely affect the water quality presently existing in the area or limit progress that is being made toward improvement or water quality in the area in which the dock is proposed to be located. Response: Flow velocities of the adjacent water body are not great enough to cause significant shoaling or erosion in the vicinity of the proposed structure. The surface area of the proposed dock will not. cause extraordinary storm drainage. The proposed structures will be properly wrapped to ensure that no chemicals will be leached into the water, causing water quality degradation. The dock shall not have a material adverse impact upon the conservation of wildlife, marine life, and other natural resources, including beaches and shores, so as to be contrary to the public interest. Response: The proposed dock will not have a material adverse impact upon the conservation of wildlife, marine life, and other natural resources. As part of this project sixteen (16) bay balls will be placed beneath docks. Bay balls promote and support natural species diversity and population density. Fish life is abundant in and around bay balls since they are designed specifically to create marine habitat. Over 1/2 million Reef Balls (large bay balls) have been used in over 3,500 projects in 43 countries as designed artificial reef habitat. Additional information on bay balls can be found at www.reefball.org. ii) The dock shall not have an adverse impact on vegetated areas; vegetative, terrestrial, or aquatic habitats critical to the support of listed species providing one or more of the requirements to sustain their existence, such as range, nesting or feeding grounds; habitats which display biological or physical attributes which would serve to make them rare within the confines of the city; designated preservation areas such as those identified in the comprehensive land use plan, national wildlife refuges, Florida outstanding waters or other designated preservation areas, and bird sanctuaries. Response: In order to satisfy this requirement, two (2) manatee awareness signs and one (1) manatee educational sign are included in this project. The manatee signs will increase the awareness of the residents who access the proposed structure. g. Impacts on wetlands habitabuplands. The dock shall not have a material adverse effect upon the uplands surrounding. Response: No material adverse impacts to the adjacent upland area will be created as a result of the construction of the proposed dock. h. Dimensional standards. Setbacks. All commercial and multi-use docks shall be located so that no portion of such dock is closer to any property line as extended into the water than ten percent of the applicant's property width measured at the waterfront property line. Multi-use private and commercial docks abutting adjacent waterfront single-family ortwo-family properties must be setback a minimum of one-third of the applicant's waterfront property width from the adjacent waterfront single-family ortwo-family property. Response: The proposed dock will not be located adjacent to any single-family or two-family properties and thus should be allowed setbacks of ten percent of the applicant's waterfront property width of 150 feet. This would allow the proposed dock to be no closer than 15 feet from adjacent extended property lines; the proposed setback is 19 feet from the northern riparian rights line and 24.5 feet from the southern riparian rights line. ii) Length. The length of .commercial and multi-use docks shall not extend from the mean high water line or seawall of the applicant's property more than 75 percent of the width of the applicant's property measured at the waterfront property line. The width of commercial and multi-use docks shall not exceed 75 percent of the width of the applicant's property measured at the waterfront property line. Response: The proposed dock's width of 107.5 feet is less than the 112.5 foot (75%) width allowable with the applicant's 150 feet of waterfront property. iv) Covered boatlifts. Covered boatlifts are permitted provided a permanent and solid roof deck is constructed with material such as asphalt shingles, metal, the or wood. Canvas and canvas like roof materials are prohibited. Vertical sidewalls are prohibited on any boatlift or dock. Response: No covered boatlifts or vertical sidewalls are part of the proposed project. v) Deviations. Deviations from the requirements of this section may be considered and approved by the community development board in order to comply with the review criteria established in sections 3-601.C.3.a-g.
