Hayden Knowlton, CPCU,ARM,AIC Member, Society of Risk Management Consultants 1998 AGREEMENT FOR RISK MANAGEMENT CONSULTANT SERVICES THIS AGREEMENT made on the 1 st day of April, 1998, by and between the CITY OF CLEARWATER (" CITY") and WATERS RISK MANAGEMENT of Seminole, Florida ("Consultant"); WHEREAS CITY desires the Consultant to provide to it certain risk managementJinsurance/self- insurance consulting services; and WHEREAS the Consultant desires to provide such services upon the terms and conditions here- inafter set forth: NOW, THEREFORE, be it agreed as follows: 1. During the term of this Agreement, the Consultant shall provide the following risk manage- ment and insurance/self-insurance consulting services to CITY: Request for Qualifications Process The Consultant shall prepare a Request for Qualifications (RFQ) for insurance brokers who will be prequalified to go to market for various types of property/liability/workers compen- sation/self-insurance. The Consultant proposes to prepare an RFQ to assist the City in de- termining which firms will be sent copies, to review the responses when received, to prepare spreadsheets and to assist the City in designating which firms shall be chosen as finalists. Request for Proposals Process The Consultant shall prepare a Request for Proposals (RFP) to be utilized by the pre-selected insurance brokers to take to market to solicit competitive proposals for the following types of insurance: property, flood, inland marine, boiler and machinery, crime, marina operators li- ability, storage tank liability, general liability, automobile liability, emergency medical serv- ices liability, police professional liability, public officials liability, and workers compensa- tion. Third party administration and managed care services proposals are not to be included in the solicitation. The Consultant shall assist the City in determining options and program alternatives to be considered in the RFP process, to assist and conduct a pre-proposal conference, to receive, review, and spreadsheet proposals, and to assist in reaching a purchase decision and .presen- tation of the program recommendations to the City Commissioners. 2. Term: This Agreement is effective April I, 1998 and terminates at the conclusion of the de- scribed projects. ~- ~... ...... I I 1998 Agreement for Risk Management Consultant Services ,., page 2 3. Consultant's Personnel: The Consultant shall employ at his own expense, persons, agents or subcontractors to perform the services required by this Agreement. Persons, agents or sub- contractors performing professional services who are not regularly employed by the Consult- ant shall be subject to CITY approval. 4. Comoensation: CITY shall pay the Consultant for professional time at the rate of $130.00 per hour for principal consultant and $120.00 per hour per hour for other consultants for pro- fessional time, and $25.00 per hour for clerical time. CITY shall also pay the Consultant for reasonable out-of-pocket expenses, including duplicating and printing, long distance tele- phone charges, postage and freight, and travel and lodging, The total billable amount of pro- fessional time for the projects proposed shall not exceed $9,000. ' 5, Submission of Statements: The Consultant shall submit to CITY no more often than each month an invoice for services rendered and expenses incurred along with details of profes- sional and clerical time expended and related expenses.
