Aki City Attorney May 7, 2009 t.. - ORDINANCE NO. 8068-09 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE NEIGHBORHOOD AND AFFORDABLE HOUSING ADVISORY BOARD; AMENDING CODE OF ORDINANCES, ARTICLE 2, DIVISION 9A, SECTIONS 2.226 THROUGH 2.229; DECREASING THE NUMBER OF BOARD MEMBERS FROM ELEVEN TO SEVEN, TO BE AUGMENTED TRIENNIALLY BY APPOINTMENT OF FOUR COMMITTEE MEMBERS BY RESOLUTION; AMENDING POWERS AND DUTIES OF THE BOARD; PROVIDING FOR TRIENNIAL APPOINTMENT OF ADDITIONAL BOARD MEMBERS TO SERVE AS THE AFFORDABLE HOUSING ADVISORY COMMITTEE AND PROVIDING FOR COMMITTEE POWERS AND DUTIES; PROVIDING FOR THE TERMINATION OF TERMS FOR THE ADDITIONAL COMMITTEE MEMBERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Ordinance No. 7981-08 added certain distribution requirements and established the Neighborhood and Affordable Housing Advisory Board as the Affordable Housing Advisory Committee; and WHEREAS, it is advisable to provide that the Affordable Housing Advisory Committee shall be constituted only every three years, as statutorily mandated, and to provide for termination of terms of the Committee following completion of its periodic duties; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Code of Ordinances, Division 9A, Sections 2.226 through 2.229, is hereby amended to read as follows: DIVISION 9A. NEIGHBORHOOD AND AFFORDABLE HOUSING ADVISORY BOARD Sec. 2.226. Creation; membership. (1) There is hereby created and established the Neighborhood and Affordable Housing Advisory Board of the City of Clearwater. (2) The board shall consist of a minimum of seven eleven members, and aUQmented by four members triennially appointed by resolution of the city council pursuant to Section 2.228(4), who are residents of or conduct work in the city. Members shall be appointed by the city council. The board shall include the following: 1. One citizen who is actively engaged in the residential home building industry in connection with affordable housing. Ordinance No. 8068-09 2. One citizen who is actively engaged in the banking or mortgage industry in connection with affordable housing. 3. One citizen who is a representative of those areas of labor engaged in home building in connection with affordable housing. ~ 4:- One citizen who is actively engaged as an advocate for low-income persons in connection with affordable housing. 5. One citizen who is actively engaged as a for profit provider of affordable housing. 4. e. One citizen who is actively engaged as a not-for-profit provider of affordable housing. ~ ~ One citizen who is actively engaged as a real estate professional in connection with affordable housing. 8. One oitizen who serves on the looal planning agency pursuant to F.S. ~ 163.3174. 6. 9. One citizen who resides within the City of Clearwater. 7.40. One citizen who represents employers within the City of Clearwater. . 11. One oitizen who represents essential servioes personnel, as defined in the local housing assistance plan. ********* Sec. 2.228. Powers and duties. The board shall have the follo)Ning powers and duties: The board shall have the following powers and duties: Every three years the board shall review the established policies and procedures, ordinances, I:Jnd development regulations, and adopted local government comprehensive plan of the city and shall reoommend specific actions or initiatives to encourage or facilitate affordable housing while proteoting the ability of the property to appreciate in value. The board shall submit a report to the city that includes reoommendations on and triennially thereafter m,'aluates the implementation of affordable housing incentives in the following areas; (a) The processing of approvals of development orders or permits and expedited permitting for affordable housing projeots. (b) The modification of impact f-ce requirements, including reduotion or waiver of fees and alternative methods of fee payment for affordable housing. (0) The allm"Janoe of flexibility in densities for affordable housing. (d) The reservation of infrastructure oapacity for housing for very 10'll inoome persons, 10'.\' income persons, and moderate income persons. (e) The allowance of affordable aocessory residenti:J1 units in residential zoning districts. (f) The reduction of parking and setback requirements for affordable housing. 2 Ordinance No. 8068-09 (g) The allO'.vanoe of flexible lot configurations, inoluding zero lot line configurations f-or aff-ordable housing. (h) The modification of street requirements f-or aff-ordable housing. (i) The establishment of a process by which the city considers, before adoption, polioies, prooedures, ordinanoes, regulations, or plan provisions that inorease the oost of housing. m The preparation of a printed inventory of locally O'.4Jned public lands suitable f-or affordable housing. (k) The support of development near transportation hubs and major employment centers and mixed UEie developments. The approval by the board of the oity's looal inoentive strategies recommendations and its reviC'.\' of local government implementation of previously recommended strategies must be made by affirmative vote of a majority of the membership of the board taken at a public hearing. Notice of the time, date, and plaoe of the public hearing of the board to adopt final housing incentive strategies recommendations must be published in a newspaper of general paid circulation in Pinellas County. The notice must contain a short and concise summary of the housing incentive strategies recommendations to be considered by the board. The notioe must state the public place ,..,here a copy of the tentative board recommendations oan be obtained by interested persons. VVithin 90 days after the date of receipt of the housing incentive strategies recommendations from the board, the city council shall adopt an amendment to its looal housing assistance plan to incorporate the housing inoentive strategies it will implement. In addition, the board may: ********** (4) Carry out the duties of an advisory committee when and to the extent that an advisory committee may be required for the various state, federal and county housing and community development programs fundina the city receives. Everv three years. the Board shall sit separately as the Affordable Housina Advisorv Committee (AHAC) accordina to Florida Statute 420.9076. In addition to the seven members. four additional committee members will be appointed by resolution of the city council in the followina cateaories: (1) One citizen who is a representative of those areas of labor engaaed in home buildina in connection with affordable housina. (2) One citizen who is actively enaaaed as a for-profit provider of affordable housing. (3) One citizen who serves on the local plannina aaency pursuant to F.S. & 163.3174. (j) The preparation of a printed inventory of locally owned public lands suitable for affordable housina. (k) The support of development near transportation hubs and maior employment centers and mixed-use developments. The approval by the board of the city's local incentive strateaies recommendations and its review of local aovernment implementation of previously recommended strateaies must be made by affirmative vote of a maiority of the membership of the board taken at a public hearina. Notice of the time. date. and place of the public hearina of the board to adopt final housina incentive strateaies recommendations must be published in a newspaper of aeneral paid circulation in Pinellas County. The notice must contain a short and concise summary of the housina incentive strateaies recommendations to be considered by the board. The notice must state the public place where interested persons can obtain a COpy of the tentative board recommendations. Within 90 days after the date of receipt of the housina incentive strateaies recommendations from the board. the city council shall adopt an amendment to its local housina assistance plan to incorporate the housina incentive strateQies it will implement. The appointment of these four (4) additional members shall terminate upon the adoption at the end of each three-year review by the City Council of the amendments to the Local Housina Assistance Plan. 4 Ordinance No. 8068-09 ********* Section 2.
