I have enclosed a copy for the Review Panel's reference. All issues have been addressed or information provided as follows... 1. Signed and sealed original survey provided. 2: Affidavit completed on page 7 by current owner. The scheduled closing is for Tuesday of next week. 3. As we discussed, the Residential Infill Criteria was enclosed with my original submittal and you were satisfied with it. I used the wrong application form. 4. The ISR Calculation was not correct for the new plan because the pool and spa were not classified correctly as you had suspected. The permeable area is 2810 sq. ft. of 7104 or 40% and non-permeable area 4294 or 60%. The property was revisited and found that the current permeable surface area is 3827 sq. ft. or 54 %. 5. Both areas on the -sides of the landing in front of the steps are green areas. As evidenced by the front elevation, the steps for the home are recessed inside the front boundary of the house in line with the garages 15 ft. gin. from the west property line. The paved landing in front of the house is at the same elevation as the fmished floor of the garage and has anon-structural divider separating it from the planting areas on either side. The divider is 20 in. high, 8 in. thick and extends out from the front approximately 7 ft. 6 in. There is a small column with a ball at the ends of the dividers as a decorative element. We have planned on modifying the upper floor plan to include an optional family room with a fireplace. The bedroom #2 will also have a fireplace. The towers above will serve as a vents for the fireplaces. They will also be used for exhaust and stack vents. I appreciate your consideration for this application. RECEIVED Responses to Flexibility Criteria: Section 2-203.B&C FED 02 2D07 Front Setback: PI~1NIfi9G DEP~triVIENT CITY OF CI.EARiN,4TER The planning and designing of this project took into consideration the previously approved setbacks of 15 feet granted to many of the gulf-front and bay-front homes in recent years. The most recent of which is 745 Bay Esplanade. Merely three houses north of this project. This nearly completed project, also adjacent to a paper street is constructed to a uniform setback to many others houses north and south of it on Bay Esplanade. The reduction of the front setback will not affect adjacent property values because it allows for better site lines from their homes to the bay. The alternative would be to move the structure closer to the bay than the existing home on the property. Modern day design calls for a larger footprint than those of 60 years ago when this house was first built. The reduction will be consistent with the neighborhood character of varying front setbacks. As evidenced by the attached floor plans, the reduction allows for an efficient house, pool and green area layout. Rear Setback: The reduction in the rear setback applies only to the pool deck for this property and not the structure. The addition of a pool to the newly constructed house on this property will certainly enhance the livability of it as well as providing an opportunity to relocate some of the trees in a more appealing way. Currently the rear of the property is overgrown with undesirable foliage and is generally poorly maintained. The reduction in the rear pool setback will allow for the development of a substandard lot as compared to the recently approved plans of the adjacent properties. Like the front setback the pool setback reduction will result in a more efficient layout. The pool will be buffered with new and existing more strategically placed landscape material. The existing fence is unsightly and will be replaced with one of the same dimensions. This will be more aesthetically pleasing to adjacent properties and passers by. Side Setback: The existing south (right) side setback for the current structure on this property is 5 feet. The new structure will follow the same line. This will allow for the same area that currently exists for vegetation. The only reason a south side setback reduction is necessary is because the property line abuts a paper street. A 25 feet setback would only allow for an 18 feet wide footprint otherwise making the project not feasible to build. Height: The design of the home was done with a focus on scale and balance as well as combining unique architectural elements and high quality materials. In that spirit the design called for a steeper pitched roof with many different lines and at different floor levels. It was designed so that the mean roof height is exactly 30 feet from BFE. Additionally, two decorative towers were designed, each extending approximately 3 feet 9 inches above the maximum roof height. Considering them as part of the roof would increase the mean height of the roof on half of the 3 feet 9 inches or 1 foot 10 '/2 inches. That also increases the height from BFE 1 feet 10 1/z inches to 31' 10 1/z inches. We lowered the height of the first towers we designed but felt if we lowered them anymore they would be hardly visible. Since they are located beyond the mid point of the roof they can only be seen standing at ground level when you are a considerable distance away from the home. This height variance will be consistent with the community character and enhance the overall appearance of the project. This increase will be consistent not only with the adjacent property but other gulf-front and bay- front properties with towers. ®RIGIi1~ ~ECEIVE~ FE8 0 2 2007 ~wvNi~~ t~E~AItTiVIE~lT CI1Y OF ~~ EARIIVA~TER Residential infill: This project is asingle-family detached dwelling and is therefore eligible for a residential infill application. The development of this project on this lot would be impractical without allowing deviations from the set development standards previously discussed. The development of this parcel with the requested variances will in no way negatively affect the value of the abutting properties, only enhance it. The uses within the residential infill project are permitted in the district and compatible with adjacent land uses. The re-development of this property according to the plans submitted from the existing structure will upgrade the immediate vicinity, especially the public access to the south. The design creates a form and function on display for the city of Clearwater as a whole and enhances the community character. Flexibility with regard to the front, south side and rear pool deck setbacks requested and specific to this project are justified by the benefits to the community character, the immediate vicinity of the property, the city and its people. ®RIGIf~L RECEIVED FEB 0 ~ 2001 I~LA~INING DEP~-Rl'fVIE~lT CIgY 4F CI.E~aRW~TEk E. Stormwater Narrative: The existing topography extending 50 feet beyond all the property lines is virtually flat as exhibited in the attached aerial at 4 feet in elevation. The exception is the northern abutting property, 733 Bay Esplanade, which is identified as 5 feet at the garage FFE. Another survey with spot elevations in NAVD88 DATUM will be provided with the working drawings upon approval of this plan from the DRC. The proposed garage floor FFE will be 4 feet 7 inches as identified in the plans. The working drawings will confirm the garage FFE will be a minimum of 8 inches above the crown of Bay Esplanade. A slab foundation should be able to be used to maintain the existing grade. The impervious surfaces will be pitched from the FFE of the garage to Bay Esplanade to the west and to the bay to the east. An earthen berm will be created on the north end of the property and should be sufficient since the northern abutting property is one foot higher in elevation.
